NEW DELHI: Post Congress's poor show in UP, recrimination has been mixed with the hunt for a stable vote bank in a state where caste remains a key arbiter of power.

While UP Congress leaders are waiting to see how the party reinvents its caste appeal, the competition and jostling among social groups like OBCs, dalits and upper castes has become the party's focal point. The lament of Brahmin leaders has been particularly loud with Congress's minority-mandal push coming a cropper.

Matters came to an interesting point during a recent review meeting when the upper caste/Brahmin argument was invoked by a local UP leader saw Congress leader Rahul Gandhi rebutting the claim by remarking "I am a Brahmin...and general secretary in the party."

The comment was read as a counter to the argument that the party had ignored its traditional, albeit alienated base, in its quest to regain salience in UP. Although upper castes have lost their dominance in the state, leaders from these sections remain vocal and pushy in their advocacy.

A week after Rahul Gandhi conducted the review of the UP election, leaders are counting on two decisive steps for moving forward - action against non-performers and a clear idea on which social group to lean on. The urgency stems from the view that there should be enough time for party message to reach the grassroots for 2014 Lok Sabha polls.

The upper caste, OBC and dalit camps in Congress are vying for the leadership's attention. According to sources, Rahul's review saw leaders speaking of the need to fashion a "base vote" like Yadavs forSamajwadi Party and dalits in case of BSP. Upper castes felt Congress could not ignore its traditional catchment group, particularly as it has switched loyalties and seems open to being wooed.

The poll defeat seems to have complicated the Congress search for a social combination to renew its appeal among voters two decades after the Babri demolition pushed it to the margins. Congress pegged the election campaign on backwards and Muslims. Dalit leaders feel Rahul's strategy to win over key social group, initiated by his visits to their huts, would pay off in the long run. That has led to suspense over the Congress leadership's new choices.

The post-poll audit brought out common refrain from all contending groups: Congress needs a base vote. But sources said it was easier said than done to come up with a target constituency.

While backwards, including MBCs voted for SP, dalits stuck to BSP which, despite the scale of its defeat, was only 3% votes behind the winner. Thakurs, a dominant upper caste, sided with SP. In contrast, Congress bid to woo the Mandal classes, with steel minister Beni Prasad Verma being projected as a mascot of sorts, did not work while the approach put off upper castes.

Sources said the brainstorming evoked sharp reactions with senior leader Ram Lal Rahi saying that focusing on Jatavs and Yadavs was a waste of time as they were not ready to leave BSP and SP. Some others felt Congress needed to keep trying. A leader quoted an election survey to argue a section of Jatavs had left BSP.

 

No leader opposed the Muslim gambit but most felt it failed because the 4.5% quota was brought up too close to elections and the message did not percolate down to the masses.

National Herald affair: It’s fraud all the way

The bare facts exposed by Dr Subramanian Swamy on the National Herald affair this month are eloquent, needing very little prose. The fraud is explicit without exposition. Here are the basic facts. Financial crisis forced Associated Journals Limited (AJL), the publishers of National Herald newspaper founded by Pandit Nehru, to close down the paper in 2008. To pay off the employees to help the closure, the Congress Party had given interest-free loan of Rs 90 crore plus to AJL, then. With the newspaper shut, AJL had become a mere real estate company in 2008, with property in Delhi, Lucknow and Mumbai worth over Rs 2,000 crore in its balance sheet. Against this, AJL owed just Rs 90-crore plus to the Congress. It had very little liability, besides. The balance real estate of AJL, left after paying off the dues to Congress, legally and morally belonged to AJL’s thousand plus shareholders. Big and small, they had contributed Rs 89 lakh to AJL’s capital, when the Rupee was hundred times more valuable. If AJL’s real estate had been sold and cash distributed to the shareholders,     Brahm Dev Narain, a teacher holding just 41 equity shares in AJL, would have got some Rs 84,000. Hundreds of others would have got similar sums.

But, by deep design and defying both law and morals, Sonia Gandhi and Rahul Gandhi appropriated — actually misappropriated — control of AJL’s Rs 2,000-cr real estate without paying a dime to AJL’s shareholders. In just three months, between November 2010 and February 2011 and in three moves, control of thousands of crore worth property passed onto the Gandhi family. Here unfolds the sordid story.

As the first step, in November 2010, a trust company named “Young Indian” was mysteriously formed with a capital of just Rs 5 lakh, in which Sonia Gandhi and Rahul Gandhi owned 38 per cent each (total 76 per cent) and two family retainers, Motilal Vora and Oscar Fernandes, owned the balance 24 per cent, making it cent percent Gandhi family outfit. Second, the very next month, December 2010, the Gandhis got the Congress party to assign the Rs 90-cr plus loan given to AJL in 2008 to Young Indian (read themselves) by paying to the party just Rs 50 lakh. The Congress wrote off the balance Rs 89.75 cr as irrecoverable. This creative — actually criminal — accounting substituted Young Indian for the Congress, entitling Young Indian to recover Rs 90-cr plus due from AJL. Finally, in February 2011, AJL converted the Rs 90-cr plus due to Young Indian into equity shares and allotted them. By this step, Young Indian became almost 99 per cent owner of AJL, and as much of the real estate of AJL. When AJL had assets worth Rs 2,000 cr, why should the Congress write off Rs 89.75 cr due from it as bad debt? Would the Congress have done it for any person outside the Gandhi family? And did the Congress Working Committee or AICC know of, or consent to, donate Rs 89.75 cr to the Gandhis through Young Indian? More. In the founding documents of Young Indian the one word that is totally absent is “Congress”! The design is self-evident. The Congress should be out completely and the Gandhi family should exclusively grab control of the AJL’s lands at Delhi, Lucknow and Mumbai worth thousands of crores for pittance. And it did happen.

The rest of Young Indian’s story stinks even more. With the Gandhi family and loyalists holding its entire capital, the directors of Young Indian — besides Sonia and Rahul, are Vora, Oscar, Suman Dubey and Sam Pitroda — are time-tested friends of the family. But, what is the object of Young Indian? Young Indian says its first annual report (April 27, 2012), “is engaged in activities to inculcate in the minds of India’s youth commitment to the ideals of democratic and secular society”.

See what is the first act of this idealist company, after its birth in November 2010, to “inculcate” such ideals in youth. Its annual report shows that the company forthwith started its “operations in December 2010”, and as its first act in pursuance of “its objects”, it acquired the “loan owed” by AJL “for a consideration of Rs 50 lakh”, by which it became AJL’s 99 per cent owner. So the first act of Young Indian to promote idealism in Indian youth was to defraud the Congress party of Rs 89.75 crore on the one hand and the shareholders of AJL of thousands of crores of money on the other. See how the plot thickens.

Young Indians’ annual report discloses a further design — to alter the character of AJL itself. It says that AJL is recasting “its activities” to align its objects, Young Indian’s “main objects”. Finally to merge AJL into Young Indian? And “as part of the restructuring exercise of” AJL, says the annual report, the “loan was converted into equity”. A joke indeed! Young Indian speaks as if it is helping to restructure AJL. Young Indian is a pauper. Its director’s report shows that, from its inception in November 2010 to March 2012, its total income was — believe it — just Rs 800! Its total expenditure was Rs 69.79 lakh and its loss, after deducting its income (Rs 800) was Rs 69.78 lakh. Does the AJL, with huge real estate, need an asset-less and income-less pauper Young Indian for its restructure?

See the deepening design. Young Indian’s annual report intentionally conceals the crucial fact that the loan of Rs 90-cr plus owed by AJL to it was originally due to the Congress party — the intention being that Young Indian looted the Congress should be concealed. The report also suppresses the fact that AJL with asset base of a couple of thousands of crores had become (almost) its wholly-owned subsidiary. It says, in fine print, that shareholders — who? Sonia, Rahul, Vora, Oscar, Dubey and Pitroda! — will get information regarding the subsidiary on request.

This is a fraud on company law, which mandates that the details of the subsidiary be available to the public. More. Young Indian also totally suppresses its 99 per cent holding in the AJL saying that the shareholding “is treated as application on the object of the company” and so “the same has not been reflected as an investment in shares”. This deceptive accounting jargon means that the payment of `50 lakh for 99 per cent of shares of the AJL worth thousands of crores is shown not as an asset, but as expenditure! Why? Obvious.

To keep the investment out of the balance sheet of Young Indian! The annual report blatantly lies that since the net worth of AJL is negative, its investment in 99 per cent capital of AJL is written off as expenditure.

The balance sheet of AJL as on March 31, 2011, shows a positive net worth Rs 8 crore; of which Young Indian’s 99 per cent share is Rs 7.92 cr. So the negative net worth story is a fabrication. The real net worth of Young Indian is, of course, over Rs 2,000 cr.

And the final lie. After Dr Swamy’s expose, the Congress, with tears in its eyes, told the nation on November 3, 2012, that revival of National Herald, a symbol of Gandhi-Nehru ideals, was an “emotional issue” for the party, as if it has paid Rs 90 cr plus now for Herald’s revival. It had paid the amount in 2008 to help close, not revive, the Herald. Just three weeks before the Congress shed tears to revive National Herald, on October 11, 2012, ‘The Pioneer’ newspaper reported that Rahul Gandhi was emphatic that Young Indian had no intention of relaunching any newspaper. By an email to ‘The Pioneer’, Rahul Gandhi’s office said: “Young Indian is a not-for-profit company and does not have commercial operations.... The company has no intention of starting any newspaper”. Any more evidence needed to prove that the sobbing story of Herald’s revival is fake? A post facto lie?

So. The Gandhi family usurping the AJL’s Rs 2,000 cr real estate, with the funds of the Congress and through Young Indian, is fraud all the way. On the Congress. On the shareholders of AJL. And on the National Herald.

Pandit Nehru said: “I will not let the National Herald close down even if I have to sell (my own house) Anand Bhawan”. And now? The Gandhis have buried the National Herald and looted its real estate.

Umrao Khan is a driver who retired from Rajasthan's state-run roadways. More than 10 years ago, he had bought 50 bighas in Sujasar village, about 20 kilometres from Pokhran, best known for being India's nuclear test site, at Rs 3,000 a bigha. Across a dirt track lay a vast stretch, the villagers put it at 1,600-1,700 bighas, where the proposed Rajasthan Solar Processing Zone (RSPZ) was to come up.


But four years after the land bank was developed by Jodhpur-basedAshapurna Buildcon, the solar energy zone RSPZ, which spills over into the adjoining village of Galar, remains a rusting board standing in the middle of the desert.

That's because Gajner, another non-descript village about 180 kilometres north-east on the highway to Bikaner, weaned away two solar power generation projects that RSPZ had planned to kickstart with. (DESERT SAFARI)

Originally famous for a lake-side palace-turned-luxury hotel, Gajner is fast emerging as one of the largest renewable energy hubs, thanks to a special interest shown in the region by Congress President Sonia Gandhi's son-in-law, Robert Vadra, who has built a formidable land bank here through Mahesh Nagar, brother of a Faridabad-based Congress politician. Here is the story of how an aam village lost its solar plants and the developments these would have brought to a VIP village.

A portion of the RSPZ boundary, marked by white stone pillars, is still visible. Adjoining Khan's plot is a piece of land which once belonged to his cousin but is now owned by the Jodhpur-based developer.

"Is jaga ka mera chowkidaari hai (I keep a watch on this land)," Khan said.

At the top right corner of this plot, a few photovoltaic (PV) plates are mounted at an angle of 60 degrees on a metal frame about the size of a mini-theatre. There is an empty room painted in white-and-blue. To an onlooker it seems as if some solar-related activity is on, till Khan throws in the spoiler.

"Nothing is produced in there. Even the power for the single bulb is drawn from my house," he chuckles.

RSPZ was supposed to be a full-fledged solar park, with a total capacity of 100 megawatt (Mw). Among the companies that lined up to set up shop were Fonrochie Energie, a five-year-old French firm focusing on renewable energy, started by a young solar entrepreneur, Yann Maus. Fonroche's India plans were to commence with two plants with a combined capacity of 20 Mw in the land Khan guards.

Wooing Fonroche
Enter Vadra. Though the Rajasthan government had put up a 220-Kv grid sub-station on National Highway-15 that cuts through Gajner, making his holdings close to this station ideal for solar plants, none of the project developers who won the competitive bidding under the government programmes chose Gajner.

Vadra lacked a credible anchor who could move in first and spark the development in several hundred hectares of desert he had bought.

Fonroche, with its international credentials and enviable track record in solar energy, fitted the bill perfectly. While founder Maus still holds about 52 per cent, private equity fund Eurazeo holds 39 per cent in the company. Fonroche has entered into an equal joint venture with Mumbai-based PR Clean Energy for its India operations. The joint venture, called PR Fonroche, plans to invest up to Rs 800 crore this year.

Business Standard investigations reveal Fonroche bought Vadra's land in May 2012, four months after it had finalised plans in Sujasar. Though it had entered into power purchase agreements citing project location as Sujasar and nearby Galar, Fonroche changed its mind and picked the land Vadra had to offer. A little over six months later, it announced the launch of its first plant from Gajner.

Global companies such as Fonroche and Indian corporate groups such as Reliance,Tatas. Mahindras, L&T and Welspun are rushing to catch the Indian sun, largely due to the impetus provided by a central government programme called the Jawaharlal Nehru National Solar Mission or JNNSM, which under the 'Solar India' brand aims to establish India as a global leader in solar energy, "by creating the policy conditions for its diffusion across the country as quickly as possible."

"The 80 per cent accelerated depreciation available to project developers in the first year itself is a big draw for investors," said an official of a power company.

How the mission works
The mission has set a target of 20,000 Mw to be achieved in three phases (first phase up to 2012-13, second phase from 2013 to 2017 and the third phase from 2017 to 2022) for various components, including grid-connected solar power. JNNSM has proposed a mechanism of "bundling" relatively expensive solar power with power from the central government's unallocated quota generated at NTPC's coal-based stations, which is relatively cheaper. This "bundled power" would be sold to the distribution companies. JNNSM also provides for NTPC's Vidyut Vyapar Nigam Ltd or NVVN to be the designated nodal agency for procuring solar power by entering into power purchase agreements (PPAs) with solar power generation project developers. "For each Mw of installed capacity of solar power for which a PPA is signed by NVVN, the ministry of power shall allocate to NVVN an equivalent amount of Mw capacity from the unallocated quota of NTPC coal-based stations and NVVN will supply this "bundled" power to the distribution utilities," according to the policy.

Rajasthan's Jodhpur-Jaisalmer- Bikaner belt has the highest solar irradiation in the country, at 6.4-6.6 kilowatthour per square metre. This area, which also has 12 hours of sunlight for at least 330 days every year, is best suited to put solar plants.

That's why in the first batch of phase-I, 20 of 28 solar project developers chose locations in Rajasthan. In December 2011, the government awarded the bids under phase-I, batch-II of the mission. Some 24 developers emerged winners. Among these were Fonroche Raajhans Energy and Fonroche Saaras Energy.

From Sujasar to Gajner
In January 2012, both companies entered into a power purchase agreement with NVVN. According to the list of project developers put up by NVVN, reviewed by Business Standard, Fonroche Raajhans was to put up a 5-Mw plant in "Gram Galar, near Ramdevra, Tehsil Pokhran." Similarly, the location of a 15-Mw plant for which Fonroche Saaras signed the PPA was mentioned as "gram Sujasar, near Ramdevra, Tehsil Pokhran." This was because at this point both firms had got into a memorandum of understanding or MoU with the developer of RSPZ, which spread across these two villages. "We had an MoU with Fonroche and a couple of others. But they did not keep their commitments," said Arjun Singh of Jodhpur-based Ashapurna Buildcon.

Ghewar Singh, Sujasar-based landlord and farmer, said the 'companies' have been buying land in the region since 2009. "They have bought in 'thukkadas' (small pieces). Kisi se das bigha, Kisi se sou.(10 bighas from some, 100 from some) The rates have also varied from Rs 5,000 to Rs 25,000 for a bigha." In Rajasthan, 3.965 bighas make a hectare.

Ghewar's brother, Badam Singh, an elderly man with a white pagdi and glasses, said nobody would sell for less than Rs 50,000 a bigha today, though rates have touched Rs 10 lakh near the highway. "The actual setting up of plants may not make a big difference if there are no incentives for the local communities such as jobs or free electricity," said Singh. The older brother sits with regional newspapers strewn around him and identifies Fonroche as the company that bought land from Vadra. Even some of the younger Sujasar residents connect Vadra with Fonroche, which twists their tongue. But none of the villagers are aware that Vadra's gain was their loss.

Sale deeds registered in Kolayat, the registry under which Gajner falls, reviewed by Business Standard, showed that on May 23, 2012, Vadra's frontman, Nagar, executed four different deals with the Fonroche twins. Through these, the two firms bought 62.44 hectares of Gajner land for Rs 4.24 crore.

While the developer said Fonroche backtracked, the company said the requisite infrastructure was not in place in Sujasar. "At the time of entering into the PPA, we had a basic MoU with the developer in Sujasar to discuss the possibility, depending on their ability to provide the necessary infrastructure," said Pratap Raju, joint managing director of PR Fonroche. "We had an EPC tie-up with Mahindras. Since the infrastructure was not ready in time, we started looking for land between January and April and zeroed on the land in Gajner." An email sent to Vadra's personal assistant, Manoj Arora, seeking comments, did not elicit any response.

Raju said he did not know the seller was a company related to Vadra when the deals were done. "We got to know only when the newspaper reports started coming in October that we might have bought from him." He said it would cost about Rs 30 lakh a km to build a 33-Kv transmission line as specified by the government. "In Rajasthan, land is everywhere. The price of the land comes to only three per cent of the total project cost. Assuming we put up the project some 15-20 km from the power station, evacuation costs (of power) alone would have been around Rs 6 crore," he said, adding the price of land should be seen in this context. Others do not agree with these evacuation cost estimates.

Power-evacuation costs
Helped by Mahindra Solar, its EPC partner, Fonroche has begun power generation in its Gajner-based plant. Located just a stone's throw from the 220-Kv grid sub-station, evacuation costs are minimum.

Across the road from the plant, Nandkumar Naik, who runs a shop, points to the land parcel behind him. "That is about 70 acres. Reliance has bought. They are trying to buy more. Once it is complete, they will start setting up the plant," he said.

Along the trail of 33-Kv towers, one B M Developers is putting up a 5-Mw project 10 km from the Gajner sub-station. A few Tamil-speaking engineers are completing the electrical work. One says land prices have shot up from Rs 1 lakh an acre, the rate at which their client bought, to Rs 8 lakh. Besides these, not much work could be seen in Gajner, though many are said to have bought from Vadra and others.

About 15 km away, near Kolayat, is a substation. A couple of projects are coming up a few kilometers from here on the road to Deh. Charan Kumar Chowdry is working for a Rays Power Experts project. Chowdry, who travels 45 kilomtres daily from Bikaner, says engineers like him are in demand. He was a cluster manager with Reliance Communications before cashing in on the solar boom.

The company he works for is putting up a park model, wherein it is allowing "small investors" to buy capacities of as low as 250 Kv. (1,000 Kv make a megawatt). "Maximum size available here is 10 Mw, which could cost about Rs 70 crore," said Chowdry. He gives different numbers for the transmission towers. According to him, a tower costs Rs 1-2 lakh and a tower is needed every 200 metres. That puts evacuation costs at a fraction of what Fonroche estimates.

Yet to see a plant
Though Sujasar residents do not realise this, it appears to be among the few places in the original list yet to see a plant come up. Nearby solar hubs such as Dhursar, on the Jodhpur-Pokhran road, and Askandra have received big investments from companies such as Reliance Power and Lanco Infratech.

"About 150 people worked in shifts when the construction was on. Now it's down to 60-65," said Durjar Singh, who works for G4S Security Services, which mans the Lanco plant. He says the project spreads over 4,000 acres.

About 90 km from Pokhran, in Phalodi taluk of Jodhpur district, several other projects have sprung up. A 25-km stretch between Bap on the National Highway to Bikaner and Kanasar is dotted by Welspun, Punj Lloyd and Green Infra Solutions projects, most of these commissioned. A Haryana-based developer Conflux Infratech has even put up a 1-Mw plant just off the highway. "It's about 21 bighas," the young security guard said.

Once the photovoltaic plates are set up, not much manpower is required to run a solar energy plant, apart from security and maintenance staff. "Dusting of the plates from sand is a typical problem in Rajasthan. A 20-Mw plant would require about 30 people for maintenance," says a Bikaner-based solar entrepreneur.

The Fonroche effect
Meanwhile, in Sujasar, after Fonroche, LEPL Projects, a Vijayawada-based developer also pulled out. Ashapurna's Arjun Singh said he had roped in Andhra-based Srisakthi Alternative Energy to revive the park in Sujasar-Galar, which Rahamatullah, the teenage driver of a Phat-Phat argues, is in Dudhia and not in Sujasar.

"We have already received commitments for 70 Mw from some reputed corporate names. We are in the process of tying up the rest. Some government approvals for the park are also pending," said Arjun Singh of Ashapurna Buildcon.

The villagers say it's the Tatas who are in talks now. "They want the developer to build the approach road before finalising the deal," one of them said.

"I said I want to buy here only, as my father and relatives had land holdings here," Umrao Khan of Sujasar said. Khan and his sons have turned their land into an island of green amid the vast stretches of wasteland with nothing but tropical shrubs. Khan won't sell, though he says he has received offers of up to Rs 2.5 crore. "I make up to Rs 5-7 lakh out of this land every year," he said.

Fed up with calls about the project, Khan says he tells people that the armed forces have taken over the place and it is a shooting range now. "Dalal bahut ho gaye. Pareshan karte hain." Who are these dalals? How can they be reached? "Everyone is a dalal these days. Even farmers, anyone. Bas itna hi bolna hai. Zameen hai. Dila sakta hoon. Ban gaye dalal (All you have to say is you can get land and you are a broker)."

Khan wouldn't tell if he was referring to the biggest of them all. But a smirk spills out of his beard, leaving no room for doubt.

Unravelling Vadra's land deals: Reaping a rich harvest in barren Bikaner

A three-member panel appointed by the Haryana government to look into charges against Robert Vadraof breaching the Land Ceiling Act has given Sonia Gandhi's son-in-law a clean chit. But Headlines Todayhas unearthed more proof of Vadra's suspicious land deals.

Documents with Headlines Today show Robert Vadra broke the law buying land in Rajasthan, much above the prescribed ceiling. It indicates that Vadra is set to reap a windfall from the vast swathes of land bought by him in the arid Bikaner. Thanks to an amendment to the law by the Ashok Gehlot govt heading the state.  

While Robert Vadra may have bought several hundred acres of land before the Amendment to the Land Ceiling Act, Headlines Today has specific information of four transactions which total 321.78 acres - nearly double the permissible limit of 175 acres.

The first is in Basti Chauanan village in Bikaner: 218 acres of land were bought in 2009 by Vadra's frontman Mahesh Nagar, the man who struck all the deals for Robert Vadra in Kolayat region.

The second tract of land bought was in Gajner Village. Here Vadra bought over 36 acres of land on June 4, 2009. The land deal documents mention, Mahesh Nagar as the buyer on behalf of Blue Breeze Pvt Trading Ltd, a company that has Robert Vadra as its director.

Vadra bought another 27 acres land in Gajner village, again on June 4, 2009. Once again the buyer was Mahesh Nagar.

On June 12, 2009, Vadra mopped up 39 acre land again in Gajner village. Mahesh Nagar bought this land on behalf on Blue Breeze Trading.

 spoke to one of the sellers in Bikaner, the man from whom Vadra bought the biggest tract of land, Vineet Asopa. He said, "I got to know that the land was being bought by Vadra only during registry. I was surprised that my barren piece of land was being bought at a premium. I got an expert to check the land for the presence of minerals. I sold more than 350 bighas of land to Vadra."

Mahesh Nagar to whom Asopa sold his land is only the authorised signatory, not the owner of the land. The companies he represented for the land deals - Real Earth and Blue Breeze - have Robert Vadra as the majority stakeholder. Vadra owns 99 per cent equity in Real Earth with his mother Maureen owning the remaining one per cent.

According to the Ministry of Corporate Affairs website, there are only two shareholders in Blue Breeze Trading Private Limited - Robert and his mother Maureen.

 has exclusive access to copies of cheques issued in the name of M/s Real Earth Estates Pvt Ltd, which bear the signatures of Robert Vadra. These cheques paid for buying land are proof that Vadra was operating through his front man Mahesh Nagar.

Headlines Today tracked down Mahesh Nagar, the frontman for Robert Vadra, in Faridabad. But he refused to respond after promising to speak to Headlines Today.

These transactions are in clear violation of the Rajasthan Imposition of Ceiling on Agricultural Holdings Act, 1973 as Vadra had crossed the maximum permissible limit of 175 acres by April 2009.

Vadra bought more than 321 acres of land between April 2009 and August 2010.

In September 2010, the state government amended the more than three-decades-old law and scrapped the ceiling on land. The amendment was loaded with retrospective clause making all previous acquisitions legal, spurring Vadra to buy more land in the region. The move, just one month apart, raised eyebrows.  "Clearly, the government's move to bring an amendment was aimed at benefiting someone. Even if he (Vadra) had acquired properties through several companies, it frustrates the essence of the law," says Prateek Kasliwal, a lawyer in Jaipur.

After amending the law to scrap ceilings on land purchases, the Rajasthan govt sat on the Centre's directive to create a land bank for solar projects for almost 3 years. This gave Robert Vadra the legal cover to carry on with acquisitions at a blinding pace in barren stretches which three years later became the state's solar hub.

The BJP alleges that Vadra was privy to the plan about a rich harvest in the wasteland. Its MP Arjun Ram Meghwal says, "We want a probe into Vadra's land transactions. While the government delayed setting up a land bank, companies linked to Robert Vadra came here and purchased land through brokers. They bought land in Bikaner, Kolayat, Phalodi, Barmer and Jaisalmer."

And here's how Vadra made a quick profit in Bikaner. He bought 81.35 acres of land in Bikaner's Kolayat regions and later sold it for a solar power project to an Indo-French company, Fonroche Saaras, at six times the price. Vadra made 612 per cent profit only in one transaction. The price of land had shot up six times during those two years.

On June 4, 2009, Vadra's frontman again bought 27.5 acres in Gajner and sold it for over six times the price. He bought the land for over Rs.13 lakh and sold it for over Rs.75 lakh to Fonroche Rajhans.

The two moves of changing the Land Ceiling Act and the sudden rush to build solar projects have led the Opposition to accuse of collusion between the Rajasthan government and Robert Vadra. He will need to start answering these charges soon.

Truth vs Hype: The 'Talented' Robert Vadra


But a closer look at these transactions, both those contained in the Khemka report and beyond, suggest that property traders, Congress politicians, state governments and business houses appear to do extraordinary favours to Mr Vadra to ensure that he becomes a multi-millionaire without spending a penny. 

In his 100-page report, the deal that Ashok Khemka spends the most time on, is what he claims is Mr Vadra's illegal purchase of a piece of land in Shikhopur, Gurgaon, which Mr Vadra's company Skylight Hospitality bought in February 2008.

 
The sale deed records that Mr Vadra bought the land from Onkareshwar Properties through a cheque of Rs. 7.5 crores from Corporation Bank, which Mr Khemka argues is a bogus transaction since Mr Vadra's balance sheet, had only Rs. 10 lakh as paid up capital.

Mr Khemka also refers to Corporation Bank's clarification that they had extended no such overdraft and the Rs. 7.5 crores is simply a book entry in Mr Vadra's balance sheets. 

The actual payment to Onkareshwar happens only six months later, by which time Mr Vadra had sold the land to DLF, and had money in his bank. Mr Khemka says this makes the sale illegal, because no money changed hands at the time of registry, nullifying the Vadra-Onkareshwar deal. Moreover, by registering a cheque which they never intended to cash, Mr Khemka claims Mr Vadra and Onkareshwar effectively lied before a public servant, which is punishable with a jail sentence of seven years.

Mr Vadra himself remains unreachable. 

But senior Supreme Court lawyer, KTS Tulsi, speaking in defence of Mr Vadra says the deal is not illegal in the least. He told NDTV, "sale is transfer of ownership, transfer of property and if it is immovable property for the money paid or promised or partly paid and partly promised. So if it is not paid, it's a sale. If I am willing to sell for something which you will pay me after 10 years or you will pay my children, it's a valid sale. I'm transferring ownership."

Independent legal voices also say illegality is hard to prove. 

Property lawyer Vinay Singh told us "when you hand over the cheque, the payment is made. Now the encashment may take place at any point of time in the future. It does not matter when the encashment takes place. Since the payment has been made down the line, effectively the transaction has closed, seller does not have the case that he hasn't received the consideration. So effectively I don't think that this is an issue at all."

But others say that this is a classic benami deal, with Mr Vadra simply being a front for DLF.

Prashant Bhushan says "it is a classical benami transaction, because in this case though the sale deal is between Mr Onkareshwar and Mr Vadra's company Skylight, but since the consideration for this sale is actually paid by DLF after four months and Mr Vadra enters into a back-to-back agreement with DLF for reselling the same land to DLF immediately thereafter for 58 crores. It is quite clear that in this whole transaction, Mr Vadra has acted as a benami for DLF. The real sale is between Onkareshwar and DLF and Mr Vadra has been engaged as a broker to get the land use change permission or rather the colonisation permission from the (Bhupinder Singh) Hooda government." 

But rebutting this Mr Tusli says, "the allegation is that after Vadra had become the full owner, he enters into an agreement with DLF and that is when the DLF pays him money. That can't make the previous transactions benami. See there is a time gap and their own allegations do not constitute even a benami. There is no illegality, there is no crime, there's no benami."

While Mr Vadra's defenders may deny any illegality, is a clear pattern of political cronyism evident in Mr Vadra's land deals?

One of the directors of Onkareshwar is Sandeep Dahiya, the nephew of Chief Minister Bhupinder Singh Hooda's wife.

Another director is Sushil Gupta, a Rohtak resident also said to be close friend of Mr Hooda.

Another director is Satyanand Yajee, also close to Mr Hooda, seen with the chief minister at a function of the All India Freedom Fighters Organisation (AIFFO), of which both are members.

Mr Yajee was in-charge of constructing a memorial for Chief Minister Hooda's father Chaudhary Ranbir Singh in Rohtak.

We tried to contact Mr Yajee at his house in Delhi's Freedom Fighters Colony. 

We also tried at the office of the Freedom Fighters association at Jantar Mantar, where pictures of Mr Hooda and Mr Yajee's father are hung on the walls. But all our efforts came to nought as he has not been home for the last few days and didn't answer calls. 

Onkareshwar's fortunes changed dramatically after their deal with Mr Vadra. 

From a loss of Rs. 23 lakhs, Onkareshwar registers a huge profit of Rs. 55 crores for the first time in 2009, thanks to a series of clearances for realty projects in and around the same village where Mr Vadra bought land.

Onkareshwar also has links to companies owned by controversial Congress politician Vinod Sharma. Mr Yajee's Onkareshwar Properties shares the same office as Mark Buildtech owned by Kartikeya Sharma, son of Mr Sharma. 

Onkareshwar invested about Rs. 25 crores of its profits in Kartikeya Sharma's media companies.

The Chief Minister repeatedly refused to answer our questions.

The illegality behind these deals may be hard to prove, but they fit in with a pattern of Mr Vadra doing land deals in Congress-run states, often using local real estate players with Congress links.    

As we found last year, in at least two Congress-ruled states, he used the same politically connected frontman: Mahesh Nagar as his power of attorney. 

Mr Nagar's brother is Lalit Nagar, who got a Congress ticket to contest the 2009 Haryana assembly elections - many believe only because of his association with Mr Vadra.

Though Lalit Nagar lost, his posters are all over the villages of Faridabad in Haryana, where Mr Vadra is said to have acquired 400 acres of land in 2007.  

Mahesh Nagar also acquired almost 300 acres of land for Mr Vadra about 1000 miles away in Bikaner in Rajasthan. 

The land he bought is wasteland, but as the site of an emerging solar energy hub, is drawing many other speculators.

But Mr Vadra's purchases started just three months after Ashok Gehlot came to power, and the solar energy thrust here is being overseen by the Centre's Jawaharlal Nehru Solar Energy Mission.

Another alleged beneficiary: Aftab Ahmed, the Congress MLA from Nuh constituency, three hours from Gurgaon. 

Mr Ahmed sold 17 acres of his family land in Shakarpuri village in Mewat in 2009 to Mr Vadra for Rs. 2 lakh per acre, almost eight times below the circle rate of Rs. 16 lakhs per acre. 

A former Congressman from here told us, Mr Ahmed, who lost the seat twice, was given the ticket for a third time only because of the favour to Mr Vadra.

But Mr Ahmed denied these allegations. He says he received no special favours from the Congress.

KTS Tulsi says Mr Vadra has simply been lucky and "got a good deal in the beginning of their career."

But given the absence of a credible, independent probe into the questions surrounding Mr Vadra's land deals, the opposition refuses to accept that luck alone could have contributed to his meteoric rise

DNA investigations: Robert Vadra and his many Bikaner plots

Armed with inside information, Sonia's son-in-law went on a land-buying spree in Rajasthan district, purchasing 20 plots of land between June 2009 and August 2011.

In a flurry of deals between June 2009 and August 2011, Robert Vadra purchased at least 20 plots of land collectively measuring more than 770 hectares in Rajasthan’s Bikaner district, in a region that would see prices spiraling soon after.

A clutch of investors, including Vadra, apparently privy to information on upcoming industrial projects in the vicinity, reaped huge profits with land values appreciating by up to 40 times since 2009.

Data from the office of the registrar in Bikaner shows 20 properties Vadra purchased through companies, including Real Earth Estates Pvt Ltd, North India IT Park Pvt Ltd, and Skylight Realty Pvt Ltd. All the deals were executed on his behalf by Mahesh Nagar, brother of Haryana Pradesh Congress Committee member Lalit Nagar. These companies together invested Rs2.85 crore in barren land here during this period.

“Vadra clearly misused his position as the son-in-law of Sonia Gandhi,” said Devi Singh Bhati, six-time MLA of the Kolayat tehsil where most of the Bikaner deals took place. “The land was purchased either in the knowledge that industrial projects would be announced, or circumstances were created to bring projects to the area.”

Just days before a memorandum of understanding was inked between the Rajasthan government and a private firm for a Rs45,000-crore project to manufacture silicon chips for the telecom industry, Mahesh Nagar — acting on behalf of another company named Blue Bridge Trading Pvt Ltd — completed two deals in Gajner village of Kolayat, home to over 15 such deals.

Bhati said a grid substation came to Gajner soon after the land deals, followed by more industries, including solar power plants promoted by the government’s solar parks policy.

Clearly, that is why Vadra did not buy the land cheap — almost all the plots were purchased at several times the government-recommended rates.

Bikaner businessman and land investor Vineet Asopa, who sold among the largest plots to Vadra, was so surprised at the ease with which he demanded and received Rs65,000 a hectare when local prices were no more than Rs30,000 a hectare that he summoned contractors for an overnight survey of whether the land was rich in minerals.  They dug 80 feet deep, found only rocky surface, and Asopa went ahead with the deal. He found out only two months later that the purchaser was Vadra, whose signature was on the cheques. 

At least one individual who sold land to Mahesh Nagar said the deals were done rapidly, the buyer depicting an unusual “hunger” for the land. Local MP Arjun Meghwal, too, has called for an investigation.

Taking place amid rapid land purchases in the region – local people estimate that over 3,000 hectares changed hands between 2009 and 2011 in Bikaner alone – the deals led to further speculation and more investors queuing up.

“A variety of reasons pushed prices upward in the area – the Vavasi silicon chip project and the solar parks policy, to start with,” said Hariom Garg, a local journalist-activist who wrote about Vadra’s purchases in 2010.

As Vadra and a host of others invested heavily, prices spurted alongside demand, nudged by the fact that these highway-side plots will be the spine of the Bhatinda-Barmer route that will see traffic multiply once a proposed refinery in Barmer is ready.

Stroke of luck or business sense? Robert Vadra strikes gold through land deals in Bikaner

Call it a huge stroke of luck or a keen sense of business acumen, Robert Vadra struck gold through sale and purchase of land in the parched deserts of BikanerRajasthan .

In the process, Congress president Sonia Gandhi's son-in-law is said to have pocketed a cool Rs.100 crore.

What is significant about Vadra's land dealings in Bikaner is that he was among the first to buy property there when Bikaner's Gajner town of Kolayat tehsil was hardly seen as an investment destination because of its aridness and lack of infrastructure.

It all started in December 2008, when Ashok Gehlot ousted the BJP's Vasundhara Raje in the assembly elections and came to power in the desert state.

Soon after, Vadra went on a land buying spree through six of his companies, M/s Blue Breeze Trading Pvt Ltd, Sky Light Realty Pvt Ltd, Sky Light Hospitality Pvt Ltd, Real Earth Estates Pvt Ltd, North India IT Park Pvt Ltd and Lambodar Art Enterprises Pvt Ltd.

Between 2009 and 2011, Vadra had acquired 733.18 acres, spread across 32 plots, in Gajner, 30 km from Bikaner, the district headquarters.

Then earlier this year, between February and May, Vadra sold almost all of it, making a huge profit.

When contacted, renowned Supreme Court advocate KTS Tulsi, who counts Vadra as a client, said he did not have the necessary information to comment on the issue.

"It's any citizen's right to acquire property and dispose it off," Tulsi said, adding that he was not speaking on Vadra's behalf as far as the Rajasthan property was concerned. "This matter doesn't deserve any attention without more (information)," he added.

What is of significance in the land dealings is that Vadra went on a land buying spree in Gajner, the same place where the Gehlot government proposed to develop an industrial area.

It is unclear if Vadra had prior information about the government's plans for industrial development in Gajner or had a strong intuition about them.

But as Vadra's land was adjacent to the proposed industrial area of the Rajasthan Industrial Development and Investment Corporation Ltd (RIICO), the worth of Vadra's land shot up.

The land cost escalated further after the Rajasthan government installed a 320 KV grid substation recently for the industrial area.

So when Vadra sold his property earlier this year, he made a huge killing. According to BJP MLA of Kolayat Devi Singh Bhati, Vadra must have made at least Rs.100 crore as the prevailing market rate at that time was Rs.13 lakh to Rs.13.5 lakh per acre.

The land revenue records and jamabandi papers (records of rights), the copies of which are with Mail Today, show that of the 733.18 acres, Vadra has kept only 11.83 acres.

The jamabandi records of the revenue department reveal that Vadra sold his land to VCB Trading Pvt Ltd, Fonroche Saras Energy Pvt Ltd, Fonroche Rajhans Energy Pvt Ltd, Sanchiya Enterprises Pvt Ltd, Elegance Finlease Pvt Ltd and BS Trade Invest Pvt Ltd.

Fonroche Saras and Fonroche Rajhans have already finalised financial closure for their respective solar power projects in the proposed industrial area, sources said. Vadra has sold only one piece of land - 8.02 acres - to a private party, one Rishipal of Mewat in Haryana.

Congress under fire after Vadra charges

Unfazed by BJP's aggressive stance on Robert Vadra land deals controversy, Congress on Tuesday ruled out discussion on the issue in Parliament and dared Yashwant Sinha to move court after he sought a probe by Special Investigating Team into the matter.

Rejecting BJP's demand that government give a reply in Parliament on the issue, party spokesperson Sandip Dik**** said, "He (Vadra) is an individual. Not a member of House. We
do not discuss individuals in Parliament".

"There are large number of forums in the country. They are welcome to go anywhere they like.... If he (Sinha) feels, he can go to the court. Nobody is stopping him or anybody else from either approaching the court or the government of Haryana," Mr Dik**** said.

Mr Sinha today demanded that a Special Investigating Team be set up to inquire into the land deals of Mr Vadra, son-in-law of Congress president Sonia Gandhi.

Mr Dik**** also refused to comment on the BJP leader's acerbic remarks about Mr Vadra's "business model" and stuck to the party's stand that the issue is state specific and hence Mr Sinha is "welcome to give any feedback to Haryana government".



BJP leader Ravishankar Prasad held that the issue involves "manipulation" of a nationalised bank document, thereby becoming "clearly a national subject".

"It is an issue of Haryana government. Land belongs to the state government not Parliament and Central government... what is not in our purview, we can't discuss. These are personal allegations. In any case, we do not discuss individuals in Parliament. An individual, who is not a member of House," Mr Dik**** contended.

To a question on whether Congress was with Mr Vadra, he said, "We are always with the truth."

Probe Robert Vadra's land deals in Haryana, Delhi and Rajasthan: BJP

 BJP on Tuesday sought to corner the government over alleged irregularities in land deals involving Sonia Gandhi's son-in-law Robert Vadra, disrupting Parliament and demanding probe by a special investigative team.

BJP members created storm in both Lok Sabha and Rajya Sabha by demanding a debate on the issue, which was rejected by the government. The uproar led to repeated disruptions of both the Houses.

However, BJP did not get support from other parties, with Samajwadi Party and BSP, outside supporters of UPA, saying Sonia Gandhi could not be blamed for any alleged irregularities by Vadra.

Left parties said all cases of corruption, whether any individual or any corporate is involved, must be probed and the guilty punished. These issues must also be discussed in the House.

Raising the issue in the Lok Sabha, Yashwant Sinha (BJP) said, "Though there are several business schools which teach models of making money, there is one highly connected person who did not go to any such school but has given a model where no investment is made but windfall gains of thousands of crores are made."

Seeing the apparent reference to Vadra, Congress members were on their feet in protest. Sanjay Nirupam walked into the Well and protested against BJP's charge.

Parliamentary affairs minister Kamal Nath and his deputy Rajiv Shukla, both seated in the front row, were on their feet. BJP members countered them from their seats.

BJP members chanted, "Congress ka haath, damaad ke saath (hand of Congress is with the son-in-law)."

This was met with counter slogans "Congress ka haath, janata ke saath, garib ke saath (hand of Congress is with the people and the poor)" by ruling party members.

In the Rajya Sabha, Rajiv Pratap Rudy (BJP) asked the chair for his view on a Zero Hour notice to raise the Vadra issue.

"There is scam that has taken place. It has rocked the nation. It involves somebody very important," Rudy said, with his party MPs rising in support.

Soon Congress members were on their feet raising counter slogans.

Sinha later told reporters outside Parliament, "We are demanding a Special Investigating Team, to probe into the land deals of Vadra, which should be monitored by the Supreme Court, so that truth would come out and guilty would be punished."

He said it should be multi-disciplinary team, because Vadra has allegedly violated many central laws including banking law, Income Tax law and company law.

"All his deals in the Congress-ruled states of Haryana, Delhi and Rajasthan should be probed," Sinha said.

Taking a dig at finance minister P Chidambaram, the BJP leader said, "Since Vadra has presented a unique business model before the country, my recommendations will be to the Congress party, which disturbed me and did not allow me to complete my speech in the Lok Sabha, is to open a Vadra school of management."

Since then, Vadra appeared to have his fingers in even more business pies. Vadra is also the sole owner of Sky Light Hospitality Pvt Ltd, having his mother Maureen as a partner. Furthermore he owns 20 per cent of Unitech, which was in the centre of the high profile 2G spectrum scam. As Robert was involved in the scam, there are concerns from the Indian citizens that the investigation will never come to a definite conclusion.

As Vadra gained his billions, he had to deal with three family tragedies: His sister, Michelle, died in a car accident in 2001; his older brother, Richard, was found dead in at his home in 2003 and his father Rajinder hanged himself in 2009. UP polls 2012: Robert Vadra bids for a place in Gandhi family power structure

The oldest political dynasty in India has a new dynast. On February 6, Robert Vadra, 42, chose Rae Bareli, the headquarters of Gandhi Inc, political home of Indira Gandhi and Sonia Gandhi, to announce his ambitions. Astride a motorcycle, he declared: "If people want, I can join politics.'' The people did not reply; and the Congress party was a bit hesitant about its reaction. Most Congressmen were stunned. Loyalty lines were blurring. Rahul Gandhi, 41, was their chosen leader, and sister Priyanka, 40, a support rather than threat. What would her husband Robert constitute? In public perception, Rae Bareli had been allotted to Priyanka. She was seen as the natural successor to the family seat. Vadra has disrupted all calculations; the unspoken worry is that Vadra has developed prime ministerial ambitions and is now ready to voice them.

 

Priyanka, who was campaigning in Amethi, 60 km away, blamed the media for asking her husband agolmatol (roundabout) question. She understood the implications, because a dynasty cannot have two heirs without Mughal-style war eventually breaking out. "He (Vadra) is a successful businessman and has no time for politics,'' she said. But her successful businessman refused to back down. In yet another interview, this time to a news channel, he reiterated his statement: "I think there is a time and place for everything. The day I feel that I can make a difference for the people, and the people would like me representing them... That calling will come at some stage, I feel.''

This was as plain as ambition can get. Suddenly Vadra, who has spent 15 years in the shadows, did not look apologetic about space in the limelight. His two children Raihan, 11, and Miraya, 9, came with him on this first solo foray into Rae Bareli. since 1999, when he started accompanying the family on election campaigns. The man who once drove his brother-in-law Rahul's car seems to be seeking the driver's seat.

Congress leaders are apprehensive about Vadra's move from Page 3 to Page 1. Adjectives like loose cannon are being used to describe Vadra, supplementing the familiar analogy between him and Pakistan President Asif Ali Zardari, husband of the late Benazir Bhutto. Local Congress leaders in Rae Bareli have noticed the change in Vadra. Kalyan Singh Gandhi, 45, a Congress leader who has worked with the family for the past two decades, says Vadra wanted to create an impact in this election and asked for an individual event befitting his style. "So I organised the bike rally for him in Salon reserved constituency in Rae Bareli. Vadraji addressed two rallies before getting on the bike,'' Kalyan told India Today. The rally was officially in support of the local candidate Shiv Balak Pasi, who rode pillion on Vadra's bike. But it was in truth a coming-out party.

Vadra also rode into controversy for violating the model code of conduct when the District Election Officer Pawan Sain stopped him. The 2005 batch ias officer was promptly issued a transfer order even though the Election Commission (EC) claimed the order had been issued days earlier. However, the EC later said that Sain would stay on till the polls were over.

Vadra has benefited from his association with the Gandhi family. Some privileges are minor but irritants in the public eye. For instance, the exemption from pre-embarkation security check at all the airports of the country. There are 31 categories of exemption, Vadra is the only one named, a category of his own. The remaining 30 are defined by rank and post.

Since his marriage, Vadra's business has grown exponentially. His father Rajinder Vadra ran a brassware export business in Moradabad. Young Vadra started Artex, a handicrafts and fashion accessories business in 1997, the year he got married. In earlier interviews, he has spoken of how he went door to door selling samples. "It's not easy to set up a business from scratch. I went to Chawri Bazar and into the galis of Old Delhi to find my suppliers. I travelled the world with a bag of samples, went door to door to find buyers.I got pushed away many times but I persisted. And we have done very well. We have come a long way,'' he told a paper in 2010.

His brass-to-gold story is now in the public domain. In March 2011, a pink paper reported details about his "quiet and unheralded entry'' into the real estate business, including a partnership and wide-ranging transactions with the country's biggest realty firm, DLF. According to the paper, Vadra scaled up and diversified his business in 2007, acquiring tracts of land in Haryana and Rajasthan, a 50 per cent stake in a leading business hotel in Delhi, and attempting an entry into the business of charter aircraft. Several of his companies have received loans, some of them unsecured, from DLF Group companies.

 

Vadra responded to the report, saying that his association with DLF stemmed from a long-standing friendship with the family that controls the realty giant. "I have known the DLF people for a long time and they are friends of mine. I had wanted to invest in real estate and one thing led to another,'' he said. He took pains to clarify that he was doing things on his own. DLF claimed that the "business relationship of DLF Group with Vadra has been in his capacity as an individual entrepreneur and on a completely transparent and arms-length basis" So far, Vadra's growing empire has escaped public scrutiny because he has remained a private individual. If he becomes a claimant for legislature and office, he will have to abandon that privilege.

 

Vadra returned to Delhi with Priyanka on the evening of February 6 after his news-making trip to Rae Bareli. Priyanka hit the campaign trail again on February 9. There is no word on Vadra's plans. Sources say the embarrassed Congress is looking for a way to rein in the son-in-law. "He has stolen the limelight from Rahul. Whatever gains Congress has made because of Rahul's efforts will come to naught if damage control is not done,'' rues a Congress leader.

 

Rahul has infused some life into a dead Uttar Pradesh Congress but Vadra has put the party on the backfoot. At the Centre too, the Congress leadership is not sure how to deal with Vadra; marriage creates obvious sensitivities. Questions remain in the mind: does Vadra have Sonia Gandhi's permission? Is he putting pressure on his wife? The official party line was offered by General Secretary Janardan Dwivedi and spokesperson Abhishek Manu Singhvi. "People have interpreted Vadra's statement in a different context, I have nothing to add after Priyanka Gandhi's clarification on her husband's political ambitions,'' said Singhvi. He did not comment on Vadra's statements made in the wake of Priyanka's clarification.

 

Vadra's statements over the years, indicate that politics has always been a temptation, although his claimed focus is on his business, which he runs from his old 268, Sukhdev Vihar home in South Delhi. Maybe the time has come, in his calculation, for the crossover step. His business is flourishing and his persona familiar to media. He loves a party, whether it is at LAP night club or F-Bar at Ashok Hotel. He is not averse to being photographed in body-hugging black leather, which even earned him the Best Dressed Man Award from a city supplement in December 2011. A fitness fanatic, he is obsessed with his body, which he loves to display-be it in a fitness glossy or on his Facebook profile. He loves the toys that money can buy, and has an array of luxury cars, including a black 500 SEL Mercedes, a top-end BMW and a recently acquired Range Rover. Being protected by the Special Protection Group by virtue of marriage to Priyanka, he travels in style: his car is preceded by a pilot Gypsy with five Delhi Police commandos and followed by another Gypsy. In 2011, he purchased five top-end bikes-Hayabusa, Harley-Davidson and Ducati-though his friendly bike rides with brother-in-law Rahul have now ceased.

 

Vadra has never been far from the headlines. Highs or lows, his life has been full of quirks and controversies. His uncle ran a school sponsored by the Rashtriya Swayamsevak Sangh at the family farmhouse in Moradabad. He disassociated himself from his father Rajinder and brother Richard through a public legal notice in January 2002. He alleged that they were promising jobs and favours using his name and association with the Gandhi family. His late father sued Vadra for defamation.

In April 2009, his father was found dead in a rundown Yusuf Sarai motel during the run-up to the Lok Sabha elections. The police said it appeared to be a suicide. Nothing was proven. His brother Richard committed suicide in September 2003 in Moradabad at the family's home. Vadra's sister Michelle died in a car accident on the Delhi-Jaipur highway in April 2001.

Vadra is close to his mother Maureen, an Anglo-Indian of Scottish origin, who is a director in his five companies established after 2007. Priyanka was a founder-director in one of his companies, Blue Breeze Trading Pvt Ltd, set up in 2007 for chartering aircraft. However, she disassociated herself from the company and ceased to be a director in July 2008. Of late, Vadra has been spending a lot of time travelling, mostly to Dubai and England, leading some to claim that he might have acquired nri status. When in India, he is said to divide his time equally between his luxury apartment at DLF Aralias in Gurgaon, and the couple's home in Delhi's Lutyens' Zone, Lodi Estate.

Priyanka, who has earned herself the sobriquet of barsaati mendak (monsoon frog) seen only during elections, is focusing on bringing up their two children. She is trying to ensure a normal childhood for them, even saying in an interview that she loves baking cupcakes for them. She is a good, sensible mother. Studying in The Shri Ram School in Delhi, the children are believed to be well-behaved, disciplined and fuss-free. Priyanka makes it a point to attend all parent-teacher meetings and is active in the school's Parent-Teacher Association.

Seeking peace of mind, Priyanka has been practising Vipassana (meditation) for over a decade. She has also completed a master's degree in Buddhism. She also met Nalini, her father Rajiv Gandhi's assassin, in Vellore jail in 2008 "to make peace with the violence'' in her life. "I refuse to let anger and violence overpower me,'' she explained in an interview later.

Vadra has, till now, been careful about separating the personal and the political but he has managed to inadvertently pit himself against Priyanka, the darling of the Congress, this time. The party would prefer Priyanka to become the candidate from Rae Bareli if Sonia Gandhi retires because of health reasons. In 2011, he told the paper that published his business links that he does "not try to benefit from my family". "I never take obligations from people because if I do, they will ask me for something bigger in return... People can imagine all kinds of things about me but people who matter to me know me and know how I am." Now, it seems he wants the world at large to know too.

Is Robert Vadra really a private citizen?

Congress’ defence may not be tenable, say legal and financial experts, citing international law, RBI circular

New Delhi/Mumbai: Is Robert Vadra, son-in-law of Congress party president Sonia Gandhi, a “private citizen”?
This has emerged as the core of the Congress party’s defence of Vadra, whose transactions with real estate company DLF Ltd have come under public and media scrutiny.
The argument may not be a tenable one, say legal and financial experts, citing international law and even a circular issued by the central bank. None of the people wanted to be identified given Vadra’s position.
The experts point to India being a full signatory to the Financial Action Task Force (FATF) on money laundering, which clearly defines a “Politically Exposed Person” (PEP) and the set of people who qualify to be PEPs and cannot, therefore, be treated merely as private citizens. FATF, the agency’s website says, is an “inter-governmental body established in 1989 by the ministers of its member jurisdictions... to set standards and promote effective implementation of legal, regulatory and operational measures for combating money laundering, terrorist financing and other related threats to the integrity of the international financial system”.
FATF defines domestic PEPs as “individuals who are or have been entrusted domestically with prominent public functions, for example, heads of state or of government, senior politicians, senior government, judicial or military officials, senior executives of state-owned corporations, important political party officials”. It goes on to say that the “requirements for all types of PEPs should also apply to family members and close associates of such PEPs”.
“The government cannot ignore the FATF guidelines. Doing so would be reading the law too narrowly,” a New Delhi-based lawyer said.
India became a full signatory of FATF in 2010.
“Domestic politically exposed persons are now covered by the standards and financial institutions are required to take into account the associated risks of doing business with them,” says a June 2012 report to Group of Twenty leaders presented by FATF.
“Family members and close associates of politically exposed persons are also to be treated in a similar way to politically exposed persons,” the report adds.
“You cannot have different standards for different people when you have signed a set of regulations framed by an international body,” said a second person, who has previously served on the board of stock market regulator Securities and Exchange Board of India (Sebi).
To make things even more explicit, a report, prepared by the Wolfsberg Group, a grouping of global banks the objectives of which are similar to those of FATF, defines the concept of “close family” in relation to PEPs.
It says that while considering PEPs, “close family” should include “a PEP’s direct family members including spouses, children, parents and siblings of the PEP”.
To be sure, it does provide for exceptions.
“In any of these cases, there may be circumstances which mitigate against such a categorization including separation and estrangement, although these facts should be investigated and recorded,” the report adds.
The Wolfsberg report also defines the concept of a “close associate”, who it says will include “a PEP’s widely and publicly known close business colleagues and/or personal advisors, in particular financial advisors or persons acting in a financial fiduciary capacity”.
On 2 July, the Reserve Bank of India (RBI) sent an advisory to banks on PEPs that pretty much repeats what FATF and the Wolfsberg Group said, specifically adding that “the norms may also be applied to the accounts of the family members or close relatives of PEPs”.
L’affaire Vadra came to a head after Arvind Kejriwal and Prashant Bhushan of India Against Corruption (IAC) alleged on 6 October that the land deals struck by Vadra with DLF were in return for political favours. “Is there a nexus between DLF and the government of Haryana?” asks a press release on the IAC website. To be sure, there’s so far been no evidence of any quid pro quo.
On 7 October, law minister Salman Khurshid rejected demands for a probe into the issue. And several Congress leaders, including its spokesperson Manish Tiwari, went on record and said Vadra was a “private citizen”.
“You cannot investigate lies. Mr Vadra has done his duty as a private citizen and according to law,” Tiwari told CNN-IBN news channel on 11 October.
Only, that may not be the case.
A third expert said that if an RBI or Sebi circular includes FATF guidelines, in whole or in part, it implies that the guidelines are legally applicable in India to that extent.
Which would mean that Vadra may not just be another private citizen.

The Haryana Chief Minister says there is nothing illegal about the land transactions involving the Congress president’s son-in-law

Like most senior Congress leaders, Haryana Chief Minister Bhupinder Singh Hooda too has avoided commenting on the sharp questions raised by IAS officer Ashok Khemka about the Robert Vadra-DLF land deal and the issuance of land development licences in his State. Speaking for the first time on the controversy that broke out after The Hindu reported excerpts from Mr. Khemka’s 100-page submission to the government, a combative Mr. Hooda, with several bureaucrats by his side, answers some of the charges.

Following the uproar over Ashok Khemka’s 100-page submission to your government on the Robert Vadra-DLF deal and other concerns relating to the issuance of colony licences, questions have been raised about the manner in which such licences are issued in Haryana. They are seen as favours to political cronies.

It is the policy of our government to give licences to farmers to develop their land and not just restrict it to a handful of big builders. This was done because it was felt that the small farmer is being denied the benefit of rapid urban development taking place in the State. So, if a farmer collaborates with a developer (as Robert Vadra did with DLF), he can sell his licence along with the land and reap the benefit.

Are you saying that Mr. Vadra is a poor small farmer in Haryana?

He is a landowner. If he owns land designated as an agricultural zone, then he is a farmer. This uproar (over 3.53 acres) is only because he is the son-in-law of the Congress president. Thirty-five to 40 per cent of our licences are given to such small farmers who enter into collaboration agreements with developers. It is not illegal.

Not only opposition parties, but a senior Congress MP, Rao Inderjeet Singh from Haryana, has also demanded an investigation into licensing of 21,000 acres of land for various uses by your government in the past eight years, including the 3.53 acres that was part of the Vadra-DLF deal.

Rao Inderjit Singh has himself collaborated with Unitech and got a colony licence for 83 acres of his land in Gurgaon. Part of it is his ancestral land and part has been bought later. If someone with 83 acres can get the benefit of a licence then why should a small farmer with two or three acres not get it? He has as much right to get a licence. My question is, why should a poor man be denied a licence? When Inderjit gets a licence for his own land, then the policy is correct. When Robert Vadra gets it, then he says it is wrong. Why?

There is a demand for an independent investigation into the whole gamut of issues raised by Mr. Khemka. Why is your government shying away from an investigation?

An investigation for what? We have no complaint from anyone that Mr. Vadra has done anything wrong in Haryana. We have enquired into the two aspects of the deal that concern our government. These are, whether Mr. Vadra has paid the full stamp duty on the sale and whether the licence fee has been paid by his company. On both these counts he is clear. The rest is a matter between two private parties and the government has nothing to do with it.

Mr. Khemka’s specific charge is that Mr. Vadra falsified documents and entered into sham transactions to earn money from his land licence.

Who has charged? Which are the false documents? There are no false documents filed by Mr. Vadra. Corporation Bank has never said that it is not their cheque. It could be called ‘false’ if it was forged or counterfeit. That cheque [mentioned in the sale deed between M/s Onkareshwar properties and M/s Skylight Hospitality] was never presented or dishonoured.

As for what money DLF paid to Mr. Vadra for the licensed land, DLF should have come and defended itself. I am not sure why they are not doing it.

Mr. Khemka has also alleged that the government committee did not enquire into many other issues referred to it, such as misappropriation of panchayat land by misusing the Consolidation Act.

That is not true. Everything has been enquired into by the Committee. I have not read its report, but I think it is alright. No colony or commercial licence or change of land use by my government has been cancelled by any court. That itself is indication that there is no wrongdoing.

There is nothing new in Mr Khemka’s allegation. Everything has been clarified by our Committee. He is making an issue out of a non-issue.

If Mr. Khemka, as you say, has made false allegations against your government, will you take action against him for doing so?

The Chief Secretary is looking into that and has probably asked him for comments. It is for him to take action. I am never in a hurry to take action against anyone. Everything has a time. I am not a biased person, but will not spare whoever is at fault.

The media has raised questions on allegations made by Mr. Khemka about the Vadra-DLF deal, and yet you say that nothing is wrong or worth ordering an independent investigation?

The media is sensationalising the issue for TRPs. Mr. Vadra is a decent man. He could have filed defamation cases against anyone. He is only being maligned for being the son-in-law of Sonia Gandhi.

One month after he filed a criminal complaint against Congress president Sonia Gandhi, vice-president Rahul Gandhi, treasurer Motilal Vora, general secretary Oscar Fernandes, family friends Suman Dubey and Sam Pitroda, and the private firm Young Indian, for ‘misappropriation’ of the assets of National Herald and associated journals, before the chief judicial magistrate at Patiala House Courts, New Delhi, Janata Party leader Subramanian Swamy tasted victory.

Metropolitan Magistrate Gomti Minocha took cognizance of the complaint on Friday and directed Swamy to testify in the case on July 9, 2013. The complaint was first heard by link magistrate Ambika Singh on February 14.

Swamy, a well known activist against corruption in high places, has alleged criminal breach of trust by the accused persons against the All India Congress Committee (hereafter Congress) and The Associated Journals Ltd (hereafter AJL) who are the publishers of National Herald newspaper, founded under the chairmanship of Jawaharlal Nehru to support the freedom struggle. Funds were collected from the public at large and since 1977 the party received tax exemption under Section 13A of the Income Tax Act as it was funding the paper.

Yet the assets of AJL shareholders were allegedly ‘misappropriated’ by the accused, under the cloak of Section 25 of the Companies Act, 1956, through crony control over the Congress and AJL, disregarding the conflict of interest and breach of trust involved.

The takeover was executed in eight steps. First, AJL was formally closed and printing of National Herald, Navjivan and Qaumi Awaz terminated in 2008, leaving an unpaid debt of Rs 90 crore approximately. Second, on November 23, 2010, Young Indian Pvt Ltd (hereafter Young Indian) was incorporated with a paid up capital of just Rs 5 lakh under Section 25 of the Companies Act, in which Sonia Gandhi and Rahul Gandhi owned 38 per cent shares each (or jointly 76 per cent).

Third, in December 2010, the Board of Directors of Young Indian passed a resolution to “own” the outstanding debt of the AJL, and obtained an unsecured zero interest loan from the Congress for equivalent amount to liquidate the said debt. Sonia Gandhi was then Congress president, Rahul Gandhi general secretary, and Motilal Vora party treasurer and CMD of AJL.

Fourth, the AJL held a board meeting and declared that it could not discharge the debt to Congress. It resolved without reference to and approval of the shareholders that Young Indian would own its debt, and for Rs. 50 lakhs its entire share equity would be transferred to Young Indian. Thus AJL became a wholly owned company of Young Indian.

Fifth, the accused wrote off the loan obtained from the party as irrecoverable.

Sixth, the AJL Balance Sheet shows that it had real estate assets of at least Rs 2000 crore (possibly Rs 5,000 crore), in Delhi, Lucknow, Bhopal, Indore, Mumbai, Panchkula, Patna and other yet identified places. These were provided by various Union and State Governments after 1947 for facilitating newspaper printing, and publishing.

Seventh, after taken possession of this vast real estate, Young Indian declared that according to its objectives submitted for obtaining registration under section 25 of the Companies Act, 1956 it will not engage in publishing newspapers, including the National Herald.

Eighth, National Herald House in New Delhi has been rented and Young Indian receives at least Rs. 60 lakhs/month for space made available.

In his petition Swamy contends that National Herald was not owned by the Nehru family, but the general public, particularly those who joined the freedom movement, contributed most of the share capital. Hence,Young Indian had no right to appropriate 99 per cent of AJL shares with funds from the Congress.

When National Herald closed down in 2008, the Congress gave AJL an interest-free loan to pay off the employees’ terminal compensation. That Congress was funding the paper was admitted in the editorial by editor TV Venkitachalam on April 1, 2008 when the paper appeared last: “The paper is part of Nehru’s legacy and has continued to uphold the traditions of secularism and non-alignment and I hope the Congress will not allow it to close down finally.”

With closure, AJL continued to hold valuable properties and owed only Rs 90 crore to the Congress; it had very little other liability. This real estate could pay off the loan and give huge benefits to the thousand plus shareholders who contributed roughly Rs 89 lakh to AJL’s capital at various times.

The constitution of the Congress provides in Art XIX (i) that the “Working Committee shall constitute a Trust for holding immoveable properties belonging to the All India Congress Committee” under the chairmanship of the party president, and with the treasurer and general secretary in-charge of administration as ex-officio members. Yet AJL shares were taken over by Young Indian, a company whose main beneficiaries are the party president and vice president. The party treasurer is not an appointed post as per the constitution, but an appointee of the president. He played a critical role in the entire episode and owns 12 per cent share in Young Indian. Oscar Fernandes was made a director of AJL on June 17, 2010. He also owns 12 per cent share in Young Indian.

Suman Dubey and Sam Pitroda are close associates of the party president and promoters of Young Indian. Both were made directors of AJL on November 21, 2010.

AJL director since June 19, 2000, Vishwa Bandhu Gupta, resigned suddenly or was asked to resign on February 4, 2011, just before AJL converted the Rs 90.25 crore loan due to the Congress into equity shares by which control of AJL passed into the hands of Young Indian. The latter’s first Annual report (April 27, 2012), states that it “is engaged in activities to inculcate in the mind of India’s youth commitment to the ideals of democratic and secular society”. At the same time, the Annual Report of AJL says it is recasting “its activities” to align with Young Indian’s “main objects”, which suggests the intention to merge AJL into Young Indian.

All in all, an unedifying story.

  1. Mrs. Sonia Gandhi and Rahul Gandhi had floated a Section 25 private company called Young Indian, and acquired the public limited company, the Associated Journals Ltd., which is the owner of National Herald and Quami Awaz Newspapers, and all high value real estate property in Delhi and other places in Uttar Pradesh of the said company. The deal is a sham, bogus, and a violation of several laws. It is a fraud committed in order to grab the Herald Housein Delhi, that is located in a hub and which is valued at about Rs.1600 crores. 

     

  2. The first dubious fact of the AJ Company RoC details is that Jawahar Lal Nehru, Indira,Feroze GandhiGD Birlaand other like noted deceased person, are shown as current shareholders! In fact 80 per cent of the original shareholders are no more alive So too many of the defunct firms, including several companies having dubious addresses in Kolkata, are shown as shareholders of the Associated Journals Ltd. 

     

  3. The second dubious fact is the acquisition of the associated Journals Ltld. Judging by documents filed with RoC it is wholly illegal. On February 26, 2011, the Board of AJ Pvt. Ltd. passed a Resolution approving that All India Congress Committee9AICC) had loans to the Company unsecured and for zero interest rate to extinguish the liability of the company of more than Rs.90 crores. It is illegal for a political party to give loans to any company. The Resolution also resolved that in lieu of this deal with AICC, the Board decided to allot all AJ’s nine crore shares, of Rs.10 each to Young Indian, the private company of Sonia Gandhi and Rahul Gandhi, where both together more than three fourths of the total shares and fully control the said Young Indian Company. 

     

  4. The third dubious fact is that Young Indian filed statements with the RoC disclosing that the shareholders meeting was held in Sonia Gandhi’s Government allotted 10, Janpath. This is violation of the law since the 10, Janpath, New Delhi Government accommodation cannot be used for commercial purposes and business. 

     

  5. The fourth dubious fact is that the Rs.90 crore liability of The associated Journals was owned by Young Indian for a mere Rs.50 lakhs! 

     

  6. Thus the deal was to grab the Rs.1600 crore worth Herald House and other properties of the National Herald/Quami Awaz in Delhi and in different part of UP for a commitment to pay Rs.50 lakh to AICC for the Rs.90 crores advanced as unsecured zero interest loan. 

     

  7. Therefore, I urge immediate institution of a SFIO/CBI probe into this dubious stinking deal between Young Indian and The Associated Journals as also the illegality of the AICC in giving a loan to a private company in reckless cronyism since the AICC President is Ms. Sonia Gandhi and General Secretary Rahul Gandhi who are also owners of Young Indian, the beneficiary. More curiously, the associated Journals Ltd.’s Chairman Shri Motilal Vore is also the Treasurer of the AICC! 

     

  8. In his election affidavit on assets and liabilities, Mr. Rahul Gandhi had failed to inform that he owned 38 per cent share of a company he had formed named Young Indian with his mother, Ms.Sonia Gandhi, who also owned 38 per cent of the shares.

Janata Party chief Subramanian Swamy today targeted Sonia Gandhi and Rahul Gandhi raising questions over acquisition of a company that published the now-defunct National Herald newspaper to which Congress gave a loan of over Rs 90 crore – Swamy made a fleeting mention of Rs 1,600 cr figure too in his diatribe.

Addressing a press conference here, he said Sonia and Rahul had floated a Section 25 company called ‘Young Indian’ each with a share holding of 38 per cent, which acquired Associated Journals, founded by late Jawaharlal Nehru, that published the National Herald and Quami Awaz.

Swamy said Associated Journals obtained an unsecured loan of over Rs 90 crore from AICC which he claimed was illegal under Income Tax Act because a political party cannot give loans for commercial purposes.

Congress dares Swamy to prove charges against Rahul, Sonia

New Delhi: Taking on Janata Party president Subramanian Swamy, the Congress party on Friday said that the onus was on him to prove the allegations of wrongdoings against Sonia Gandhi and Rahul Gandhi, and stressed that the party is ready for a legal battle. 

It may be noted that Swamy had targeted Rahul and Sonia Gandhi over acquisition of a company that published the now-defunct National Herald newspaper to which Congress gave a loan of over Rs 90 crore and challenged the Gandhis to sue him for defamation. 

Swamy had alleged that the loan to Associated Journals was in violation of tax and election laws. 

The Congress, in its response, said that Swamy should go to court if he felt that there was merit in the case. 

Rejecting the allegations, the Congress maintained that its support to National Herald newspaper was interest free loans yielding no commercial profit to the party. 

In a late night press release, Congress general secretary Janardan Dwivedi said that the Congress has done its duty in supporting The Associated Journals Limited to help initiate a process to bring the newspaper back to health in compliance with the law of the land. 

"This support was extended by the Indian National Congress in the form of interest-free loans from which no commercial profit has accrued to INC," the release said. 

Earlier, addressing a press conference, senior Congress leader PC Chacko said, “We are now ready, the person (Swamy) who made this allegations should prove it. We have sent a letter from Rahulji’s office and that amounts to legal notice.” 

“Swamy should have the guts to go to court. This is very strange, he wants us to file case against him… it is insensible. If there is a violation of rules, we challenge him to prove it. There is no commercial transaction here, people are trying to create confusion,” he stressed. 

Taking the challenge further, Chacko said, “We want to see whether he will sue us. We have reminded him that what he has said is defamatory. We will not succumb to such blackmailing tactics. When we deny that then we say that there is no violation.” 

Chacko said "now the bluff master (Swamy) will face the music" but refrained from giving a categorical reply whether Congress would sue the Janata Party chief as suggested by Rahul yesterday. 

Yesterday, Rahul Gandhi’s office had sent a letter to Swamy. "Our attention has been drawn to your purported press conference of the afternoon of November 1. The allegations made by you are utterly false, entirely baseless and defamatory," the letter said. 

It said, "Your action of calling a press conference is a motivated attempt for reasons, which one can easily discern." 

"We are committed to pursuing all legal actions against the scandalous abuse evident in your so-called press conference. Please be informed that we shall pursue the legal remedies open to us against the utterly motivated and irresponsible contents of your press conference.” 

‘Sue me, Rahul’ 

Hitting back, Swamy said, "Rahul should sue me instead of writing dirty letters. I am going to court as I have done in 2G and other cases. 

"The court will ask me whether I have exhausted all options. That is why I have written to the Prime Minister and the Election Commission for action. I will give them sometime, wait for their responses. After that I will go to court". 

The BJP too waded into the controversy seeking a specific answer whether money was transferred from AICC. 

The opposition party asked Congress to clarify whether it gave a loan of Rs 90 crore to Associated Journals, which ran the now-defunct National Herald daily, saying, if true it was violation of tax and electoral laws. 

In Shimla, Leader of the Opposition in Rajya Sabha BJP Arun Jaitley said he merely wanted a specific answer from Congress and not adjectives like 'baseless and untrue' as was used in a communication issued by Rahul Gandhi's office. 

Raising questions on the basis of details provided by Swamy yesterday, Jaitley said if it was true that such a transfer of funds had taken place, then it could lead to various consequences for Congress, including withdrawal of tax exemption and registration by the Election Commission. 

He said if Congress were to say that what Swamy has alleged was wrong, then the matter ends. If not, then the whole issue is one of "gross impropriety and gross illegality". 

The former Law Minister maintained a political party can use its funds only for political purposes and not any business or financial activity. 

External Affairs Minister Salman Khurshid, who was earlier in-charge of Corporate Affairs, expressed surprise over the allegations. 

"I am absolutely clear in mind that there is absolutely no reason for anybody to put a question mark on this. If anything, this should be treated as an example of good governance, transparency and accountability rather than treated as example of the opposite," he said. 

Khurshid reasoned that in this case, a non-profit company has been created. "It is a Section 25 company and hence a non-profit company. A non-profit company means that no dividends are paid. So, I am little bit surprised that any issue should have been made of this." 

He said that having been a Corporate Affairs Minister, he knows there are amendments made to structures of institutions, "where sometimes for greater clarity and accountability, you try to move from a system of Trust to Society, from Society to a company". 

Information and Broadcasting Minister Manish Tewari lamented the "culture of shoot and scoot" saying it has far- reaching implications. He said the allegations were "completely absurd and hold no truth".

New Delhi: The Punjab and Haryana High Court pulled up the Hooda government on Monday for flouting land laws in order to aid the Rajiv Gandhi Charitable Trust in Gurgaon's Ulawas village. It is being reported that the site for the Indira Gandhi Eye Hospital and Research Centre in Gurgaon's Ulawas village, to be set up by the Trust, was granted eight acres of land in violation of the land acquisition laws. The land owners, including artiste Anjolie Ela Menon, had approached the court against the land deal saying that the 'Gandhi's as trustees' tag helped with the Trust acquire the land. Chetan Mittal, who is the counsel for petitioners, said, "there is no provision of releasing any vacant land. Here the government has not gone against the policy but they have tried to straight away favour the Trust." The Haryana Government, according to petitions in the court, alleged that the rules were bent to help the Rajiv Gandhi Charitable Trust and a few others. Fearing political fire and embarrassment to the Gandhi's, the Congress government in Haryana offered to clean up the mess caused but the High Court wanted to get all the facts in place and observe them. "When you are caught red handed, you are trying to escape... We cannot tolerate what you are doing with the common man," The high court told the state government. "This has to be stopped. We are shocked at the sad state of affairs. Be rational and be fair to everybody," the high court added. When contacted by CNN-IBN, the Haryana government refused to give any official reaction. "No comments. the matter is in the court... Tomorrow... Tomorrow... No comments," is what HS Hooda, attorney for the state government, said. Villagers in Ullawas say that they were also told there was pressure from influential people. One of the villagers, Dharamveer, said, "there was no meeting between the panchayat, the gram sabha and the sarpanch... The District Commissioner told them there was pressure from the government and that they had to sign the deal." Another villager Satinder said that they were pressurised to sign the deal and that they would be sent to jail if they refused. "They put pressure on us.. They told us that we would go to jail... We were ready, after all, how else would we sustain ourselves?" Satinder said. The Rajiv Gandhi Charitable Trust has reacted to the CNN-IBN reports saying that they followed all procedures in acquiring the land for the eye hospital. Rajiv Gandhi Charitable Trust CEO Dr YSP Thorat said, "The Trust corresponded directly with the Gram Panchayat and was leased by the Gram Panchayat for 33 years through due process, without any concessions and according to the provisions of the law. The Trust's lease with the Gram Panchayat stipulates that the land shall be used only for the purposes of an eye hospital; that there shall be no further sub-lease or transfer; that the eye hospital shall run on a no profit-no loss basis."

New Delhi: The acquisition of land in Haryana for the Rajiv Gandhi foundation has been adding to the Congress' woes. CNN-IBN has now accessed documents to show that the land use law was deliberately changed to help the foundation. On October 20, 2010 the Rajiv Gandhi Charitable Trust applied for Change of Land Use (CLU) to utilize village common land to set up an eye hospital. On December 1, 2010, the trust got the approval for CLU. What has remained hidden is that in between, the Haryana Government on November 8, 2010 brought in a new policy. By this policy the state government allowed Charitable Institutions who have taken land from Panchayats to be considered owners for the purpose of grant of CLU. The Haryana Government now says that the trust was given permission even though the land owners, the Panchayat, never applied for it. Haryana Financial Commissioner and Principal Secretary SS Dhillon said, "The trust applied for Change of Land Use after getting permission from the government and without the permission of the government to approve the lease for 33 years they could not have applied even for the Change of Land Use." But the state Additional Advocate General Narinder Hooda, when asked by CNN-IBN said clearly that land is always released in favour of the owners. The trust is not the owner of the land. Very clearly the Haryana Government could not have released the Rajiv Gandhi Trust from acquisition as there never was a request for release from the Panchayat, who are the true owners of the land. And therefore, new rules were introduced to consider the trust the owner, grant permission and release 5 acres from acquisition. Other petitioners said that this clearly shows favouritism by the Haryana Government.

New Delhi: The Rajya Sabha was adjourned on Wednesday over the acquisition of land for the Rajiv Gandhi trust in Gurgaon. The villagers of Ullawas village in Gurgaon have rejected the Hooda government's overtures. The villagers of Ullawas village are holding a Kisan panchayat on Wednesday to protest against the Haryana government's preferential treatment to the Gandhis. They have decided to go to court to get their land back, having refused to settle with the Hooda government. On Tuesday, following CNN-IBN's report, the Haryana government decided to reconsider the exemption provided from land acquisition to the Rajiv Gandhi Charitable Trust for 5 acres of land. In all, 65 landowners had gone to court claiming the Gandhi name was used to extract favourable treatment for the Trust while their land had been acquired. Reacting to the CNN-IBN expose on Haryana land deals favouring the Rajiv Gandhi Trust, the Congress has said that no rules were bent and that land was only given on lease. Congress spokesperson Abhishek Manu Singhvi said, "The land was leased to the Rajiv Gandhi Charitable Trust for eyecare. The trust does not own the land." Singhvi claimed, "Not a single rule has been bent, the Gram Panchayat owns the land." The congress on Wednesday slammed the BJP's comment, equating the land acquisition in Gurgaon to that by Yeddyurappa and the Mayawati government. "Why is leader of Opposition in Rajya Sabha equating Bhatta with the Haryana issue? Chief spokesperson of the party saying this is a land issue the same as Yeddyurappa. One lakh people have been treated in the hospital. Five acres of land have been legally given by the panchayat to the trust," said Information and Broadcasting minister Ambika Soni.

எங்கள் அரசு ஊழலுக்கு எதிராகக் கடுமையாக நடந்துகொண்டதுபோல் வேறு எந்த அரசும் நடந்துகொண்டது கிடையாது. ஊழலின்பேரில் எங்களைத் தாக்குகிறவர்கள் அவர்களுக்குள்ளே இருக்கும் ஊழலைக் காண முடியவில்லையா என்ன?” என்று மே மாதம் 20ம் தேதி வாரணாசியில் நடந்த ஒரு பேரணியில் சோனியா காந்தி பேசினார். (1)

அதற்குச் சரியாக ஒரு மாதம் முன்னர், ஏப்ரல் 19ம் தேதியன்று அண்ணா ஹசாரேவுக்கு எழுதிய கடிதத்தில், “லஞ்சத்தையும் ஊழலையும் எதிர்க்கவேண்டியது அவசரமானதும் அவசியமானதும் என்று நம்புகிறேன். பொது வாழ்க்கையில் நேர்மை மற்றும் நாணயத்திற்கான போராட்டத்தில் என்னுடைய பொறுப்புமிக்க ஈடுபாட்டைப் பற்றிய சந்தேகம் தங்களுக்கு இருக்கக்கூடாது” என்று குறிப்பிட்டிருந்தார் சோனியா. (2)

அதற்கு நான்கு மாதங்களுக்கு முன்னால் 2010 டிசம்பர் 10ம் தேதியன்று காங்கிரஸ் திட்டக்குழுவில், “ஊழலிடம் சகிப்புத்தன்மை கூடாது. சந்தேகமில்லாமல் அனைத்து மட்டங்களிலும் ஊழல்புரையோடியிருக்கிறது. அதற்காக தேசம் பெரிய விலையைக் கொடுத்துக் கொண்டிருக்கிது” என்று பேசினார். (3)

மேற்கண்ட வார்த்தைகளை மனமுணர்ந்து சோனியா பேசியிருப்பார் என்று நம்ப முடியவில்லை. காரணம், காங்கிரஸ் கட்சிக்கு ஊழல் என்பது வாழ்க்கை முறை என்பது மட்டுமல்ல; சோனியாவின் தலைமையில் இயங்கிக் கொண்டிருக்கும் ஐக்கிய முற்போக்கு கூட்டணி அரசு, ஊழல் என்னும் சமுத்திரத்தில் முழுகி முழுகி மக்கள் பணத்தைப் பல்லாயிரம் கோடிகளாகக் கொள்ளையடித்துக் கொண்டிருப்பதும்தான்.

ஆனால் அரசியல் அமைப்புச் சட்டத்திற்கு அப்பாற்பட்ட ஓர் ஆளுமையாக மத்திய அரசை ஆட்டிப் படைத்துக்கொண்டிருக்கும் இந்த அந்நியப் பெண்மணியின் பேச்சுக்களையும் நடவடிக்கைகளையும் கூர்ந்தாய்வது தற்போதைய அவசியம். அப்போதுதான் ஊழலுக்கு எதிரான நம் தேசத்தின் போராட்டம் முன்னேறியுள்ளதா என்பதும், இந்தப் பெண்மணி அரசியலில் இருப்பது இந்த தேசத்திற்கு நன்மை பயக்குமா என்பதும் சரிவர விளங்கும்.

நேர்மையற்ற முறையில் சம்பாதித்து, கருப்புப் பணத்தை வெளிநாடுகளின் வங்கிகளில் பதுக்கி வைப்பதைப் பற்றிய பேச்சு பல வருடங்களாக நம் சுதந்திர இந்தியாவில் பேசப்பட்டிருந்தாலும், சென்ற 2009 பாராளுமன்றத் தேர்தலில் முக்கியப் பிரச்சனையாகப் பேசப்பட்டது. பா.ஜ.கட்சியால் அமைக்கப்பட்ட, பல நிபுணர்கள் அடங்கிய ‘பணிக்குழு’ (Task Force) ஏப்ரல் 2009ல் வெளிநாடுகளில் பதுக்கி வைக்கப்பட்டிருக்கும் கருப்புப்பணத்தைப் பற்றி, தன்னுடைய இடைநிலை அறிக்கையை வெளியிட்டது. பா.ஜ.க இந்தப் பிரச்சினையை 2009 தேர்தலில் ஒரு முக்கியப் பிரச்சினையாக வைத்துப் பிரசாரம் செய்தது.

பா.ஜ.கவின் பிரசாரத்திற்குப் பதிலளிக்க வேண்டிய நிலைக்கு காங்கிரஸ் கட்சி தள்ளப்பட்டது. தாங்கள் மீண்டும் ஆட்சியமைத்தால் 100 நாட்களுக்குள் வெளிநாடுகளில் பதுக்கி வைக்கப்பட்டிருக்கும் கருப்புப் பணத்தைத் திருப்பிக் கொண்டு வருவதற்குத் தேவையான நடவடிக்கைகளை எடுப்போம் என்று பதில் பிரசாரம் செய்தது காங்கிரஸ் கட்சி. தேர்தலில் வெற்றி பெற்று ஆட்சியமைத்த பின்னர் பாராளுமன்றத்தில் ஜனாதிபதியின் உரையின் மூலமும் அதே வாக்குறுதியை அளித்தது காங்கிரஸ் அரசு.

மத்திய அரசு ஒவ்வொரு ஊழலிலும் சிக்கித் திணறிக் கொண்டிருக்கும்போது, பா.ஜ.க. அமைத்த பணிக்குழு அமைதியாக பல ஆதாரங்களைச் சேகரித்து வெளிநாடுகளில் இந்தியர்களால் பதுக்கி வைக்கப்பட்டிருக்கும் கருப்புப் பணம் பற்றிய விவரங்கள் அடங்கிய ஒரு ஆவணத் தொகுப்பைத் தயாரித்தது. தேசப்பற்று மிகுந்த, நேர்மையான எந்த ஓர் அரசும், நாட்டின் முக்கிய எதிர்க்கட்சி தயாரித்த தொகுப்பை வாங்கி, அதைப்பற்றி அனைத்துக் கட்சிகளுடனும் ஆலோசனை செய்து, கருப்புப் பணத்தை மீட்பதற்கான நடவடிக்கைகளில் இறங்கியிருக்கும்.

ஆனால் ஐக்கிய முற்போக்கு கூட்டணி அரசோ, ஆட்சியின் உயர் மட்டத்தில் இருக்கும் ‘புனிதர்களை’க் காப்பாற்றுவதற்காக உண்மைகளை மறைக்கத்தான் முயன்றது. ஆனால், எதிர்க்கட்சிகளின் தொடர் தாக்குதல்களுக்குப் பிறகே ‘நேர்மையான’ பிரதமர் தொலை தொடர்புத்துறை அமைச்சர் ஆண்டிமுத்து ராசாவை பதவியிலிருந்து நீக்கினார். அவ்வளவுதான். அதற்குப் பிறகு, தனக்குச் சமமான ‘நேர்மை’ உடைய தொலைக்காட்சி சானல் எடிட்டர்களுடனான, நன்றாக ஒத்திகை செய்யப்பட்ட ஒரு சந்திப்பு வரை, பிரதமர் வாய் திறக்கவில்லை. தன்னுடைய உயரதிகார மையத்திலிருந்து வரவேண்டிய ஆணைகளுக்காகக் காத்திருந்தாரோ என்னவோ!

இதனிடையே, எதிர்கட்சிகள் அரசின் மீதான தங்கள் தாக்குதலைத் தொடர்ந்து கொண்டிருந்தன. செய்தித்தாள்களிலும் பத்திரிகைகளிலும் தலையங்கங்களும் கட்டுரைகளும் வந்த வண்ணம் இருந்தன. டிவி சானல்கள் பலவும், பா.ஜ.கவின் பணிக்குழு உறுப்பினர்கள் உட்பட பல அறிவுஜீவிகளைக் கொண்டு விவாதங்கள் நடத்தின. அம்மாதிரியான ஒரு விவாதத்தில் 1970-களிலேயே இந்திரா காந்தி சுவிட்ஸர்லாந்தில் கருப்புப்பணம் பதுக்கி வைத்திருந்ததாக ஒரு அறிவுஜீவி கூறினார். இவ்வளவும் நடந்துகொண்டிருக்க சோனியாவும் ராகுலும் மௌனம் சாதித்தனர். பா.ஜ.க பணிக்குழு தயாரித்த “Indian Black Money Abroad in Secret Banks and Tax Havens” என்கிற ஆவணத் தொகுப்பு வெளியிடப்பட்ட பின்னர், சோனியா அத்வானிக்கு எழுதிய கடித்த்தில்,“என்னைப் பற்றியும், என் கணவர் என் தாயார் உட்பட்ட என் குடும்பத்தினர் பற்றியும்அடிப்படை ஆதாரமற்ற, பொறுப்பற்ற குற்றச்சாட்டுகள் உங்கள் கட்சியினர் தயாரித்த ஆவணத் தொகுப்பில் சொல்லப்பட்டுள்ளன. அவ்வப்போது ஒரு சில ஊடகங்களிலும் மற்றும் ‘அக்கறையுள்ள’ சில நபர்களாலும் பரப்பப்படும் இந்தப் பொய்களை அவற்றுக்கே உரிய அவமதிப்புடன் நான் புறக்கணித்தே வந்திருக்கிறேன் என்று கூறியுள்ளார். (4)

ஆனால் சோனியா கூறியது உண்மையல்ல. அவர் அக்குற்றச்சாட்டுக்களை அவ்வாறு அவமதிப்புடன் புறக்கணிக்கவில்லை என்பதை சமீபத்திய நிகழ்வுகள் நமக்குத் தெரிவிக்கின்றன.

பத்து ஆண்டுகளுக்கும் மேலாகப் பொதுத்தளங்களில் இருந்துகொண்டிருக்கும் இக்குற்றச்சாட்டுகளை, முன்னாள் ஆர்.எஸ்.எஸ் தலைவர் திரு சுதர்ஸன் அவர்கள் கூறியபோது, காங்கிரஸ் கட்சியினர் நாடெங்கிலும் உள்ள ஆர்.எஸ்.எஸ் அலுவலகங்கள் மீது தாக்குதல் நடத்த ஏவப்பட்டனர். சுதர்ஸன் பேச்சுக்கும் தங்கள் இயக்கத்திற்கும் சம்பந்தமில்லை என்றும் அவர் மீது சட்டப்படி நடவடிக்கை எடுக்கலாம் என்றும் ஆர்.எஸ்.எஸ் கூறியபோதும்கூட தனக்கே உரிய காரணங்களால் சோனியா நீதிமன்றத்தை அணுகவில்லை. இதே போன்றதொரு சந்தர்ப்பத்தில் அமெரிக்காவில் அவருக்குக் கிடைத்த அனுபவமே அவர் நீதிமன்றத்தை அணுகாததற்கு காரணமாக இருக்கலாம். அக்டோபர் 2007ல், ஐ.நா சபை காந்தி பிறந்த தினத்தை சர்வதேச அகிம்சை தினமாகக் கொண்டாடியபோது அங்கு பேசச் சென்ற சோனியாவுக்கு எதிராக, அமெரிக்க வாழ் இந்தியர் சிலர் அவருடைய தகுதிகளை கேள்விக்குள்ளாக்கி, ‘தி நியூயார்க் டைம்ஸ்’ பத்திரிகையில் ஒரு முழுப் பக்க விளம்பரம் கொடுத்திருந்தனர். அவ்விளம்பரத்தில் அவர் குடும்பத்தினர்மீது தற்போது கூறப்படுகின்ற அனைத்துக் குற்றச்சாட்டுகளும் இடம் பெற்றிருந்தன. சோனியா அவ்விளம்பரத்தைப் புறந்தள்ளவில்லை. அமெரிக்காவில் உள்ள தன் கட்சியினரை ஏவிவிட்டு விளம்பரம் செய்தவர்களுக்கு எதிராக 100 மில்லியன் டாலர் நஷ்டஈடு கேட்டு நியூ யார்க் நீதிமன்றத்தில் அவதூறு வழக்கு தொடர்ந்தார். மேலும் ஒரு வழக்கு நியூ ஜெர்ஸி நீதிமன்றத்தில் போடப்பட்டது. (6)

சோனியாவின் துரதிர்ஷ்டம், நியூ ஜெர்ஸி நீதிமன்றம் வழக்கு செல்லுபடியாகாது என்று சொல்லி தள்ளுபடி செய்துவிட்டது. உடனே சோனியாவின் கட்சியினரே நியூயார்க் நீதிமன்றத்தில் போட்ட வழக்கையும் வாபஸ் பெற்றனர். ஆனால் அவர்கள் மிடில்செக்ஸ் கவுண்டி நீதிமன்றத்தில் தங்களுடைய தாய்க் கட்சியான இந்திய தேசிய காங்கிரஸ், அந்த விளம்பரத்தில் அவதூறு செய்யப்பட்டுள்ளது என்று கூறி, 20 மில்லியன் டாலர் நஷ்டஈடு கோரி வழக்கு போட்டனர். ஆனால் வழக்கு தொடுத்த ‘இந்திய தேசிய வெளிநாட்டு காங்கிரஸ்’ முறையான வாதி அல்ல எனவும், அவதூறு என்பது ஒரு தனிப்பட்ட மனிதருக்குத்தான், ஒரு கட்சிக்கு இருக்கமுடியாது என்று உச்சநீதிமன்ற தீர்ப்பு உள்ளது எனவும் கூறி, நீதிமன்றம் தள்ளுபடி செய்துவிட்டது. (7)

ஆகவே, தன் மீதான குற்றச்சாட்டுகளை சோனியா புறந்தள்ளினார் என்பது உண்மையல்ல. மேலும் வழக்கு தொடர்ந்தால், தான் நீதிமன்றத்தில் குற்றவாளிக்கூண்டில் நிற்கவேண்டி வரும் என்கிற காரணத்தாலும் அவர் வழக்கு தொடராமல் இருந்திருக்கலாம்.

இதில் மேலும் கவனிக்க வேண்டிய விஷயம் என்னவென்றால், சோனியா தன் எதிராளிகளுடன் மோதும்போது அவர்களைத் தேர்ந்தெடுத்துத்தான் மோதுகிறார் என்பதே. உதாரணத்திற்கு, ஜனதா கட்சித் தலைவர் சுப்பிரமணியன் சுவாமி தன்னுடைய இணையத்தளத்தில், ‘உங்கள் சோனியாவைத் தெரிந்துகொள்ளுங்கள்’ (Know your Sonia) என்கிற தலைப்பில் சோனியா மீது பலவிதமான குற்றச்சாட்டுகளைக் கூறி, நீதிமன்றங்களில் செல்லுபடியாகக் கூடிய பல ஆதாரங்களுடன் விவரங்கள் கொடுத்துள்ளார். (8)  திரு ஏ.சூர்ய பிரகாஷ் அவர்கள் தொகுத்துள்ள ‘Issue of Foreign Origin – Sonia under scrutiny’ என்ற புத்தகத்தில் அவரும் மற்றும் பிற எழுத்தாளர்களும் கட்டுரையாளர்களும் சோனியாவைப் பற்றிய பல விவரங்களையும் குற்றச்சாட்டுகளையும் முன்வைத்து எழுதியுள்ளனர். அதோடு மட்டுமல்லாமல், பிஃரான்ஸுவா கோதியே, ஜான் மெக்ளிதன் போன்ற வெளிநாட்டு பத்திரிகையாளர்களும்கூட சோனியாவைக் கடுமையாக விமரிசித்து கட்டுரைகள் எழுதியுள்ளனர்.

மெக்ளிதன் ‘தி நியூ இந்தியன் எக்ஸ்பிரஸ்’ நாளிதழில், ‘An Empress of India in new clothes என்றும், கோதியே ‘Sonia’s presence in Delhi is costing India dearlyஎன்றும் கட்டுரைகள் எழுதியுள்ளனர். சமீபத்தில்கூட இருவரும் பாபா ராம்தேவ் விஷயத்தில் சோனியாவைக் கடுமையாக விமரிசனம் செய்துள்ளனர்.

 ‘Schweitzer Illustrate என்கிற பெயர்பெற்ற சுவிட்ஸர்லாந்து பத்திரிகையில் சோனியாவின் கருப்புப்பண வங்கிக் கணக்குகளைப் பற்றி செய்தி வந்துள்ளது. மேலும், டாக்டர் யெவ்ஜீனியா அல்பாட்ஸ் என்கிற ருஷ்ய நாட்டு பத்திரிகையாளர் தன்னுடைய ‘The State Within a State: The KGB in the Soviet Union’ என்கிற புத்தகத்தில், சோனியாவைப் பற்றிய சில ரகசிய விவரங்களை ஆதாரத்துடன் சொல்லியிருக்கிறார். அவையும் பொதுத் தளத்தில் பல வருடங்களாக இருப்பவைதான். சோனியாவுக்கும் ருஷ்யாவின் உளவு அமைப்பான கேஜிபிக்கும் இடையேயான தொடர்பைப் பற்றி சிபிஐ விசாரிக்கவேண்டும் என்று சுப்பிரமணியன் சுவாமி 2001ல் போட்ட வழக்கு இன்னும் தில்லி உயர்நீதிமன்றத்தில் நிலுவையில் உள்ளது. (9)

புராதனம் மிக்க சிலைகளையும் பொருட்களையும் இந்தியாவிலிருந்து கட்த்திச் செல்வதில் சோனியா ஈடுபட்டுள்ளார் என்றும் அதை விசாரிக்கவேண்டும் என்றும் கோரி மற்றொரு வழக்கையும் சுவாமி தில்லி உயர்நீதிமன்றத்தில் பதிவு செய்துள்ளார். (10)

வலுவான ஆதாரங்கள் கொண்ட எதிராளிகளைப் பொறுத்தவரை, அவர்களிடம் மோதாமல் அமைதி காக்கும் போக்கையே கடைப்பிடிக்கிறார் சோனியா. ஆனால் அதையே அவர்களுக்குரிய அவமதிப்புடன் புறக்கணிப்பதாகச் சொல்லிக்கொள்கிறார். தன்னுடைய அரசியல் அமைப்புச் சட்டத்தை மீறிய ஆளுமையையும் சக்தியையும் பயன்படுத்தி, அரசாங்கத்திலும், சி.பிஐ, நீதித்துறை போன்ற அமைப்புகளிலும் தனக்குச் சாதகமானவர்களை தலைமைப் பதவியில் வைத்து, அவர்கள் மூலம் தனக்கு எதிரான வழக்குகளை நீர்த்துப் போகச் செய்வதிலும் தாமதமாக்குவதிலும் ஈடுபடுகிறார் சோனியா என்ற சந்தேகம் எழுவது தவிர்க்கமுடியாதது.

உண்மையில் ஊழலைப் பற்றி அவர் ஒன்றும் பெரிதாகக் கவலை கொள்வது கிடையாது. ஈராக் நாட்டுடன் கொண்ட ‘உணவுக்கு எண்ணெய்’ (Oil for Food scam) ஒப்பந்த ஊழலில் நட்வர்சிங், போஃபர்ஸ் (Bofors scam) ஊழலில் கோத்தரோச்சி, காமன்வெல்த் போட்டிகள் ஊழலில் (CWG scam) கல்மாடி, ஸ்பெக்ட்ரம் ஊழலில் (2G scam) திமுக என்று தான் சம்பந்தப்பட்ட ஒவ்வொரு ஊழலிலும் யாராவது ஒருவரைப் பலிகடாவாக்குவது அவருக்கு கைவந்த கலை. அவர் மிகவும் பயப்படுவது அவர் வெளிநாடுகளில் பதுக்கி வைத்துள்ளதாகச் சொல்லப்படும் கருப்புப்பணம் பற்றிய புலனாய்வு மற்றும் விசாரணைக்குத்தான்.

இவ்விஷயத்தில்கூட ஓரளவிற்குத் திறமையாகச் செயல்பட முயன்றிருகிறார் என்றே சொல்லவேண்டும். 2009 தேர்தலில் கருப்புப்பண விவகாரத்தை ஒரு பெரிய பிரச்சினையாக பா.ஜ.க. முன்வைத்தபோது, நாங்கள் மீண்டும் ஆட்சிக்கு வந்தால் 100 தினங்களில் கருப்புப்பணத்தைத் திரும்பக் கொண்டு வரும் நடவடிக்கை எடுப்போம் என்று மன்மோகன் சிங் மூலம் அறிக்கை விட்டார். ஆனால் மீண்டும் அரசு அமைத்த பிறகு, ஊழல்தான் தொடர்ந்து கொண்டிருக்கிறதே தவிர, கருப்புப்பணத்தைத் திருப்புவதற்கான எந்த நடவடிக்கையையும் எடுக்கவில்லை. பா.ஜகவின் பணிக்குழு கருப்புப்பணத்தைப் பற்றிய ஆவணத் தொகுப்பை வெளியிட்ட பிறகு அத்வானிக்குத் தன்னுடைய கடுமையான ஆட்சேபத்தைத் தெரிவித்து கடிதம் எழுதி அவரிடம் இருந்து மன்னிப்பும் பெற்றார். அத்வானியின் செயலால் அவமானப்பட்ட பணிக்குழுவைச் சேர்ந்தவர்களோ, சோனியா தனக்கு ‘இடுக்கண்’ ஏற்பட்டதாகச் சொன்ன கடிதத்திற்கு அத்வானி ‘வருத்தம்’ தெரிவித்ததாகச் சொன்னார்கள். (11)

அவர் எதிர்பார்த்தார்போல் கருப்புப்பண விவகாரம் அந்தக் கடிதப் போக்குவரத்தோடு முடியவில்லை. பா.ஜ.க. தோல்வியுற்ற இடத்தில் பாபா ராம்தேவ் வெற்றி பெற்றார் என்றே சொல்லவேண்டும். நாட்டின் மூலை முடுக்குகளுக்கெல்லாம் பயணித்து மக்களிடையே கருப்புப் பண விவகாரம் பற்றியும் ஊழலைப் பற்றியும் ஒரு மிகப்பெரிய விழிப்புணர்ச்சியை ஏற்படுத்தினார் பாபா ராம்தேவ்.

அவருடைய தொடர் பொதுக் கூட்டங்களும் அவற்றிற்கு வரும் மக்கள்திரளும் சோனியாவை அதிர்ச்சிக்குள்ளாக்கியது உண்மை. ஒரு பக்கம் பாபா ராம்தேவ் தேசிய அளவில் பெரும் தாக்கத்தை ஏற்படுத்திக் கொண்டிருக்க, மறுபக்கம் சுப்பிரமணியன் சுவாமி நீதிமன்றங்களில் புரட்சிகரமாக இயங்கிக் கொண்டிருந்தார். சோனியாவின் ஊழல் அரசு இரண்டுபேருக்கும் இடையில் சிக்கிக்கொண்டு தவித்தபோது, உளவுத் துறையினர் கொண்டு வந்த செய்திகளும் சோனியாவின் வெந்த புண்ணில் வேலைப் பாய்ச்சுவதாக இருந்தன.

பிஃப்ரவரி மாதம் 27-ம் தேதி ராம்லீலா மைதானத்தில் ஒரு மாபெரும் பேரணிக்கு பாபா ராம்தேவ் ஏற்பாடு செய்துகொண்டிருந்தபோது, அப்பொதுக் கூட்டத்தில் அவருடன் ஒரே மேடையில் தோன்றுவதற்கு சுப்பிரமணியன் சுவாமியும் தயாரானார். கலங்கிப்போன சோனியா காந்தியத்தில் அடைக்கலம் புகுந்தார். தேச விரோதத் தொழில்துறையான என்.ஜி.ஒ தொழிலில் ஈடுபட்டுக் கொண்டிருக்கும் தன்னுடைய நம்பிக்கைக்குறியவர்கள் சிலரை அனுப்பி காந்தியவாதியான அண்ணா ஹசாரேவை வரவழைத்து ஊழலுக்கு எதிரான பாபா ராம்தேவின் இயக்கத்தை அவர் கடத்திக்கொண்டு போகுமாறு செய்தார். பாபா ராம்தேவின் மாபெரும் பொதுக்கூட்டங்களையும் பேரணிகளையும் முழுவதுமாகப் புறக்கணித்த, சதா சர்வகாலமும் காங்கிரஸ் துதி பாடிக்கொண்டிருந்த ஊடகங்களும், அண்ணா ஹசாரேவின் ஜந்தர் மந்தர் உண்ணாவிரதத்தை பெரிதுபடுத்திக் காண்பித்து, அவரை மதச்சார்பற்ற காந்தியாகவும், பாபா ராம்தேவை மதவெறியுள்ள ஹிந்துவாகவும் முன்னிலைப்படுத்தி, ஊழலுக்கும் கருப்புப்பணத்திற்கும் எதிரான மாபெரும் இயக்கத்தில் பிளவு உண்டாக்கின.

ஓரளவுக்கு வெற்றி பெற்ற களிப்பில் சோனியா இருந்தபோது, எப்ரல் 15 அன்று சுப்பிரமணியன் சுவாமி ஒரு பெரும் குண்டைத் தூக்கி அவர் தலையில் போட்டார்.

 சோனியா Vs சுவாமி – 2

 

கடந்த ஏப்ரல் மாதம் 15ம் தேதி சுப்பிரமணியன் சுவாமி பிரதமர் மன்மோகன் சிங்கிற்கு 206 பக்கங்கள் கொண்ட ஒரு மனுவை அனுப்பினார். அதில், ஊழல் தடுப்புச் சட்ட்த்தின் 11 மற்றும் 13-ம் பிரிவுகளின்கீழ் சோனியாமீது வழக்கு தொடர பிரதமரின் அனுமதியைக் கோரியிருந்தார். சோனியாவின் தேசிய ஆலோசனைக்குழு தலைவர் பதவி காபினெட் அமைச்சருக்கு சமமான அந்தஸ்தில் இருப்பதால், அவர்மீது சட்டப்படி நடவடிக்கை எடுக்க பிரதமரின் அனுமதி தேவை. சோனியாவின் மீதான அனைத்து ஊழல் குற்றச்சாட்டுகளையும் சுவாமி தன்னுடைய மனுவில் குறிப்பிட்டிருந்தார். (12)

அனைத்து ஊடகங்களாலும் வேண்டுமென்றே புறக்கணிக்கப்பட்ட சுவாமியின் மனுவில், 1974லிருந்து சோனியாவின் சந்தேகத்திற்கு இடமான நடவடிக்கைகள் அனைத்தும் பட்டியலிடப்பட்டிருக்கிறது. அவையாவன:

  1. பிரதமரின் அரசு பங்களாவைப் பயன்படுத்தியது – சோனியா 1970களில் பொதுத்துறை ஆயுள் காப்பீட்டு நிறுவனங்களின் பினாமி ஏஜெண்டாக, அப்போதைய பிரதமர் இந்திரா காந்தியின் அரசு வீட்டின் முகவரியைத் தன் முகவரியாக வைத்துக்கொண்டு, வேலை பார்த்திருக்கிறார். 1974 நவம்பர் 19 அன்று சுப்பிரமணியன் சுவாமி ராஜ்ய சபையில் இந்தத் தகவலைச் சுட்டிக் காட்டிய பொழுது, இந்திரா காந்தி சோனியாவை அந்த வேலையிலிருந்து ராஜினாமா செய்ய வைத்தார்.
  2. பெஃரா (FERA – Foreign Exchanges Regulation Act) சட்ட மீறல் – 25 ஜனவரி 1973 முதல் 21 ஜனவரி 1975 வரை சோனியா மாருதி கார் கம்பெனியில் (Maruti Technical Servicesநிர்வாக இயக்குநர் பதவியில் சம்பளம் பெறுபவராக இருந்துள்ளார். அதன் பிறகு Maruti Heavy Vehicles Pvt Ltd கம்பெனியிலும் நிர்வாக இயக்குநராக அதிகச் சம்பளம் பெற்றுள்ளார். அப்போது அவர் பல சட்டமீறல் குற்றங்களைப் புரிந்துள்ளார் என்றும் சுவாமி குற்றம் சாட்டியுள்ளார். உயர் நிலைப் பள்ளித் தகுதிகூட இல்லாத ஒருவர் மேற்கண்ட பதவிகளில் இருந்துள்ளதைச் சுட்டிக் காட்டியுள்ள சுவாமி, நீதிபதி ஏ.ஜி.குப்தா கமிஷன் (1977) ஐ.பி.சி மற்றும் பெஃரா சட்டங்களின் படி சோனியா பல குற்றங்கள் செய்துள்ளதாக அறிக்கையில் சொல்லியுள்ளதை ஆதாரமாக வைத்துள்ளார்.
  3. இத்தாலியக் குடியுரிமை; இந்தியாவில் ஓட்டுரிமை: – மக்கள் பிரதிநிதித்துவ சட்டத்தின் 31வது பிரிவின்படி, வாக்காளர் பதிவு விதிகள் (1960) கீழ்வரும் படிவம்-4ன்கீழ் சோனியா குற்றம் புரிந்துள்ளார் என்று சுவாமி கூறியுள்ளார். இத்தாலியக் குடியுரிமையுடன் இருக்கும்போது இந்திய வாக்காளராக சோனியா 1980ல் பதிவு செய்துள்ளார். ஒரு இந்தியக் குடிமகன் புகார் செய்தபிறகு 1982ல் அவர் பெயர் நீக்கப்பட்டது. பின்னர் மீண்டும் 1983ல் தன்னுடைய பெயரைச் சேர்த்து அக்குற்றத்தைப் புரிந்துள்ளார் சோனியா.
  4. ஏப்ரல் 1983ல் அவர் அவசரமாக அதிவேகத்தில் பெற்ற இந்தியக் குடியுரிமை, குடியுரிமைப் படிவங்களில் அரைகுறை பதில்களால் நிரப்பப்பட்டுப் பெற்றதாகும். உதாரணமாக, இத்தாலியக் குடியுரிமையை ரத்து செய்துள்ளதற்கான இத்தாலிய அரசின் ஆவணத்தைத் தராமல், அந்தக் கேள்வியின் கீழ் ‘சம்பந்தமில்லை’ (Not Applicable) என்று குறிப்பிட்டிருக்கிறார் சோனியா. ‘தில்லியில் உள்ள இத்தாலிய தூதரகம் சோனியா குறிப்பிட்டுள்ளதை வெறுமனே உறுதி செய்ததை ஒரு ஆதாரமாக எடுத்துக் கொள்ள முடியாது’ என்று தெரிவித்துள்ள சுவாமி, அவர் தன்னுடைய இத்தாலிய பாஸ்போர்ட்டை மீண்டும் 1992ல், இத்தாலியில் குடியுரிமைச் சட்டம் திருத்தம் செய்யப்பட்டபோது, திரும்பப்பெற்றார் என்று குறிப்பிட்டுள்ளார். அவ்வாறு சோனியா செய்தது நமது நாட்டின் குடியுரிமைச் சட்டம் (1955) 10ம் பிரிவின்படி இந்தியக் குடியுரிமையை ரத்து செய்வதாகும் என்றும் கூறுகிறார் சுவாமி.
  5. போஃபோர்ஸ் ஊழல் – கோத்தரோச்சியுடனான சோனியாவின் தொடர்பு; சோனியா அவருடன் சேர்ந்து எப்படி சதி செய்தார்; கோத்தரோச்சிக்கும் அவர் மனைவி மரியாவுக்கும் சோனியா குடும்பத்திடம் எவ்வளவு சுதந்திரம் இருந்தது; ராஜிவ் சுவிட்ஸர்லாந்து சென்றபோது தன்னுடைய சகோதரியின் கணவர் வால்டர் வின்ச்சியின் செல்வாக்கின் மூலம் ராஜிவை எவ்வாறு ஊக்கப்படுத்தினார்; சிபிஐமீது எப்படி அதிகாரத் துஷ்பிரயோகம் செய்து கோத்தரோச்சியைத் தப்புவித்தார் போன்ற பல விவரங்களைக் கொடுத்துள்ளார் சுவாமி. Outlook பத்திரிகையில் வந்த ஸ்வீடன் நாட்டு தேசியப் புலனாய்வு மையத்தின் தலைமை அதிகாரி ஸ்டென் லிண்ட்ஸ்டார்ம் அவர்களின் பேட்டி; இந்திய உளவுத்துறை அதிகாரி நரேஷ் சந்திரா சிபிஐ ஆய்வாளர் கண்ஷ்யாம் ராய்க்கு 20 மார்ச் 1997 அன்று எழுத்து மூலம் கொடுத்த ஆவணம் (ஹெட்லைன்ஸ் டுடே சானல் வெளியிட்ட செய்தி); நாம் ப்ரொகெட்டி (Snam Progettiஎன்கிற இத்தாலிய பொதுத்துறை நிறுவனத்தின் பிரதிநிதியாக இந்தியாவில் இருந்த கோத்த்ரோச்சியின் கார் டிரைவர் சசிதரனின் சாட்சி ஆகியவற்றை ஆதாரங்களாகச் சுட்டிக் காட்டியிருக்கிறார் சுவாமி.
  6. சோனியாவின் கருப்புப்பணம் – ராஜிவ் காந்தியின் பெயரில் சுவிட்ஸர்லாந்து வங்கியில் உள்ள கருப்புப்பணம் அவர் இறந்தபிறகு அவர் மனைவி என்கிற முறையில் இவருக்கு நேரிடையாக வந்து சேர்ந்தது; ருஷ்ய உளவு ஸ்தாபனமானKGB-யிடமிருந்து இவருக்கு வந்த நிதி; இந்தியாவின் புராதனப் பொருட்களையும் சிலைகளையும் சட்டத்திற்குப் புறம்பாக விற்றதில் இவருக்குக் கிடைத்த பணம்; பெஃமா (FEMA) மற்றும் எஃப்.சி.ஆர்.ஏ (FCRA) சட்டமீறல்கள ஆகியவற்றையும் தன் மனுவில் குறிப்பிட்டுள்ளார். இந்த சொத்துக்கள் குறிப்பிடப்படாத சோனியா மற்றும் ராகுல் ஆகியோரின் தேர்தல் மனுக்கள்; Schweitzer Illustrate பத்திரிகைச் செய்தி; தி ஹிந்து மற்றும் டைம்ஸ் ஆஃப் இந்தியா ஆகிய செய்தித்தாள்களில் ராஜிவ் குடும்பத்திற்கு ருஷ்ய கேஜிபி கொடுத்த நிதி பற்றிய செய்திகள்; ருஷ்ய ஜனாதிபதி போரிஸ் யெல்ஸ்டின் அவர்களால் நியமிக்கப்பட்ட கேஜிபி நடவடிக்கைகளுக்கான கமிஷனின் தலைவி யெவ்ஜீனியா அல்பாட்ஸ் எழுதிய The State within Stateஎன்கிற புத்தகத்தில் குறிப்பிட்டுள்ள செய்திகள்; சோனியாவுடனும் அவரின் அரசியல் ஆலோசகர் அகம்மது படேலுடனும் நெருங்கிய தொடர்பு கொண்டுள்ள, சமீபத்தில் கைதாகிய ஹஸ்ஸன் அலி சுவிட்ஸர்லாந்தின் ரகசிய வங்கிக் கணக்குகளுக்குப் பணம் அனுப்பியதாகக் கொடுத்த வாக்குமூலம் ஆகிய ஆதாரங்களைத் தந்துள்ளார் சுவாமி.
  7. உணவுக்காக எண்ணெய் ஊழல் – ஐ.நா.சபை நிறுவிய டாக்டர் எஃப் வோக்கர் என்பவரது தலைமையிலான கமிட்டி காங்கிரஸ் கட்சி உணவுக்காக எண்ணெய் ஊழலில் பெரும் பயனடைந்தது என்று கொடுத்த அறிக்கை; காங்கிரஸ் அடைந்த அந்தப் பயன்களை (எண்ணெய்) மார்ச் ரிக் என்பவர் மூலம் கள்ள மார்கெட்டில் அதிக விலைக்கு விற்றது; மார்க் ரிக் என்பவர் பெயர்போன ஒரு கள்ளக்கடத்தல் மன்னன் என்பது; அமெரிக்க நீதிமன்றங்களால் அவன் கடுமையாகத் தண்டிக்கப்பட்டு பின்னர் இஸ்ரேல் பிரதமரின் சிபாரிசால் 2000ம் ஆண்டு ஜனாதிபதி கிளிண்டனால் மன்னிக்கப்பட்டது; அவன் தற்போது சுவிட்ஸர்லாந்தில் வசிப்பது ஆகிய விவரங்களையும், இந்த ஊழலில் நட்வர் சிங் எவ்வாறு பலிகடாவாக ஆக்கப்பட்டார் என்பதையும் சுவாமி விவரமாக மனுவில் குறித்துள்ளார்.
  8. அமெரிக்க வாழ் இந்தியர்களுக்கு எதிராக சோனியா போட்ட அவதூறு வழக்கு– காங்கிரஸ் கட்சியின் வெளிநாட்டுக் கிளை (INOC  Indian National Overseas Congressநாரயண் கதாரியா மற்றும் இருவர் மீது நியூ யார்க் மற்றும் நியூ ஜெர்ஸி நீதிமன்றங்களில் தொடர்ந்த வழக்கு; நீதிபதி எமிலி குட்மேன் அந்த வழக்கைத் தள்ளுபடி செய்தது; வழக்கு போடத் தூண்டியதாகக் கூறப்பட்ட நியூ யார்க் டைம்ஸ் பத்திரிகையில் வந்த விளம்பரம் ஆகியவற்றை குறிப்பிட்டுள்ள சுவாமி, “இந்த உண்மைகளை எதிர்த்து நிஜமாகவே வெற்றி பெறும் சாத்தியம் இருக்கும் பட்சத்தில் சோனியா நீதிமறத்தில் ஆஜராகி வழக்கைத் தொடர்ந்திருக்கலாமே? ஏன் செய்யவில்லை? என்றும் கேட்கிறார்.

சுவாமி தன்னுடைய பத்திரிகை அறிக்கைகளிலும், ஊடக நேர்காணல்களிலும் சோனியாவின் சகோதரிகளான அனுஷ்கா மற்றும் நடியா ஆகிய இருவரும் ஸ்பெக்ட்ரம் ஊழலில் 60% பயனை அடைந்துள்ளனர் என்று உறுதியாகக் கூறியிருக்கிறார். கடைசியில் 24 நவம்பர் 2010 அன்று பிரதமர் மன்மோகனுக்கு எழுதியுள்ள கடிதத்தில், “எனக்குக் கிடைத்த தகவலின்படி, சோனியாவின் சகோதரிகளான அனுஷ்காவும், நடியாவும் தலா 18,000/- கோடி ரூபாய் வீதம் 60% (36,000 கோடி ரூபாய்) ஸ்பெக்ட்ரம் ஊழல் பணம் பெற்றுள்ளனர். மலேசியா, ஹாங்காங், துபாய் மற்றும் ஏனைய ஐரோப்பிய நாடுகளுக்கு சோனியாவும் அவரின் குடும்பத்தினரும் அடிக்கடி பறந்து செல்வதையும் அப்பயணங்களின் பின்ன்னியையும் நமது நாட்டின் சட்டங்களின்படி விசாரணை செய்ய வேண்டும். வர்த்தகத்துறையில் உள்ள விமானங்களில் பயணம் செய்யாமல், தனியார் கார்பரேட் நிறுவன்ங்களின் ஜெட் விமானங்களில் அவர்கள் பயணம் செய்வது, தங்களுடைய தனியான கவனத்துக்குரியது. அவ்வாறு தனியார் விமானங்களில் பயணிப்பதே Directorate General Civil Aviation (DGCA) விதிகளின்படி குற்றமாகும் என்பதையும் தங்களுக்கு நினைவூட்டுகிறேன். மேலும் சோனியாவும் அவர் குடும்பத்தினரும் துபாய் சென்று அங்கிருந்து அராபிய தொழிலதிபர்களின் ஜெட் விமானங்களில் ஐரோப்பிய நாடுகளுக்குச் செல்வதை வாடிக்கையாக்க் கொண்டுள்ளனர் என்றும் அறிகிறேன். அவர்கள் எந்த பாஸ்போர்டில் பிரயாணம் செய்கிறார்கள் என்பது சரியாக விளங்கவில்லை. துபாயில் அவர்களை அனுசரிப்பவர்கள் பாகிஸ்தான் உள்ளிட்ட நமது எதிரி நாடுகளின் பிரதிநிதிகளாகவும் இருக்கிறார்கள்” என்று எழுதியுள்ளார். (13)
காமன்வெல்த் போட்டிகள் நடத்தியதில் ஏற்பட்ட ஊழலிலும் சோனியா குடும்பத்தினருக்குப் பெரும்பங்கு இருக்கும் போலிருக்கிறது. ஆகஸ்டு 11 2010 தேதியிட்ட தன்னுடைய பத்திரிகை அறிக்கையில், “சமீபத்தில் வெளிநாடுகளுக்குச் சென்றிருந்தபோது, இதுவரை காமன்வெல்த் போட்டிகளுக்காகச் செலவு செய்யப்பட்டுள்ள ரூபாய் 40,000 கோடியில், ஆலோசனைக் கட்டணம், காண்டிராக்ட் தொகை போன்ற பெயர்களில் 15,000 கோடி ரூபாய் லஞ்சப் பணமாகக் கொடுக்கப்பட்டுள்ளது என்பதை அறிந்தேன். இதில் அதிகபட்சத் தொகை காங்கிரஸ் எம்பியும், சோனியாவின் மகனுமான ராகுல் காந்திக்குச் சென்றடைந்துள்ளது. லண்டனில் ராகுல் காந்தி ராவுல் வின்ஸி என்கிற பெயரில் அறியப்படுகிறார். லண்டனில் உள்ள இந்திய ஹைகமிஷனின் அலுவலர் ஒருவரே ராகுலின் ஏஜெண்டாக இருக்கிறார். ராகுல் குறைந்தபட்சம் மாதம் ஒருமுறையாவது, முறையாக அறிவிக்கப்படாத தன் மனைவியான கொலம்பியப் பெண் வெரோனிக்காவுடன் லண்டனுக்குப் பயணம் செய்கிறார்” என்று சுவாமி கூறியுள்ளார்.(14)

ஆட்சி பீடத்தின் உச்சத்தில் இருப்பவர்களின் ஊழலுக்கு எதிராக சற்றும் சளைக்காமல் போராடி வரும் தனிமனிதர் சுவாமி. அவருடைய கடுமையான உழைப்பினால் மிகவும் பலம் வாய்ந்த நபர்களான ஏ.ராஜா, கனிமொழி போன்றவர்களைச் சிறைக்குள் அனுப்பியிருக்கிறார். கருணாநிதியைப் பற்றியும் தன்னுடைய மனுவில் குறிப்பிட்டுள்ளார். உள்துறை மந்திரி பி.சிதம்பரத்தைப் பற்றியும் ஸ்பெக்ட்ரம் ஊழலில் அவருடைய பங்கு பற்றியும் அவர் பிரதமருக்குக் கடிதம் எழுதியுள்ளார். சிபிஐயின் இயக்குனர் ஏ.பி.சிங் அவர்களுக்கு 13 மே 2011 அன்றும், இணை இயக்குனர் ஹிதேஷ்.சி.ஆவஸ்தி அவர்களுக்கு மே 10, 2011 அன்றும், சிதம்பரத்தை விசாரணை செய்யுமாறு கடிதம் எழுதியுள்ளார். மேலும், கருப்புப் பண மோசடி மன்னன் ஹஸ்ஸன் அலி விஷயத்தில் சோனியாவுக்கு ஏதுவாகச் செயல்பட்டதற்காக நிதியமைச்சர் பிரணாப் முகர்ஜி ராஜினாமா செய்யவேண்டும் என்றும் மார்ச் 11 2011 தன்னுடைய பத்திரிகை அறிக்கையில் கூறியுள்ளார் சுவாமி. (15)

இதனிடையே, கடந்த ஜுன் 4ம் தேதியன்று, கருப்புப் பணம் மற்றும் ஊழலுக்கு எதிரான தன்னுடைய பிரசாரத்தைத் தொடர்ந்து செய்துகொண்டிருந்த பாபா ராம்தேவ் ராம்லீலா மைதானத்தில் ஏற்பாடு செய்திருந்த மாபெரும் போராட்டத்தில், நடுஇரவில் அமைதியாகத் தூங்கிகொண்டிருந்த மக்கள் மீது போலிசாரை ஏவி கடும் தாக்குதல் நட்த்தியது சோனியா அரசு. அந்தத் தாக்குதலானது சோனியாவின் உத்தரவின் பேரில் உள்துறை அமைச்சர் சிதம்பரம் ஆணையிட்டு தில்லி போலிசார் செய்ததாக நம்பப்படுகிறது. அச்சம்பவத்தை ‘துரதிர்ஷ்டவசமானது ஆனால் தவிர்க்க முடியாதது என்று மன்மோகன் வர்ணித்தார்.(16)
மன்மோகன் அரசுக்கு எதிராக நாடெங்கும் கண்டனக்குரல்கள் எழும்பிய அதே வேளையில், சுவாமி மற்றொரு குண்டை சோனியா மீது வீசினார். ஜூன் 8, 2011 தேதியிட்ட தன் அறிக்கையில், ‘சோனியாவும் அவருடைய சகோதரிகள் அனுஷ்கா மற்றும் நடியா ஆகிய இருவரும் இத்தாலியில் உள்ள சர்தினியாவில் ஆகா கானுக்கு சொந்தமான பெரும் சொத்தை விலைக்கு வாங்கியுள்ளனர். என் விசாரணையின்படி, ஏ.ராஜா அவர்களுக்கு கொடுத்துள்ள 8 பில்லியன் டாலர் பணத்திலேயே அந்தச் சொத்து வாங்கப்பட்டுள்ளதாகத் தெரிகிறது. அமைச்சர்களுக்கான சட்ட விதிகளின் படி, பிரதமர் மன்மோகன் சோனியாவிடம் இந்தக் குற்றச்சாட்டை மற்றுக்கவோ அல்லது அவருடைய சொத்துப் பட்டியலை வெளியிடவோ சொல்லவேண்டும். எப்படியாயினும், இந்தச் செயல் சட்டத்திற்குப் புறம்பானது என்பது தெளிவாகிறது என்று குறிப்பிட்டுள்ளார். (17)

சுவாமியின் அறிக்கை வெளியான அடுத்த நாளே சோனியாவும் ராகுலும் இத்தாலிக்குச் சென்றனர். பாபா ராம்தேவ் தன்னுடைய உண்ணாவிரதத்தை முடித்த அன்று அவர்கள் இருவரும் சுவிட்ஸர்லாந்தில் இருந்துள்ளனர். இந்தப் பயணம் மிகவும் புதிரானது என்பதைச் சொல்லவும் வேண்டுமோ! (18)

தற்போது சிதம்பரத்தை விசாரிக்க வேண்டும் என்று சுவாமி தாக்கல் செய்துள்ள மனு உச்ச நீதிமன்றத்தில் நிலுவையில் உள்ள நிலையில், பிரணாப் முகர்ஜியின் அனுமதியுடன் நிதி அமைச்சகம் பிரதமர் அலுவலகத்திற்கு எழுதிய (25 மார்ச் 2011 தேதியிட்ட) அலுவலகக் குறிப்பேடு வெளியாகி, ஸ்பெக்ட்ரம் விற்பனைமுடிவில் இருக்கும் சிதம்பரத்தின் பங்கை நிரூபணம் செய்துள்ளது. எனவே விசாரணையிலிருந்து சிதம்பரம் தப்பிக்க வாய்ப்பு இல்லையென்றும், சுவாமி மனுவின் மீதான உச்ச நீதிமன்றத்தின் தீர்ப்பு அப்படித்தான் இருக்கும் என்று கூறப்படுகிறது.(19)

இதனிடையே, ஒரு தொலைக்காட்சிக்கு அளித்த பேட்டியில், “ஸ்பெக்ட்ரம் ஊழலில் திமுக தலைவர் கருணாநிதியும், சோனியாவின் மருமகன் ராபர்ட் வதேராவும் (பிரியங்காவின் கணவர்) பங்கு பெற்றுள்ளனர். அவர்களையும் விசாரிக்கக் கோரி நான் மனு செய்வேன்” என்று சுவாமி கூறியுள்ளார். உடல்நிலையைக் காரணம் காட்டி அமெரிக்கா சென்று ஒரு மாதம் கழித்து இந்தியா திரும்பிய சோனியாவுக்கு இது பேரதிர்ச்சி அளித்துள்ளது. சிதம்பரத்திற்கும் பிரணாப் முகர்ஜிக்கும் இடையே ஏற்பட்டுள்ள பிரச்சினையை சுமாராக சமாளித்து நிமிர்ந்த அவருக்கு சுவாமி ராபர்ட் வதேராவையும் ஊழலில் இழுத்துள்ளது பேரதிர்ச்சியைத் தந்துள்ளது. (20)

திடீரென்று, சுவாமி நான்கு மாதங்களுக்கு முன்னால் DNA (Daily News & Analysis) இதழில் எழுதிய கட்டுரையில் மதத் துவேஷத்தைத் தூண்டியுள்ளார் என்று சொல்லி தில்லி போலிசார் முதல் தகவல் அறிக்கை தயார்செய்துள்ளனர். (21)

இவ்விஷயத்தில் ஒரு நகைமுரண் என்னவென்றால், அந்தக் கட்டுரை வந்தபோதே அஸ்கர்கான் என்கிற தில்லியைச் சேர்ந்த வக்கீல் ஒருவர் நீதிமன்றத்தை அணுகியபோது நீதிமன்றம் அவரைக் காவல்துறையிடம் போகச் சொன்னது. அப்போது தில்லியில் உள்ள தில்லைநகர் போலிசாரும் நிஜாமுதீன் போலிசாரும் முதல் தகவல் அறிக்கை பதிவு செய்ய மறுத்துள்ளனர். (22)

தற்போது, அதுவும் நான்கு மாதங்கள் கழித்து தன்மீது தில்லி குற்றவியல் போலிசார் முதல் தகவல் அறிக்கை பதிவு செய்துள்ளதற்குக் காரணம் சோனியாவும் சிதம்பரமும்தான் என்று கூறியுள்ளார் சுப்ரமண்யன் சுவாமி. (23)

பிரதமர் மன்மோகனிடம், “நீங்கள் தலையிட்டு அந்த முதல் தகவல் அறிக்கையை வாபஸ் பெறச் செய்யுங்கள். இல்லாவிடில் மேலும் அரசுக்கு சிக்கல்கள் உருவாகும் என்று கேட்டுக் கொண்டுள்ளார். மேலும், “உயர் நீதிமன்றத்தில் மனு செய்து அந்த முதல் தகவல் அறிகையை ரத்து செய்வேன் என்றும் பத்திரிகையாளர் சந்திப்பில் கூறியுள்ளார். (24)

Fraud charges: Rahul Gandhi threatens legal action against Subramanian Swamy

Rahul Gandhi on Thursday night threatened to pursue "all legal actions" against Janata Party chief Subramanian Swamy, who targeted him and Sonia Gandhi raising questions over acquisition of a company that published the now-defunct National Herald newspaper to which Congress gave a loan of over Rs. 90 crore.

"Our attention has been drawn to your purported press conference of the afternoon of November 1. The allegations made by you are utterly false, entirely baseless and defamatory," Rahul Gandhi's office said in a communication to Swamy.

It said, "Your action of calling a press conference is a motivated attempt for reasons, which one can easily discern."

 

 

"We are committed to pursuing all legal actions against the scandalous abuse evident in your so-called press conference. Please be informed that we shall pursue the legal remedies open to us against the utterly motivated and irresponsible contents of your press conference.

"And that we shall pursue all proceedings that are available in law to ensure that an individual like you do not abuse the freedom to speak and write in utter violation of the equal important need in a civilised society to maintain the dignity of individuals and organizations and to abide by the law of the country," it said.

Earlier addressing a press conference in New Delhi, Swamy had said Sonia and Rahul had floated a Section 25 company called Young Indian each with a share holding of 38%, which acquired Associated Journals, founded by late Jawaharlal Nehru, that published the National Herald and Quami Awaz.

 

Swamy said Associated Journals obtained an unsecured loan of over Rs. 90 crore from AICC which he claimed was illegal under Income Tax Act because a political party cannot give loans for commercial purposes.

The crime which he committed was, in America you can enter with more than 10,000USD in cash without declaring it and the punishment is 8 years for every installment of 10K dollar you exceed So he had 16 times and therefore you will be sent to jail for 128 years 16 times of 8. The Bush Govt saying to call FBI off because this will affect our Indo-US relation and FBI agreed. After 9 hours of questioning the FBI told Rahul gandhi if you if give a undertaking that whenever we will call you again you will apear in USA then we will let you go. They took that in writing and they registered a case also. Now why Vajpayee wanted to protect Rahul Gandhi multiple times? (3.32min)

2 Mr Quattrocchi, the Malaysian govt that decided to extradite him to INdia and they informed indian govt. Quattrocchi old SOnia Gandhi that if I have to go to Indian Jail then I will speak out everything because I can not stand Indian Jail, I will buy out my way out. Then Sonia Gandhi went to Vajpayee. And Vajpayee ensured that the CBI lawyer in Malaysia was selected by the Quattrocchi. Vajpayee told that please we are not interested in his extradition. Because our smooth function of the govt will be disturbed. And Quattrocchi won that case easily and he went back to Italy. I went to Delhi High court and filed a petition in 2001 that Sonia Gandhi is receiving payments from Russian KGB and when Russian govt had when asked by a Hindu News paper that is it true then they said on record Yes, because Sonia Gandhi and Nehru family has always been friendly to Soviet Union. So with that proof I filed it. Because the Americans, after the Collapse of Soviet Union, they went into KGB library and they photocopied every document of KGB and placed in princeton library, harvard library and library of Congress. So I went to Harvard library and download it. And got all Indians who got KGB money and Sonia Gandhi was in that. Sonia Gandhi has also been smuggling idols from indian temple to abroad and getting it auctioned by her sisters. So for this purpose of creating a bill, she created two shops in Italy. One was near Milan and it was called Etnica and another in her hometown of uplasano near turin, it is called Ganapati I had people who go there and take photographs and give me copies of that. So I have filed that said she is smuggling our paintings and our Murits from our temples and having them auctioned. After keeping them for some time in her shop and making false bill and then taking them to London. I also made other charges about her educational qualification that she claimed that she is educated from cambridge university but she has not passed fifth class. ALl these charges as Prima facie accepted by the Delhi High court and they issued notice to CBI. Court said to CBI to get these documents, original documents because Swamy got photostats. So CBI went to Italy and Russia and both govt said that we are ready to give all the documents but you first give us a letter rogatory, which is a international procedure. Which mean a FIR has to be registered and this FIR has to be filed in court by court of Law in India. Then court will issue a request which is called letter rogatory to these governments saying please assist as in prosecution of the accused. So the matter came in court so I argued that let the govt register a FIR and go to court and get a letter rogatory. The counsel for Raju Ramachandran which was counsel for the CBI. He said this is sudden development and a I need instructions from the govt so please give me 2 weeks adjournment So two weeks adjournment was given. And after two weeks when the court assembled the counsel for the CBI was changed from Mr Raju Ramachandran to Mr Malhotra who is a congressman, who takes up Sonia Gandhi cases in election matters and all that. ANd I was surprised I asked Arun Jaitely, he was the Law Minister later on, how did you change and bring a congressman? He said Mr Atal Bihari Vajpayee instructed me to do that. So the court posted it, for hearing whether FIR should be directed by the court itself if the govt did not willing, which was my demand. But in the meantime Vajpayee advanced the election and he lost the election and SOnia gandhi came to power. After that you know that it is very difficult for judges to go against govt. Balakrishnan became the Chief justice who was Great chamcha of Sonia Gandhi. So I did not pursue the matter and left there. (10.54 min)

Now comes to your question why. Ever since Indira Gandhi died Mr Vajpayee was blackmailed by the Nehru family. Why he was blackmailed and for what he was blackmailed is too long story for me to go. Someday you call me for a special lecture on Vajpayee i will tell. Because you will ask me how you know this, how you know that, what is the proof, so I must have all those things ready etc. 
But broadly speaking Mr Vajpayee had much to hide. During the emergency he wrote apology letter to Indira Gandhi saying that what Jayaprakash narayan done was wrong and he is sorry for it. And so please let me out of Jail. Indira Gandhi let him out of Jail. So all this put together his govt was hand in glove with SOnia Gandhi. So therefore Jayalalithaa told me that we should bring this govt down and thats how his govt brought down. That time I did not know that Sonia Gandhi and Vajpayee also had deal. I thought Indira Gandhi and Vajpayee had deal. So Rajiv Gandhi was my friend so he never thought of Vajpayee very high. Therefore I assumed his wife will be also like that, later on I came to know that these two (Sonia & Vajpayee) also had deal. So to bring down this govt Sonia Gandhi agreed to help us, because she wanted to put pressure on vajpayee for the Quattrochi matter to block the case and once she got deal she left us halfway. So even if Jayalalithaa has not decide to bring down the govt Vajpayee govt continued and all these 5 years he protected the Sonia gandhi and thats why I supported Jayalalitha.

Refresh to  your memory, rahul was arrested/detained by the FBI at BOSTON Airport in September 2001.He was carrying with him $ 1,60,000 in Cash. He couldn’t explain why he was carrying so much cash.Incidentally he was with his Columbian girlfriend Veronique Cartelli, ALLEGEDLY, the Daughter of Drug Mafia.9 HOURS he was kept at the Airport. Later then freed on the intervention of the then Prime Minister Mr.A.B.Vajpayee.. FBI filed an equivalent of an FIR in US and released him. When FBI was asked to divulge the information, by Right/Freedom to Information Activists about the reasons Rahul was arrested … FBI asked for a NO OBJECTION CERTIFICATE from Rahul Gandhi. So Subramaniyam Swami wrote a Letter to Rahul Gandhi, ” If you have NOTHING to HIDE, Give us the Permission”

Why did that arrest not make Headlines Rahul? You could have gone to the Media and told, “I am ashamed to call myself an INDIAN?”Or is it that, you only do like to highlight Symbolic Arrests (like in UP) and not Actual Arrests ( In BOSTON)

New DelhiJanata Party President Subramanian Swamy today dared Rahul Gandhi to take him to court.

"Either Rahul Gandhi or his lawyer sends a letter to me (or) I will throw of these papers in the dustbin without reading it. My advice to Rahul Gandhi is grow up, go to the court and file a defamation case. I will fight him there," Mr Swamy said.

    Unfazed by Subramanian Swamy’s charges over acquisition of a company that published the National Herald newspaper, the Congress on Friday dared the Janata Party chief to sue Sonia Gandhi and Rahul Gandhi, contending that the onus to prove allegations lay with those who make these.

    “If Swamy has guts, he should sue Rahul Gandhi and Sonia Gandhi. It is for those to prove charges, who make allegations. If there is a violation let them take it to court,” party spokesperson P.C. Chacko told reporters, responding to a host of questions at the AICC briefing.

    Chacko’s challenge came a day after Rahul Gandhi threatened to pursue “all legal actions” against Swamy, dubbing his allegations as “utterly false, entirely baseless and defamatory.”

    Chacko, however, refrained from giving a categorical reply whether the Congress would sue the Janata Party chief as suggested by Rahul Gandhi on Thursday.

    “Future course is open to us. All options are open to us,” he merely said.

    He also parried questions about the specific charges leveled by Swamy as well the leader of the opposition, Arun Jaitley.

    “Whether Swamy will sue or not, we want to see. It is not our responsibility. It is the responsibility of the people, who raise an allegation. We are not responsible for it. We have explained that there is no wrong thing.

    “They have been doing that consistently. He is holding press conference and running away to make next allegation the next day. They are making blind allegations. They have nothing to substantiate. No newspaper’s property is valued in real estate terms,” Chacko said.

    He said that if there is any violation of Income Tax Act or the Company Act, “we challenge them to prove it. There is no commercial transaction. People are trying to mislead and gain out of confusi

Rahul Gandhi calls for clear majority in 2014 polls

4919783891154752463_Org.jpgPune: Congress Vice President Rahul Gandhi, on Wednesday, called upon party workers to work towards ensuring that the Congress gets a clear majority in the 2014 Lok Sabha polls.

Gandhi added that if that was not achieved, then the Congress would be compelled to continue its alliance with other UPA partners. 

He was interacting with party leaders and workers from 22 districts including western Maharashtra, Konkan and Marathwada regions at the Chattrapati Shivaji Sports Complex in Balewadi. Gandhi interacted for about 30 minutes with each delegations and gave them a patient hearing. 

During the meeting, a vast crosssection of party workers from various districts in western Maharashtra complained about the Congress’ alliance partner the Nationalist Congress Party (NCP) and demanded that the Congress go to the polls alone.

With most party workers speaking about the Congress contesting the election on its own, Gandhi said that if the workers do the groundwork the party could win 272 seats in the Lok Sabha election. If that did not  happen, then an alliance would be mandatory, he said.

Polls in April-May ’14

Gandhi hinted that Lok Sabha polls could take place in April or May next year. He said that there was nothing to worry about despite the BJP having announced Narendra Modi as its prime ministerial candidate. 

He said, “In my interactions, no concerns were raised by any worker about our opposition in Maharashtra. Instead, they seemed to be more concerned about our alliance partner. It shows that in Maharashtra the Congress has a good base. Once campaigning starts, the Congress will surge ahead.”

Stating that the Congress is “handicap” in Navi Mumbai as it does not have a single assembly seat, party leaders from satellite city, who met Congress vice-president Rahul Gandhi in Pune on Wednesday, pitched for contesting on one seat in the coming elections. They also demanded snapping of political ties with the Nationalist Congress Party (NCP) at all levels. 

“There was a general sentiment among all those gathered to meet Gandhi that the Congress should snap ties with NCP and contest elections on its own strength. As far as Navi Mumbai is concerned, we have informed him that we are do not have much say in the satellite city since we are not holding any assembly seat. Both the seats are with the NCP. How can we help the party grow in a situation like this?” said Dashrath Bhagat, Navi Mumbai district Congress chief, who led the delegation to apprise Gandhi of the ground-level political scenario ahead of the 2014 Lok Sabha elections. 

Congress members and corporators demanded that the party should demand one assembly seat in the satellite city from the NCP. Both the assembly seats in Navi Mumbai — Airoli and Belapur are with the NCP. While Sandeep Naik is MLA from Airoli seat; guardian minister Ganesh Naik has been elected from the Belapur seat.

The delegation apprised Gandhi of local issues as well. The Congress vice-president visited Maharashtra for interaction with district-level leaders and workers to gauge the ground level politics ahead of the elections. “We have demanded one seat for Congress for the forthcoming assembly elections. We have been making similar demand to the Maharashtra Pradesh Congress Committee (MPCC), which has been responding positively to our demand. And we have apprised Gandhi on the need for contesting one assembly seat in the satellite city,” Bhagat added. Gandhi had allotted a particular time to the Congress leaders from Navi Mumbai to raise their issues. “There is no use of forging alliance with the NCP; Congress must contest the elections on its own strength,” said a Congress leader who was part of the delegation that met Gandhi.

However, Gandhi seems to have told the delegation that the Congress will need NCP at least at the Centre. “If you [referring to Congress workers] can help us get absolute majority, we will not need any political party’s support and can form government on our own strength,” Gandhi told the members. 

Besides, apprising Gandhi of the political scenario, the city Congress members also informed him of various issues such as extra floor space index, problems faced by project affected persons, providing basic facilities to slum dwellers on MIDC land, increasing the frequency of Harbour line trains, starting more ladies specials, maintaining proper security on local trains and platforms, starting reservation counters at Airoli and Nerul stations for outstation trains. 

Gandhi assured the members that he will work out a solution for all these issues after having a word with the MPCC and the state government. Earlier, MPCC president Manikrao Thakre, too, had seconded the demand made by city Congress, saying, since the party does not have any MP or MLA from this area, it is difficult for the party workers and leaders to function in Navi Mumbai.

New Delhi: Even in moments of high tension,Prime Minister Mamohan Singh displays minimum emotion.But on Friday he wouldve steeled himself ahead of meeting Barack Obama,knowing his every nuance was under scrutiny.
The test is all the more severe on foreign soil amid hectic international engagements that include an encounter with Pakistani PM Nawaz Sharif in the wake of escalating terror strikes and opposition attacks.
If Rahul Gandhis remarks amount to a public humiliation for the PM and his government,Singh will take care not to let it show.Congress president Sonia Gandhis soothing words must be helping his efforts.She called him to reassure him of the partys support.Sources said the call was to assuage any hurt.
Even Rahul,in his letter to the PM,emphasized his respect for Singh and his leadership.The Congress decision to release contents of the letter pointed to damage control efforts against the backdrop of the rising perception that the Congress vice-presidents dramatic performance was a direct humiliation of the PMs office.
Statements released on his behalf from the US indicate that the attempt was succeeding.A reference to Rahul having written to him and the promise that the Cabinet will consider his views on Singhs return dont signal defiance or a bruised ego.
The manner in which Rahul rubbished the ordinance to help convicted legislators far surpassed the tongue lashings CPM boss Prakash Karat handed out to Singh over the nuclear deal with the US during UPA-1.
The incident shreds what remains of Singhs prime ministerial authority already severely eroded by scams ranging from the Commonwealth Games to Coalgate.

Washington: A deeply embarrassed Manmohan Singh reeled back on the controversial ordinance after it was rubbished by Rahul Gandhi,reports Chidanand Rajghatta.Stunned by the criticism just hours before he was to meet US President Barack Obama,the Prime Minister issued a statement from Washington,saying,The Ordinance cleared by the Cabinet pertaining to the Representation of the People Act has been a matter of much public debate.The Congress Vice-President has written to me on the issue and also made a statement, he said.The government is seized of all these developments.The issues raised will be considered on my return to India after due deliberations in the Cabinet. 
While one view of the statement was that Singh was asserting the primacy of the Cabinet (of which Gandhi is not a member) and its collective responsibility vis--vis the decision on the ordinance,others suggested that he was deferring to Rahul,on whom he is ready to confer the mantle of prime ministership.I would be happy to work for the Congress party under the leadership of Mr Rahul Gandhi, he had recently tweeted from the PMO Twitter account.

New Delhi: Congressmen widely viewed Rahul Gandhis public snub to the ordinance saving convicted MPs from disqualifi cation as the most definitive sign of an impending regime change in the party.
The young scions veto,terming the ordinance as nonsense,put the Union Cabinet headed by the prime minister in the dock.
That it was cleared barely three days ago and is on the Presidents table for assent only made it more diffi cult for its backers to swallow the insult.
Reading the developments,a senior leader said,Rahul has begun to assert himself.This act showed that he did not mind announcing to the public his differences with the way things are done. 
The bold act is widely seen as audacious for the risk of appearing to highlight differences within while also appearing to undermine the prime minister.But it shows that Rahul is willing to speak above all,and is a loud signal to the party that he is taking charge.
Since his elevation as Congress vice-president and heir imminent,Rahul has occupied himself with closed-door organizational meetings.
As he began to take active interest in party affairs,Rahul scrupulously avoided being seen as clashing with the government.When issues like inflation or corruption or foreign affairs or Naxalism or terrorism were lobbed at him,he merely deflected them to the government,lest he appeared to be undermining the PM.
But shedding his reluctance appears timely given UPA-2 is at its fag end and speculation is already rife about a generational change in the party.Rahuls decision to step out appears in sync with indications from Congress that it could declare its PM candidate before elections.
Not that Rahul has not weighed in with opinions on major issues,but the instances have been rare and within the closed confi nes of party fora.
His belligerence at the Congress Working Committee meeting over the 26/11 Mumbai attacks put paid to Shivraj Patils hopes of survival as home minister,his pro-nuclear deal stance removed the last bit of resistance in the party over taking on the Left.
His views on the visit of four senior ministers to Delhi airport to receive Baba Ramdev created a furore in the party.
Lately,a leader revealed,he forced the government to refer the bill to exempt political parties from the purview of RTI to a standing committee when there seemed to be political support to pass it in Parliament last month.
What came at the Press Club of India in the impromptu media conference has awakened Congressmen to a new leader taking charge of his fi ef.

இதுதொடர்பாக காங்கிரஸ் துணைத்தலைவர் ராகுல்காந்தி கடந்த 27-ந்தேதி டெல்லியில் நிருபர்களிடம் பேசினார். அப்போது அவர், “அவசர சட்டம் முட்டாள்தனமானது, அதை கிழித்து எறிய வேண்டும், இந்த விஷயத்தில் எங்கள் அரசு தவறு செய்துவிட்டது” என ஆவேசமாகவும், பகிரங்கமாகவும் கருத்து தெரிவித்தார்.

 

பிரதமர் தலைமையில் மந்திரிசபை கூடி எடுத்த முடிவை ராகுல்காந்தி கடுமையாக விமர்சித்தது, சர்ச்சையை ஏற்படுத்தியது. அதைத்தொடர்ந்து பிரதமர் மன்மோகன்சிங் அமெரிக்காவில் இருந்து திரும்பியதும், கடந்த 2-ந்தேதி காலை அவரை ராகுல் காந்தி சந்தித்துப்பேசினார்.

 

அப்போது அவசர சட்டம் தொடர்பாக தான் தெரிவித்த கருத்துக்கு விளக்கம் அளித்தார். அன்று மாலையே பிரதமர் மன்மோகன்சிங் தலைமையில் மத்திய மந்திரிசபை கூடி அவசர சட்டத்தை வாபஸ் பெற முடிவு எடுத்தது.

 

உணர்வுகள் தவறானவை அல்ல

 

இந்த நிலையில் குஜராத் மாநிலத்தில் சுற்றுப்பயணம் செய்த ராகுல் காந்தி ஆமதாபாத்தில் நேற்று நிருபர்களுக்கு பேட்டி அளித்தார். அப்போது அவர் கூறியதாவது:-

 

நான் பயன்படுத்திய வார்த்தைகள் தவறானவை என்று எனது தாயார் (சோனியா காந்தி) கூறினார்கள். நான் உபயோகித்த வார்த்தைகள் கடுமையாக இருந்திருக்கலாம். ஆனால் உணர்ச்சிவயப்பட்டு கூறிய கருத்துக்கள் தவறானவை அல்ல. நான் இளைஞன்.

 

எனக்கு உரிமை உண்டு

 

எனது கருத்தை தெரிவிக்க எனக்கு உரிமை உள்ளது. அவசர சட்டத்தை திரும்பப்பெறுவதுதான் காங்கிரசில் பெரும்பாலானவர்களின் விருப்பமாக அமைந்தது.

 

தவறான ஒன்றின் மீது எனது குரலை ஒலிக்கச்செய்ததற்காக நான் ஏன் தண்டிக்கப்படுகிறேன்? நான் தவறாக கூறினேனா?

 

நிலைகுலைய வைத்தது

 

எனது கருத்து எங்கள் கூட்டணி கட்சிகளுக்கு கெடுதலாக அமைந்து விட்டது. அந்த விவகாரத்தில் என் மனதில் தோன்றியதை கூறினேன். ஆனால் அதற்கு வரக்கூடிய விமர்சனங்கள் வியப்பு அளிப்பதாக அமைந்தது. என்னை நிலைகுலையவும் வைத்து விட்டது.

 

இவ்வாறு ராகுல்காந்தி கூறினார்.

 

முன்னதாக ஆமதாபாத்தில் உள்ள மகாத்மா காந்தியின் சபர்மதி ஆசிரமத்துக்கு ராகுல் காந்தி சென்றார். அங்கு மகாத்மா காந்திக்கு அஞ்சலி செலுத்திவிட்டு, அங்குள்ள அருங்காட்சியகத்தை பார்வையிட்டார்.

 

சுமார் அரை மணி நேரம் ராகுல் காந்தி அந்த ஆசிரமத்தில் கழித்தார்.

 

‘இந்த ஆசிரமத்துக்கு வருவது எனக்கு எப்போதும் பெருமையாக இருக்கிறது. நான் காந்தியையும் அவரது கொள்கைகளையும் பின்பற்றி நடப்பவன். நன்றி’ என்று ஆசிரமத்தில் உள்ள பார்வையாளர்கள் புத்தகத்தில் ராகுல் காந்தி எழுதினார்.

Not a problem if minorities do not repay government loans: KPCC chief

Bangalore: In a race to appease the minorities ahead of the 2014 Lok Sabha elections, Karnataka Pradesh Congress Committee (KPCC) President G Parameshwara urged the state body to provide Muslims with more loans. He also suggested that loans as much as 50 lakh must be provided to the minorities. "Give them big loans through the corporation or through the departments and let them start industry, what is wrong in that," he said during a Congress workshop for schemes on minorities. ALSO SEE Why is Karnataka Congress Chief embarrassing his own party government? He also went on to say that it was not a problem if the loans are not repaid as there were many others who had not done so as well.

"If they defraud its alright, there are many others who have defrauded on government loans unto thousands of crores. Let us also allow minorities to do that this is part of development process," he said.

The Samajwadi Party chief Mulayam Singh, today on National TV , has directly attacked Congress General Secretary Rahul Gandhi stating categorically that he is unfit to lead the country.  

"Rahul Gandhi lacks the ability to run the country. He has not been able to rise up to the challenge"
 
Sonia Gandhi has maneuvered her Man Friday Pranab Mukherjee onto the Presidents chair, replacing Puran Poli nay—Pratibha Patil.   She fervently hopes that Mukherjee will invite Rahul to be PM when the stage is set , despite his Italian birth certificate, against the Indian Constitution.

Sonia Gandhi went skippety skip to President Abdul Kalam to be PM.  Patriot Sushma Swaraj threatenened to shave off her head and enter Parliament to wake up sleeping India.  Immediately Sonia got cold feet and withdrew, hoppety hop. 

Dijvijaya Singh has been shouting from the roof tops that it is indeed time for Rahul Gandhi to take over as Prime Minister.  

And suddenly all joined the "animal farm" chorus – who wants to miss them cherries doled out to family loyalists by  Sonia Gandhi.

But alas, the million dollar question is – is Rahul Gandhi fit to be India’s PM.
 
Has he displayed  any responsibility till today?  Has he or his mother every shown a vestige of accountability when things go wrong?  

AK Antony , a Christian member of the inner coterie of Sonia,  fixed the blame for the pathetic performance of Congress in UP on everybody except Rahul baba.  A grateful Sonia rewarded Antony by making him No 2 , after PM,  hop-step-jumping the seniority queue .   
 
Mind you, just the previous year Rahul had gleefully, with dimpled and pink cheeks , taken a sham award from CNN IBN, from loyalists Rajdeep Sardesai and his wife  “cacafonika” nay- Sagarika Ghose for “single handedly” reviving the fortunes of Congress party in UP.

Rahul was quick to rush to Dadri Kond to claim credit for stopping a mining project.  Do leaders with spirit swallow credit and let someone else take the blame?
 
Has Rahul ever been open to a dialogue, or a debate or a press conference?  Can he answer a simple question  without being helped out .
 
Can Rahul ever sit through a Karan Thapar interview?

The Indian Express has done some detailed reporting on the educational qualification claimed by Rahul in his MP affidavits, as not matching their investigations in Cambridge, UK.  

Subramanian Swamy, the biggest thorn to the Nehru dynasty of late, has even gone on record stating that Rahul is“a super dumbo”.  Hey, how about a moonh todh rebuttal, Rahul?

Some objective facts –
Rahul presented zero private member’s Bills during the 14th Lok Sabha.  Rahul asked a grand total of three questions in five years. There were a total of 89,055 questions asked by all MPs combined.  Rahul Gandhi’s share was a mind boggling  0.003%--BRAVO!  He attended 63 per cent of the Lok Sabha assemblies.
 
Now about the 15th Lok Sabha--
Rahul Paaji’s  attendance in the current Lok Sabha is a whopping 42%. Compare this with the national MP attendance average of 77 %. Among 487 MPs for whom records are available, Rahul is among the bottom three % for attendance,  zero in private member’s Bill presentation, not one mangy question , when there have been 99,416 intelligent questions in total and among the bottom 10 per cent in debate participation.

Rahul running a fraud company: Subramanian Swamy

Janata Party chief Subramanian Swamy on Saturday accused Congress leader Rahul Gandhi of running a fraud company and of misusing government facilities.

While addressing a press conference in Ahmedabad, Swamy said that Gandhi had owned a company called Back-Ops Private Limited and had indulged in wrong doings to keep it afloat.

He claimed that the office of the company was registered at a government bungalow in New Delhi which had been registered in the names of Gandhi's sister Priyanka and her husband Robert Vadra.

As per the Janata Party chief, Rahul also gave out conflicting turnover statements of the company in the assets declaration form before the last general elections, which put a question mark on the credibility of the company.

Swamy claimed that the setting up of a private company in a government residence is illegal.

"Number one, he has earned foreign exchange, all the money that he has earned is through foreign exchange. No one is sure whether it is 41,00,000 rupees ($76,271.97) or 41,000 ($762.72) rupees. Secondly, they have shown their registered office as a government lodge. That is illegal," he said.

Swamy said that the company was closed down in a hurry after he had raised the issue in Parliament last year.

He said Rahul Gandhi had not mentioned the company in his asset's declaration before the general elections of 2004 and 2009, and he had nearly 82 percent shares in the company.

Swamy demanded that a probe should be initiated into the matter. He said he will write a letter to Corporate Affairs Minister Veerappa Moily about this issue.

"He has misused the privileges of a government residence. Secondly, he did not file the Registration Of Companies accounts. In 2011, they filed everything and also filed an application to close down the company, while making Priyanka the additional director. There are multiple frauds and we demand a probe into this. I am going to write a letter to Moily that this company is fraud. They should resign from Parliament as they have lied to it," he said.

Swamy said that Rahul Gandhi was managing the accounts of the company from a bank in Switzerland named Pictet Bank, but proper information about the nature of the account could not be retrieved due to the bank's privacy policies.

New Delhi: In yet another relief to BSP chief Mayawati,the income tax department has released 400 crore in fixed deposits belonging to her brother Anand Kumar and his group of companies,holding the money to be legitimate.
The department,which seized the deposits in June,held that the cash was kosher since Anand had paid tax on it.Investigations in the matter have been closed,potentially clearing the way for the former UP chief ministers sibling to invest in any venture of his choice.
Kumar,who runs around a dozen companies registered in Noida and Delhi,was reluctant to invest the pile,with the sole exception of trying to provide bank guarantees to the promoters of a luxury hotel in Kaushambi to purchase 60 acres of land in Ghaziabad an initiative that brought the taxmen to his door.
Coming soon after the CBIs decision to close its disproportionate assets case against Mayawati something widely seen through the prism of the rescue acts that the BSP performed for the UPA this decision of the income tax department spells the second big respite for the dalit czarina.

Ask JPC to rework its report,Raja tells Speaker

New Delhi: DMK leader A Raja has protested that his letter,which claimed Prime Minister Manmohan Singh was in the know about 2G policy decisions,was not incorporated in the joint parliamentary committees (JPC) report on the spectrum allocation scam.
l was best placed to explain policy and rationale of the government behind issuance of UAS licenses and grant of spectrum,as well as the sequence of events and the role of various individuals and institutions, Raja said in a letter to Lok Sabha Speaker Meira Kumar.
He demanded that Kumar direct JPC chair P C Chacko to resubmit the report after including his note on the 2G events.He had sent the note after being denied permission to appear as a witness.
The reference to individuals and institutions almost certainly deals with the PM and finance minister P Chidambaram who Raja,main accused in the 2G scam,has said were aware of details of 2G pricing and implementation.

Accusing Chacko of being partisan,Raja said despite his repeated requests and similar urgings of committee members,he was not called before the panel as a witness.
Denied permission to depose before the committee,the ex-minister said he had expected his note setting out his version of events and a response to charges levelled against him would be part of the report.JPC has chosen to hide behind falsehoods, said Raja,adding his note was also part of the dissent note submitted by on behalf of DMK by former minister T R Baalu.
The credibility of the JPC has been seriously undermined by Chacko,who excluded all inconvenient references from the report on 2G scam.
The report has been attacked by the opposition parties ranging from the BJP to the Left for being selective and air brushing the alleged culpability of the PMO.

It appears that Uttar Pradesh Congress committee has finally taken note of the thinning support in Rahul Gandhi‘s political rallies and is taking steps to correct it. To address this problem, AICC general secretary in-charge for the state, Madhusudan Mistry has called a review meeting of all the zones in Lucknow.The meeting, scheduled for November 9, will review party activities in the last one month, discuss the problems and plan strategy for all the eight zones in the state, The Indian Express reported. Rahul Gandhi’s rallies are not drawing enough crowds. PTI. The review meeting will be attended by zonal in-charges, co-ordinators and other senior party leaders, it added. Sources have also told The Indian Express that the party men in UP have advised Rahul Gandhi not to hold two rallies on the same day as it is difficult to mobilise enough crowds for two rallies. Rahul Gandhi had earlier held two rallies in Aligarh and Hamirpur on the same day. The poor show at these rallies has reportedly made him upset. This could be a move to salvage that situation, senior party leaders added.

After bringing the nation's attention to the massive 2G losses, the Comptroller & Auditor General (CAG) has blown the lids off what looks like a far worse financial mess created by the government. Over 6 times worse than the 2G fiasco, to be precise.

According to media sources, the nation's top auditing body said in its draft report that between 2004 and 2009 the government lost a whopping Rs.10.7 lakh crore by giving coal blocks to to commercial bodies without following the auction route.

In its draft report, CAG said 155 coal acreages were given to some 100 private firms apart from some PSUs for the 2004-2009 period.

Reacting to the unprecedented scale of the alleged losses, chief opposition party BJP has given a notice in Rajya Sabha to discuss the CAG report on the coal scam.

"Coal Ministry was under PM, this is the biggest scam ever. This govt has looted the country," said BJP spokesperson Prakash Javadekar in response to the 110-page-draft report.

Shailendar Kumar from the Samajwadi Party said, "We have asked for an adjournment motion on question hour to discuss this scam."

Meanwhile the earliest reaction from the government emerged from the Law Minister who refused to comment on allegations made by newspaper reports.

"You don't ask the Law Minister to comment on newspaper reports," Salman Khurshid said.

Taking note of the draft report of the CAG on allotment of coal blocks without auction, the BJP on Thursday demanded a CBI probe into the allotment of coal blocks and monitoring of the probe by a court.

"The coal allotment scam is a major scam. We demand a CBI probe and a court should monitor the probe. It is a government of scamsters (that is) involved in knee-deep corruption," BJP leader Prakash Javedkar told reporters outside Parliament.

"Why coal blocks were alloted without auction?" Javdekar asked.

According to the CAG draft report, the government extended undue benefits totalling a Rs. 10.67 lakh crore to commercial entities by giving them 155 coal acreages without auction between 2004 and 2009.

Referring to major scams, Javdekar said, "The CWG scam is (is to the tune) of Rs. 70,000 crore, 2G scam is Rs. 1.76 lakh crore. But, now the new coal scam is Rs.10.67 lakh crore. It is a government of scams... from airways to mining everywhere the government is involved in scams."

He said, "In 2006, the government introduced the Bill for auction of coal blocks...But the government did not pass the Bill till 2010. 17 billion tonnes of coal reserve in 73 blocks were distributed to private companies. It is a huge scam. There are many cases where people have sold the licences."

 GMR’s Big Steal: Rs 24,000 cr land for Rs 31 lakh

If the report of the Comptroller and Auditor General’s (CAG’s) on the Delhi airport privatisation is to be believed, GMR, which led the consortium that won the bid, has got away with murder.

At the very least, the CAG report exposes the sheer hollowness of the policy of roping in private parties to run gigantic infrastructure projects; at its worst, it is a disturbing indictment of crony capitalism with all its attendant risks of private loot at public expense.

Consider this one single stat: with a private equity investment of just Rs 1,813 crore, the Delhi International Airport Ltd (DIAL) raised more than six times as much in debt and fees to run an already running airport for 60 years (effective concession period: 58 years). In the process it gets to use land with a commercial value of at least Rs 24,000 crore – with the upper end potential earnings going up to Rs 1,63,557 crore, according to GMR’s own estimates.

In short, you need just Rs 1,813 crore of your own money to hop on to a gravy train that could be worth 90 times your investment over 58 years. If this does not stink of a cushy land scam, nothing does.

The math to arrive at this runs something like this. Of the total capital expenditure of Rs 12,502 crore, the promoters (GMR and its partner Fraport) put in equity of Rs 1,813 crore, with the Airports Authority of India (AAI, a 26 percent partner in DIAL) putting in Rs 637 core, for a total equity of Rs 2,450 crore. On this the company raises Rs 5,266 crore as debt, Rs 1,471 crore as security deposits, a measly Rs 50 crore from internal accruals, and Rs 3,415 crore by fleecing passengers through airport development fees (UDFs).

How did GMR bag a deal that was not there in the cabinet note?

AFP The question: why did the AAI need a private partner to do this kind of one-sided financial engineering where GMR’s own investment is almost laughable?

But this is only the broad picture in what looks like a scandal.

The real problem is in the deal that GMR originally won through competitive bidding and the final rights it got – a lot of sweeteners were added along the way. The winning bid was based on GMR’s offer of a revenue share of 45.99 percent of its gross revenues to AAI for 30 years, with a further concession period to be agreed subject to “the mutual agreement and negotiation of terms”. This was based on the NDA government’s cabinet note of September 2003.

But when the deal was finally signed in April 2006, the term “mutual agreement and negotiation of terms” was mysteriously dropped and GMR was given the unilateral right to extend its concession period by another 30 years – and on the same terms as in the first concession period. In other words, it got a deal for 60 years while bidding for 30. What a steal!

How did GMR bag a deal that was not there in the cabinet note?

Not only that. It may seem like a revenue share of 45.99 percent is a big deal for AAI and the government. But what appears is not the reality.

Apparently, according to CAG, the Operations Management and Development Agreement (OMDA) signed with GMR does not include several key revenue areas – like ground handling, cargo handling and parking fees – as aeronautical services within the meaning of the Airports Economic Regulatory Authority (AERA), the airport regulator set up after the OMDA was signed.

Since GMR’s tariffs are fixed by AERA on the basis of its revenues, the exclusion of these non-aeronautical services from the calculation of DIAL’s revenues meant only 30 percent of DIAL’s income was taken into account while fixing airport charges like landing fees, etc.

Again, this has all the marks of a crony deal.

Is it any surprise AERA was forced to raise airport fees by more than 300 percent – making landing in Delhi a costly affair for all airlines, Indian and foreign. Little wonder, airline companies are yelling murder and shifting hub operations to Dubai.

But there’s more…

The CAG also notes that when DIAL has practically been given a 60-year deal, it has also been given an effective licence to run a monopoly. It has first right of refusal on any airport within 150 km of Delhi. If any new airport comes up within this radius, DIAL can bid for it, and if its bid is only 10 percent below the best bid, it can match the bid and take the airport away.

What a sweetheart deal! Not only can the private operator DIAL ‘M’ for Money, it also can dial another ‘M’ for Monopoly for 30 years – and possibly more.

But it is the land deal that takes the cake.

When GMR signed the initial deal for 4,608.9 acres of Delhi airport land with AAI, it got this at just Rs 100 per year with development rights for 5 percent of the land.

Then it asked for an additional 190.19 acres from AAI, which it got for a meagre one-time fee of Rs 6.19 crore. Again, 5 percent of this land can be used for commercial development.

Add the two, and what GMR got was this: 4,608.9 acres at Rs 100 per annum, and another 190.19 acres at Rs 6.19 crore for 30 years.

Since 5 percent of the total 4,799 acres can be commercially exploited, CAG calculates that the government essentially allowed GMR to develop 239.95 acres of land (5 percent of the total) for a one-time payment of just Rs 31 lakh (5 percent of Rs 6.19 crore) and annual payment of Rs 100.

The Delhi airport deal is clearly a lot about land. Now why are we not surprised?

And the biggest surprise? The airport modernisation was initially to be funded only by equity and debt. But GMR managed to wangle a development fee payable by every passenger flying in and out of the airport. Far from just running an airport, GMR has quietly made itself a toll collector.

The civil aviation ministry’s rebuttals of the CAG report include the following: the tender was based on the highest revenue share offered, and this process was cleared by the Supreme Court. So the Rs 100 lease rent of land is not a valid charge, since 45.99 percent of gross revenues will also be earned by AAI.

According to the ministry, AAI could earn as much as Rs 3,00,000 crore over the concession period.

That, of course, remains to be seen. But as of now, assuming the CAG has got its other sums right, this looks like one hell of a dicey deal. Dicey for the taxpaying public, not GMR.

One wonders why AAI needed GMR to earn the money it could have earned anyway.

CAG smells Rs. 1.63-lakh cr scam in Delhi airport deal

 The Comptroller and Auditor General of India (CAG) hinted in its report on the Delhi airport modernisation project that the government had given out prime land that will fetch Rs. 1.63 lakh crore to its private sector partner, Dial.

The CAG report — accessed by HT but not yet tabled in Parliament — said the company had got 4,799.09 acres of land on a Rs. 100 annual lease rent for 60 years for an equity contribution of only Rs. 1,813 crore.

A Dial spokesperson, however, said, “We are not privy to the findings of the report and, therefore, not in a position to respond to it at present.”

 

 

What’s more, the operations, management and development deal signed by the Airports Authority of India permitted the company to utilise 5% of the land for commercial exploitation. Consultancy firm Merrill Lynch had worked out the valuation of the land at Rs. 100 crore an acre.

“Thus, the total current value of the land available to Dial… would amount to Rs. 24,000 crore.”

The CAG said, “The projected earning capacity of this land (239.95 acres) in terms of licence fee over the concession period of 58 years was indicated by Dial itself as Rs. 681.63 crore per acre in a letter to the joint secretary, aviation ministry.”http://www.hindustantimes.com/Images/Popup/2012/5/23_05_12-metro1.jpg

The auditor also pointed out that the government decision to offer a “post-contractual benefit” to the private partner, Delhi International Airport Ltd (Dial), of levying development fees forced passengers to cough up Rs. 3,415.35 crore towards the project cost.

The auditor said the original deal did not mention that part of the project cost would be raised through development fees. It said that if the joint venture was to have the permission to levy the fee, it should have been made known to all the other bidders too.

Delhi airport charges Rs. 1,300 and Rs. 200 per passenger for international and domestic travel, respectively. Besides, from May 15, Dial started charging a user development fee of Rs. 436-1,068 from international and Rs. 195-462 from domestic passengers.

The ministry of civil aviation, however, informed the auditor that “the decision to restructure and modernise Delhi airport was a policy decision of the cabinet. The terms and conditions as well as the modalities were finalised and approved by the empowered group of ministers.”
