Egypt to bring in law allowing man to have sex with dead wife

LONDON: Egypt’s new Islamistdominated parliament is preparing to introduce a controversial law that would allow husbands to have sex with their deceased wives up to six hours after death.

Known as the Farewell Intercourse law, the measure is being championed as part of a raft of reforms introduced by the parliament that will also see the minimum age of marriage lowered to 14 for girls.

Egypt’s National Council for Women is campaigning against the changes, saying that “marginalising and undermining the status of women would negatively affect the country’s human development”.

Dr Mervat al-talawi, head of the NCW, wrote to the Egyptian People’s Assembly speaker Dr Saad al-katatni addressing her concerns.

Egyptian journalist Amro Abdul Samea reported in the al-ahram newspaper that Talawi complained about the legislations, which are being introduced under “alleged religious interpretations”.

The subject of a husband having sex with his dead wife arose in May 2011 when Moroccan cleric Zamzami Abdul Bari said marriage remains valid even after death. He also said that women have the right to have sex with her dead husband, alarabiya.net reported.

It seems the topic, which has sparked outrage, has now been picked up by Egypt’s politicians.

TV anchor Jaber alQarmouty slammed the notion of letting a husband have sex with his wife after her death. “This is very serious. Could the panel that will draft the Egyptian constitution possibly discuss such issues? Did Abdul Samea see with his own eyes the text of the message sent by Talawi to Katatni?” the Daily Mail quoted him as telling the website.

Re-think on age of consent for sex: Court to lawmakers 

Says Changing Social Attitudes,Sensibilities Must Be Considered 

New Delhi: Lawmakers should re-think on the existing law regarding age of consent for sex keeping in mind the changing social attitudes,a Delhi court has said.
It is time for the legislators to have a re-think regarding existing law by creating certain exceptions and of making allowances regarding the age of the consent/protection keeping in view the changing social attitudes and social sensibilities, additional sessions judge Kamini Lau said.
The court made the observation while acquitting a youth,facing trial for kidnapping and abducting a young girl here in October 2008 with an intention to compel her to marry him.
The court said both the girl and the accused were in love and had eloped due to opposition by their families but now both of them are residing separately and happily married.
The legal system in our country cannot be used to punish youngsters in love who are at the verge of attending majority and this court cannot ruin their lives by taking a hypertechnical view especially so when the age gap between these youngsters is within acceptable limits and does not reflect an exploitative coercive situation, the court said.
In the present case,both the girl and boy being happily married,the matter is now required to be finally rested and under no circumstances,the future of these youngsters can be destroyed by exposing them to their past, it said.
The court acquitted Ashok Vihar resident Krishan Rai Chaudhary,who was accused of kidnapping a girl on October 20,2008 with an intention to compel her to marry with him against her wishes.She,however,was rescued on the same day from Wazirpur Industrial Area here.
According to police,an FIR was registered on a complaint by the father of the girl who said that she used to work in kothis and on October 20,2008 at 7am,she had gone to work but thereafter did not return home till evening.
He stated that he searched for his daughter in the locality but she could not be located and he expressed his suspicion upon Krishan Rai Chaudhary who was residing in the same locality and was also not present at his house.
During the trial,the father and mother of the girl said she was a minor when she was kidnapped and after seven months of the alleged incident,she was married to a Bihar-based man and they are now living happily.
The parents told the court that they have not informed the husband of their daughter about the incident and requested the court not to summon her as her matrimonial life would be ruined.Ossification test of the girl was conducted and as per the medical record,she was of 18-19 years at the time of the alleged incident.
The court noted that in cases where there is not much difference between age of the partners engaged in sexual act,allowances in the age of consent have been made worldwide.Many jurisdictions world over have made allowances regarding age of consent in cases where there is not much difference between the age of older partner and that of the minor engaged in the sexual act.The enforcement of this practice of the age of consent law varies at different places depending upon culture,social sensibilities and changing societal attitudes, it said.PTI

Proposal To Make Sex Illegal For Teenagers Up To 18 Years Of Age Flies Against All Logic And Draws Fire From Experts

Adecade ago,canoodling couples in Bandra,an uptown Mumbai suburb,were rounded up by the police.A few months ago,a Ghaziabad policewoman pounced on young lovers on park benches,pulling the men by their ears and publicly humiliating them.Elsewhere,a group of mothers in Manipur are cracking down on teenage couples in restaurants,threatening them with sticks and videocameras.
While the countrys conservatives have,for long,declared war on adolescent sexuality,the law may be set to follow suit,with a new bill in the Rajya Sabha that criminalizes teenage sex.The Protection of Children from Sexual Offences Bill (2011) had a provision for consensual sexual activity between the ages of 16 and 18,but the caveat has now been dropped from the bill,effectively criminalizing teenage sex.It renders poor an otherwise good legislation.
Deleting the consent clause has created a furore among the countrys child rights activists,feminists and the medical fraternity.Many believe that the new law will not only lead to unnecessary police harassment of young couples,but also high-risk sexual behaviour in the absence of any social support.
Do we want to start punishing young people for premarital sex Do we want them to start wearing chastity belts The authorities have gone overboard in removing the age of consent for those between 16 and 18,especially in a scenario where young people are getting sexually active at an early age.This is stupid and goes against the child, says academic Madhu Kishwar,founder of Manushi,an organization that works for democracy and womens rights.
Meanwhile,the National Commission for the Protection of Child Rights NCPCR) has taken a consistent view against criminalizing sexual exploration among those between 16 and 18.Penalizing such activities will only add to the confusion.The law can be used against both boys and girls.Anybody,from parents to neighbours,can complain to the authorities,who will,in turn,take action against the youngsters.As a result,something very natural will now become distorted,secretive and unacceptable.This will have consequences for how we organize our society and relations between boys and girls, says Shanta Sinha,chairperson,NCPCR.
The caveat for consensual sex between the ages of 16 and 18 has been dropped despite advice to the contrary from NGOs,advocates and organisations that represent women and children.While we are against the sexual exploitation of children,we have taken a position against criminalizing teenage sex,as those between 16 and 18 are known to explore their sexuality, says Nandita Shah,co-founder of Akshara,an NGO that works for the uplift of women,and was involved in consultations over the drafting of the bill.
Actor Rahul Boses The Foundation,which works towards fighting child sexual abuse,is among the organizations which have written to the government against criminalizing teenage sex.We know of instances where boys between 16 and 18 have been sent to jail for consensual sex with a girl.The new law is highly regressive and will result in an increase in such instances and also make it dangerous to engage in physical relationships.This,in turn,will lead to a rise in risky sexual behaviour.The health risks increase for girls,while boys will be threatened with jail.No gender will benefit, says Suchismita Bose,director,The Foundation.
Activists say theres nothing wrong in mutual consent sex in the age group 16 to 18,provided theres proper sex education and inculcation of awareness about sex-related risks.However,they draw a line when theres sex between,say,a 16 year-old and a 40-year-old,as the possibility of the younger one being either forced or tricked is high.We need a nuanced law,not a blanket ban, says an activist.
The lack of sex education in schools does little to remedy the situation.While both psychiatrists and sex surveys point to the fact that teenagers are increasingly getting sexually active,and hence there is greater need than ever for sex education,a parliamentary panel headed by BJP leader Venkaiah Naidu had led the charge against the introduction of sex education in schools in 2009.
Doctors believe that the lack of information on sex,coupled with the threat of jail for teenagers indulging in sexual activity,is disastrous as it will make sex not just clandestine but a high-risk activity.Dr S Krishna Kumar,a gynaecologist from Thane,gets three to five cases of teen pregnancy a month,with the girls seeking medical termination of pregnancy.If sex between 16 and 17 year olds is a crime,such cases will be forced to go underground,resulting in an increase in unsafe abortions, says Kumar.
I have handled many teenage pregnancies.Youngsters,many of them under 16,are known to indiscriminately pop Ipills and other emergency contraceptives to prevent conception, says Ahmedabadbased gynaecologist Dr Rajal Thakker.
This bill will not serve any purpose.Age of sexual contact has gone down remarkably and the adult-child is a reality, says psychiatrist Dr Harish Shetty,president of the Counsellors Association of India.He feels that punitive law of this kind will not stop sexual abuse but only increase corruption.It refutes the changing times and is a denial of the current reality.Taking away the provision of consent puts a heavy price on any attempt at sexual exploration by kids in their lateteens.If a 19-year-old boy has sex with a 17-year-old girl,will you put him away in jail"asks Shetty.Besides,this will lead a spike in honour killings,suicides and parents of one child blackmailing others.While Ahmedabad-based clinical psychologist Dr Pooja Pushkarna describes the governments denial of adolescent sexuality as the ostrich-like approach,Delhi psychiatrist Dr Jitendra Nagpal says this is an over-ambitious attempt on the part of the government to alter behaviour patterns.It could lead to kids using more dangerous ways of experimenting or result in more young people eloping, says Nagpal.Sexual contact typically begins between the ages of 12 and 14 in our metros,he says.With intercourse starting between ages of 15 and 18.With the overwhelming opinion against criminalizing teenage sex,there is still time for a rethink.Although the cabinet has cleared the bill,Parliament should review the proposal and ensure our laws are in tune with the times.

New Delhi: It is ostensibly for their own good,but teenagers between 16 and 18,dont quite agree.They feel that the raising of the age of consent from 16 to 18 just goes to show how unaware,or worse,in denial policy-makers are of current situations.
A large part of the debate hinges on the question of maturity,whether a 16-year-old is capable of taking informed decisions.Youngsters in the 16-18 age bracket believe they are not only mature but also adequately circumspect about such decisions.Most young people are mature these days, says Saurav,a XII-grader from Delhi.He should know.At 17,he has numerous friends who are sexually active and careful about it.With the internet,everybody has access to information.They know all about sex and the possible consequences, he says adding that a girl would think a hundred times before giving consent. 
I know these people, he continues,they know what they are doing but despite all that theyll now be vulnerable to harassment. 
The dropping of the age of consent from the bill criminalizes intercourse with and between youngsters.But members of the group concerned feel what they really need is information,not another legal sanction.Appropriate education,they feel,will allow them to exercise their choices responsibly.
We should have correct education about sexuality instead of the increase in the age of consent, says a class XI student from Ahmedabad.Because of easy access to pornography,youngsters are curious, he says,My friends and I have explored physical relationships. Psychiatrists counselling teens agree.
Delhi psychiatrist,Avdesh Sharma,says the way to protect children is not by imposing a law but by giving them information and creating channels of communication. 
Backward and conservative. Thats what 16-year-old Rahul says about dropping the age of consent clause.Criminalizing something natural is not fair.It wont really help.If two 16-year-olds want to have sex,they will.My friends abroad are free to do it, he says.Laws should be in step with social changes.The age of consent must be decided upon keeping in mind the prevalent culture.Laws need to be relevant and acceptable, says Chandni,a student at DAV College,Chandigarh,the parents cant stop kids,the government wont be able to either.Theyll find other ways.

Regressive clause clashes with IPC rape laws

New Delhi: If the Bill seeking to protect children from sexual offences is passed by Parliament in the form in which it was cleared last week by the Cabinet,then there will be a direct but unstated conflict between the general and special laws on rape.
Under the special law proposed in the freshly revised Protection of Children From Sexual Offences Bill,no person below 18 years will have the legal capability to give consent for engaging in any kind of sexual activity.This flies in the face of the general law,Indian Penal Code (IPC),which recognizes 16 as the age of consent for girls.
The uncertainty inherent in this conflict makes a mockery of the lofty intentions with which the age of consent is sought to be increased from 16 to 18 as it may serve as a loophole for the accused even in the most serious cases of sexual offences against children.
The Bill in its original form,as introduced last year in Parliament,did not contain any such contradiction.In keeping with the definition of rape in Section 375 of IPC,the Bill,envisaging special safeguards for children,expressly said that where penetrative sexual assault is committed against a child between 16 to 18 years of age,it shall be considered whether the consent for such act has been obtained against the will of the child or the consent has been obtained by use of violence,force 
This eminently sensible caveat to clauses 3 and 7 of the Bill has since been deleted by the Cabinet,thanks to a recommendation made by a parliamentary standing committee headed by Congress leader Oscar Fernandes.Little thought appears to have been paid to the implications of removing those IPCcompliant clauses from the Bill.How can the age of consent be both 16 and 18 in the same sexual context under two different laws 
In its report tabled in Parliament in December,the standing committee addressed this critical question cursorily.All it said was: Section 375 of IPC would operate in totally different circumstances when compared with provisions in clauses 3 and 7 of the present Bill. The claim is far from true as one of the clauses in the special legislation,clause 3 of the Bill,dealing with penetrative sexual assault,would fall squarely under the ambit of Section 375 of IPC.
Equally dubious is its claim that the recommendation to make consent irrelevant up to the age of 18 even in sexual matters was in consonance with the countrys commitment to the United Nations Convention On The Rights Of The Child (UNCRC).For,nowhere does the UNCRC stipulate that the age of consent for sexual activities should be fixed at 18.This is borne out by the fact that an overwhelming majority of the countries,including advanced democracies,have adopted an age of consent that is below 18.
The only source from which the standing committee could have drawn any kind of justification for its recommendation to increase the age of consent is a draft Bill put out by the home ministry over two years ago to amend various provisions of IPC,including Section 375.The draft criminal law (amendment ) Bill proposed,among other things,to increase the age of consent in the rape provision from 16 to 18.If the home ministry has since made no visible progress on this draft Bill,it could well have been at least in part because of the adverse reactions it might have received from feminists and human rights defenders of the controversial proposal of criminalizing teenage sex.
It is curious that elements of the executive (home ministry) and legislature (standing committee) came up with such proposals even after the law commission headed by a retired Supreme Court judge had twice in recent years debunked the idea of increasing the age of consent.The first time was in 2000 when the law commission headed by Justice B P Jeevan Reddy specifically said in its review of rape laws that the existing age of consent should be retained.Then,while proposing amendments in 2008 to the child marriage Act and allied laws,the commission headed by Justice A R Lakshmanan reiterated the need to maintain the present age of consent.

Removal of consent caveat makes no sense

If the aim of the Protection of Children From Sexual Offences Bill is to protect children from b e i n g s e x u a l ly abused by adults,the removal of the c o n s e n t cl a u s e makes no sense.
Revising the age of consent from 16 to 18 is tantamount to criminalizing teenage sex between children who are 16-18 years old.If the legislation aims at punishing adults who sexually abuse children,how does the removal of the consent clause help Such a step will only make the bill regressive.Besides,in India,the question of who a child is,is itself a highly complex issue.This could further complicate the concept.
Importantly,even the original consent clause,which was subsequently removed from the legislation,doesnt spell out in detail whether consent is invoked only when both parties are between 16 and 18,or whether one of them can be above 18.There can always be a situation where one is between 16 and 18 and the other an adult.The bill needs to specify whether this is allowed and to what extent.For instance,if the girl is between 16 and 18 and the man 30 or 40,this should not be allowed.The law needs to be clear before it can be used to protect children.
If you want to protect children from abuse,you cant bring consensual sex between teenagers under the criminal law.Force and violence against teens cannot be used under the guise of protecting them.
The removal of the age of consent for those between 16 and 18 contradicts the IPC.It is also something the moral police will take advantage of resulting in harassment of youngsters.

New sex bill will club India with Rwanda,Uganda

New Delhi: Going by just the number of countries,the global average for the age of consent is 16.The governments proposal of criminalizing consensual sex with any person below 18 will put India in the company of countries such as Rwanda,Uganda,Chile,Peru and Egypt,none of whom can be counted among liberal democracies.
While the age of consent across the world ranges from 13 to 18,the bulk of the countries,including the most liberal ones,have it at 16.Thus,India is currently bracketed with Britain,Norway,Canada,Switzerland,Israel,Russia,South Africa and a majority of the states of the US.
But if 11 US states,including California,took the conservative option of fixing the age of consent at 18,its impact has been softened by a close-in-age reprieve.This means that if the minor has three or fewer years of difference with the major,or if both partners are under the age of consent,they will be prosecuted for the minor offence of misdemeanor rather than statutory rape.
The principle of taking a lenient view of close-in-age relationships is adopted in several western countries.The absence of such a safeguard in the protection of children from sexual offences bill,which was cleared last week by the Cabinet,makes the proposed increase in the age of consent more regressive and draconian.
If the bill is passed by Parliament in its current form,the only countries that will be harsher than India on teenage sex are those that do not recognize any age of consent at all.In Islamic countries like Saudi Arabia,Yemen,Iran and Pakistan,any sex outside marriage is illegal and liable to severe punishment,even if it is entirely consensual.
The few countries that swung to the other extreme of reducing the age of consent to as low as 13 have adopted different safeguards to avert dangers of licentiousness.
Though the national law in Japan puts 13 as the age of consent,local laws in most municipalities have overridden it with higher limits.Interesting,a lot of football powerhouses have a low age of consent,ranging from 13 to 15: Spain,Argentina,Brazil,Germany,Italy,Portugal,France,Uruguay and so on.

As TOI has maintained raising the age for legal sex from 16 to 18 is a bad idea.Only a clutch of illiberal countries have it as 18 years.Why should India join that club The age for legal sex should stay at 16.Further,where the age gap between two partners is less than five years,consensual sex should be decriminalized even if a partner is a teenager less than 16 years old.There can be some deterrents if the age gap is higher.The proposal to hike the legal age for sex also smacks for an urban bias.In villages,getting married before the age of 18 is common.Would they all be treated as criminals now Educating people about the advantages of a later marriage is one thing,but making teen sex illegal ignores the reality and criminalises innocents.There is also the risk that such a move could lead to a spurt in young girls going to quacks for abortions to escape the clutches of the law.Suicides and honour killings too might rise with this ill-thought-out measure.

அடுத்த நாள் திருவனந்தபுரம் வந்த அவர்கள் நேர் முகத்தேர்வுக்கு அரபு நாட்டில் இருந்து ஆள் வராததால் தேர்வு நடைபெறவில்லை என கூறி அந்த பெண்ணை திருப்பி அனுப்பிவிட்டனர்.இந்த சம்பவம் நடந்து ஒரு ஆண்டு ஆகிவிட்ட நிலையில், மீண்டும் அனீசும், சுரேசும் அந்த பெண்ணை தொடர்பு கொண்டு கற்பழிப்பு காட்சிகளை படம் எடுத்து உள்ளதாகவும், அதை இன்டர்நெட் மூலமாக வெளியிடப்போவதாகவும் கூறி அந்த பெண்ணை மிரட்டி ரூ.21/2 லட்சத்தை அபகரித்து விட்டனர். மீண்டும் மீண்டும் அந்த பெண்ணை மிரட்டி பணம் கேட்டு தொந்தரவு செய்ததால் மனம் நொந்த அவர் தனது கணவரிடம் இதுபற்றி விவரம் தெரிவித்தார்.நிலைமையை புரிந்து கொண்ட அவரது கணவர் மாநில டி.ஜி.பி.யிடம் புகார் கொடுத்தார். புகாரின் அடிப்படையில் சம்பவம் குறித்து விசாரணை நடத்த நெடுமங் காடு துணை போலீஸ் சூப்பி ரண்டு கே.முகமதுவுக்கு டி.ஜி.வி. உத்தரவிட்டார்.அதன் பேரில் பொன்முடி போலீஸ் நிலையத்தில் வழக்கு பதிவு செய்யப்பப்டு, பாலோடு சர்க்கிள் இன்ஸ்பெக்டர் பிரதீப்குமார் தலைமையில் விசாரணை நடந்து வந்தது.இந்த நிலையில் அனீஷ், சுரேசிற்கு அனைத்து வகையிலும் உதவி செய்த கல்லரை குற்றிமூடு தினேசை போலீசார் கைது செய்தனர். கைதான தினேசிடம் போலீசார் தீவிரமாக விசாரணை நடத்தி வருகிறார்கள்.

Wife insisting on condom not mental cruelty

Mumbai: Planning when to start a family cannot be treated as cruelty,said the Bombay high court on Thursday,while upholding the family courts dismissal of a mans divorce plea.
Adivision bench of judges P B Majmudar and Anoop Mohta was hearing a petition by Pradeep Bapat,30,who said that during their honeymoon his wife Prerna,26,had refused to have sex unless he wore a condom and subsequently refused to conceive on the grounds that they were not financially stable.
She must not have shown willingness to become a mother unless there was financial stability.She wanted to give the child a better life, said Justice Majmudar.It is a mutual decision and a husband cannot insist, said Justice Mohta.
The reply of Bapats advocate Why do people go for honeymoon raised a few titters in the courtroom.
The judges also held that Pradeeps other grounds for seeking divorce not knowing to cook,not being religious,not parting with salary and not folding clothes properly did not amount to cruelty either.Bapats lawyer said his family wanted a working graduate as his wife,who would live in their joint family and also do housework.To this,Justice Majmudar said,A woman is not a slave.Her right of freedom of speech cannot be taken away.You have put (common household troubles) in the petition.If we construe these as cruelty,then no marriage will be safe. 
Observing that Bapats family was conservative and full of perfection,Justice Majmudar said,You (Prerna) should not have selected this house. 
Her advocate replied,She was the eldest (child) and unless she married,her younger sister would not have been able to do so either. Justice Majmudar said,Girls are still treated as a burden on parents.A girl must know to which family she is going (after marriage). 
The judges said the case was an eye-opener for those who were yet to marry.They said that especially in the case of arranged marriages,the prospective husband and wife should get to know each other and see if they could live happily together.
The judges were told that Prerna was willing to return to her marital home,but Bapat did not want her back.The couple married in February 2007;Prerna left her marital home in June the same year.
The judges noted that in a short span of time,the relationship between Prerna and Bapat had become strained.Also,Prerna was subjected to illtreatment.A girl coming into an entirely new atmosphere would have expected love and affection.The husband and his family are required to see to it that a (newly) married woman does not feel that she has come to an absolutely strange place, the judges said.

Girls paraded naked at childrens home

Rohtak (Haryana): A National Commission for Protection of Child Rights team raided a home for minor girls in Haryanas Rohtak Wednesday night and found inmates were regularly beaten,molested and made to work as labourers on farms and construction sites.The home is run by an NGO,Bharat Vikas Sangh that won the Haryana governments Indira Gandhi Woman Empowerment Award in March carrying a cash prize of Rs1 lakh.
Headed by Jaswanti,the childrens home has about 60 girls,most of them minors.Around 12 girls,mostly in early teens,alleged they were exploited and harassed by Jaswanti while one alleged being forced to sleep with a man.
During the raid,a group of girl inmates told the team,We were molested by various people.If any girl protested,she would be paraded naked and beaten up. 
The NCPCR team comprising Vinod Kumar Tikoo,Dinesh Lahoria,Ajay Kumar and Ramanathan Nayyar were accompanied by local police during late night raid.The NCPCR directed the police to register a case against the home owner and staff and arrest them immediately.
The NCPCR team asked Poonam Raman,programme officer (PO) of Rohtaks child and women development department to take charge of the home and send daily reports.
Speaking to TOI,Tikoo said,The inmates were exploited right under the nose of the administration which did not bother to check whats going on at the home.

Human trafficking racket busted,4 held 

Chennai: The city police on Tuesday busted a human trafficking racket in which women from Kerala were taken to Singapore and forced into prostitution.Following a complaint by one of the victims,police arrested two men,Sathya and Johnson,on charges of kidnapping the woman and her friend.They also arrested two others who were involved in the racket.
Police said the woman had been to Singapore on four occasions and knew some of the members of the gang.During her last visit to the city,the gang had taken away her passport, an investigating officer said.She came to the city on Tuesday and asked Shahnawaz for her passport.He said it was with a friend and made her get into a car.
While driving towards Anna Nagar,the two men turned on Shahnawaz and asked him to call up his contacts and arrange to give them Rs 1 lakh,failing which they would abduct the woman.Shahnawaz called his friend,who alerted the police.Police officers monitored the drop-off point and arrested the two men when they came to collect the money.Police rescued the woman.
In another case based on a complaint by the same woman,police arrested Shahnawaz and Ahmed Kalam,who had forced the girl into prostitution and taken her passport.TNN

Law on age of consent regressive,says court

New Delhi: Terming a new law that raises the age of consent for sex from 16 to 18 years as undemocratic and regressive,a trial court feared it will act as a tool for the police to harass minor children.
The Protection of Children from Sexual Offences Act (PCSOA),passed by Parliament in the recently concluded session,criminalizes all sex by teenagers.
Such a move would open the floodgates for prosecution of boys for offences of rape on the basis of complaints by girls parents irrespective of whether the girl was a consenting party, said additional sessions judge Virender Bhat.
While the court made it clear that it was against teenage sex and shared the concern of parents and the government,it said raising the age bar was not a solution to the problem.A better option would be to impart sex education in schools,the judge said.
Good virtues cannot be inculcated and good conscience cannot be imbibed in a child by legal provisions.It would be better and wiser to leave this job to parents and school teachers.Children need to be imparted sex education in the schools, the judge said while sending a copy of the order to the law department and the National Law Commission.

The observations were made while acquitting one Sandeep Paswan,facing trial for kidnapping and raping a minor girl who had eloped with him.The two had married at an Arya Samaj Mandir in Lucknow.
According to the police,the 15-year-old girl had gone missing from her house in January 2011.Her father then reported the matter to the police on February 17,2011 and an FIR was registered.The girl was found in August 2011 from a village in Uttar Pradesh where she was living with Sandeep as his wife.
While absolving Sandeep of the charges,the court noted that it was clear from the girls testimony that she eloped with him as they were in love.
The court said,with the advent of cable television,internet and rapid changes in biological factors,children were getting exposed to knowledge about sex and marital relations at an early age.
With the result,cupid strikes them at an early age,before they attain majority.Since parents are always opposed to such an alliance,may be rightly so,the loving couple elope, the judge observed.
The court said even boys in some cases become victims as they do not understand the consequences of their actions and are sometimes lured by the girl.
Such cases should be an eye opener for the worthy lawmakers of our country,who,I understand,are contemplating raising the age limit for consensual sex from 16 to 18 years.Gone are the days when a child of 16 or 17 years of age was ignorant about sex and the desire to have sex, the judge said.
The order comes on the heels of another judge,additional sessions judge Kamini Lau raising similar concerns.

We are in complete agreement with the observation of this trial court that the new law is likely to become a tool to harass teenagers rather than one that protects them.Unfortunately,the law has already been passed by Parliament and given presidential assent.We would still urge our lawmakers to reconsider what they have done and amend the law to ensure that consensual teenage sex is not criminalized.Neither Parliament nor the government should see this as a matter of their prestige.What is important is what is good for our young and that should remain the prime consideration.Sticking to a bad law does not enhance the authority of the state,it diminishes it.

Deserted woman sells twin daughters for 40K

Tirunelveli: A 32-year-old woman,left penniless after being deserted by her husband,sold her twin daughters in Tirunelveli.Police officers who arrested her said she sold the babies for Rs 25,000 and Rs 15,000.Police also arrested five others who arranged for the sale of the infants to two childless couples.
Police said Selvi,32,of Naduvakurichiin Tirunelvelidistrict,lived alonein Suthamalli after her husband Sudalai deserted her around a year ago.Selvi had an eight-year-olddaughter and gave birth to twin girls in January.After looking after them for five months,Selvi,a daily wage worker,felt she would not be able to raise them alone.
Though she did odd jobs while nursing the infants,Selvi found it difficult to make ends meet, a police officer said.
Het neighbour Fathima,34,suggested that Selvi sell her twins.Fathima made arrangements to sell one of the girls to Ayyasamy and Mariammal,a couple residing in Thittangkulam near Kovilpatti.Fathimas relative in Melapalayam,Sulekha,helped her strike the deal.Fathima also fixed the sale of the second infant to Muniswaran,a resident of Housing Board Colony in Tenkasi,with the help of Ponnuthayi of Sambavar Vadakarai, the officer said.
Muniswaran in turn sold the baby to Thangasamy of Vadalivilai in Kanyakumari district, the officer said.The other baby was sold to Ayyasamy for Rs 25,000. 
Police arrested Selvi,Fathima,Sulekha,Muniswaran,Ponnuthayi and Velusamy,who acted as a conduit in the sale of one of the girls.All six were producedin a localcourt andsentto prison.
Selvi told the police that she was struggling to raise three children.She said that she had yet to receive any money from the sale of the babies.
Even before giving birth to the twins,Selvi expressed apprehensions about raising the children on her own, the officer said.Fathima had assured thatshewouldtakecareof thechildren.Fathima apparently planned to sell the babies before they were born.Fathima even paid for medication when Selvi gave birth. 
Members of Saranalayam,an NGO,informed the police about the sale of the babies.

Filing false case valid grounds for divorce: HC

Chennai: Levelling false allegations and filing false cases against a spouse is indeed cruelty and a valid ground for divorce,the Madras high court has said.
Justice S Vimala,reiterating this established legal position,passed an order to this effect last week in a case where a woman had accused her husband of extramarital affair,suspecting her character,demanding dowry and subjecting her to cruelty.During cross-examination in a trial court,however,the woman admitted that the allegations were false.She also wanted to be reunited with her husband.Though a subordinate court had ordered restoration of her conjugal rights,the high court has said such an order cannot be sustained.
The admissions made by the wife during cross-examination are strange and shocking.There is clear-cut admission that the husband did not demand dowry and there was no cruelty on account of that.The allegation regarding illegitimate intimacy of the husband with other woman is also admitted to be false, Justice Vimala rued.
The relationship between the husband and the wife is always very deep but delicate.Trust is the hallmark of maintaining the relationship.Because of the deep intimacy,one partner making false allegations causes irredeemable damage.The wife has chosen to castigate the character of the husband,alleging that the husband is guilty of misconduct by maintaining illegitimate relationship with another woman.Certainly the allegations regarding dowry and illegitimate intimacy (which are admitted to have been falsely made) would amount to mental cruelty.Time and again,the Supreme Court has held that filing of cases with false allegations against the husband itself would amount to mental cruelty.Therefore,it is clear that the wife is guilty of cruelty. 
Noting that the wife had sounded death knell to her own matrimonial life,Justice Vimala said she must reap what she sowed.The judge,however,lamented the fact that for over a quarter century the couple had lived apart,and that since their marriage on June 10,1984 they had lived together hardly for one year.The couple,related to each other even before the marriage,ought to have honoured the marriage by celebrating the silver jubilee.They have made the marital life miserable by fighting with each other in court for more than a decade, the judge observed.

Woman offers to bear child for her mother

Ahmedabad: In a role reversal,a daughter has offered to become surrogate for her mothers child! A first of its kind case in Gujarat,a daughter has agreed to nurture the fetus for nine months to ensure that her mother completes her family.
Anand-based surrogacy specialist Dr Naina Patel said that Radhika Patel,32,consulted her along with her husband to become surrogate for her mother Lalita,52.Lalita,who had lost her husband eight years ago,recently got married to a widower,Mohan Patel,57.Since her new husband does not have any children from his first marriage,the newly wed couple was keen to have a child of their own.With age not on their side,they were wondering if their dream to have children can be realized.It is here that the daughter and son-in-law pitched in with their support.
The daughter has a son and a daughter.She said she was ready to undergo surrogacy for the mother as a child would make her new innings happier.They have agreed to use the new fathers sperms and egg of an anonymous donor,said Dr Patel.The daughter told Dr Patel that her mother has lived a lonely life especially after the marriage of her younger sister.
Now she wishes complete happiness for her, said Dr Patel.A few years ago,a 43-year-old woman shot to limelight when she successfully became a surrogate mother to twins on behalf of her infertile daughter.Her Londonbased daughter and sonin-law was suffering from infertility issues since a long time and the mother struck an extraordinary deal with daughter that she would become the surrogate and help save her daughters marriage and give her their bundle of joy.

Chennai: She holds the wine glass with consummate ease,cleaves the meat without staining the table cloth and dabs her mouth with a handkerchief after a meal.At this point,25-year-old Rita Jacob bursts into a nervous giggle before regaining her composure.The weather is quite pleasant.Would you like to go out for a walk she asks with a faint British accent,before breaking into splits again.
Her wedding is just a month away and she still has a lot to learn how to eat,walk,dance and be courteous.She is one of the students at a finishing school in Anna Nagar that teaches how to be a sociable bride and wife.My fianc has made a list of skills I need to pick up before I join him in London, says Jacob,who is set to marry an Indian Foreign Service officer.
Though still in nascent stages in Chennai,new-age finishing schools are drawing an increasing number of brides-to-be.When a woman marries a man,she is not establishing ties with him alone,but his entire family.These skills go a long way in helping her deal with this new phase, says Gerard Assey,who runs Etiquette Works,a grooming school in Anna Nagar.

Chennai: The bridal finishing schools in Chennai teach the women a range of skills from the art of carrying oneself to home dcor and personal grooming.They also give tips on how to manage the household budget,how to interact with future in-laws,dining and ****tail etiquettes.
Most of the brides who approach these schools are usually from the middleclass and upper middleclass,who are timid and want to learn to be more social,elegant and graceful,says Gerard,who underwent a training in etiquettes in the US.Although his school caters largely to corporates,Gerard started a separate department for brides after a few of his corporate clients approached him to help them gear up for their big day.
Grooming experts have attributed the sudden spurt in brides evincing a penchant for grooming to various reasons.The middle class is willing to spend a lot more on weddings now.Besides,women give a lot of importance to the way they look and are more conscious about their body language, says fashion designer Rehane,who runs Transcend Academy,a grooming school for women in Chennai.
Rehane says such programmes go beyond mere personal grooming.People may write off such finishing schools saying why should someone shell out a fortune just to learn how to walk and talk,but looking and feeling good builds your confidence which,in turn,helps in the long run, she says.
The programmes can last between three days and six months,and cost anywhere between Rs 10,000 to Rs 50,000,depending on the duration and the skill sets.While finishing schools in Chennai have started looking up.Some brides-to-be enroll sign up for crash courses at centres in Hyderabad,Delhi and Mumbai.

Hisar: A khap panchayat in a Hisar village in Haryana has banned mobile phones for youngsters and ordered girls not to wear jeans and T-shirts.Organising a DJ party is out of bounds and a complete prohibition on liquor has also been issued.
The decision was taken by the panchayat at Khedar village.Sarpanch Shamsher Singh said,We have decided to ban alcohol as it is the main reason behind rapes.We have also banned jeans and T-shirts for girl students as it is not a proper dress. 
Shanti Devi,a middle-aged woman present at the panchayat,said,The decision of the panchayat is good and will check the harassment of girls.Poor dressing is the main reason behind rapes.
The panchayat formed a 11-member committee to ensure the decision is implemented.We welcome the decision of the panchayat and anyone organizing a DJ party in the village will be fined Rs 11,000.Our main purpose is to close alcohol shops in the village as liquor is the main reason behind attacks on women, said panch Mahaveer Singh,a resident of the village.
Youngsters have opposed the diktat.The decisions will prove to be counter-productive.The mobiles can be useful in alerting parents or the police in case of assaults, said Ram Kishan,a young man from the village.
