The Army on Monday said it had instituted an inquiry into the press release issued by WAC HQ,which was derogatory against the state government and the CM of Himachal. New Delhi: The Central Bureau of Investigation,probing the Tatra scam spread across four countries including a tax haven,has approached Interpol to get details of companies related to Vectra chief Ravinder Rishi from these four countries.Agency sources said they had moved Interpol to avoid the delay of replies through Letter Rogatories (LRs).The agency has asked Interpol to provide details of at least five companies in these countries Czech Republic,Slovakia,UK and Liechtenstein. Meanwhile,agency sources said they also questioned former BEML director (finance) V Mohan in connection with the Tatra deal while present BEML chief V R S Natarajan will be questioned on Tuesday.Sources said Natarajan has confirmed that he will be joining questioning on Tuesday. The agency,through Interpol,is looking for shareholding pattern of these companies reportedly owned by Ravi Rishi apart from contracts signed by them with the Tatra AS (Czech) and Tatra Sipox (Slovakia).A senior officer said,There is a web of companies which were apparently used by Ravi Rishi to procure different parts of Tatra trucks and then supplied to Bharat Earth Movers Limited. The agency is probing why BEML decided to procure Tatra parts from Tatra Sipox (UK),which was a private company,from 1997 when it was doing so through Omnipol (a PSU in Czech Republic,which was providing Tatra parts since 1986).Also,as first reported by TOI,why the BEML officials signed the MoU with Tatra Sipox (UK) in a hurried manner on June 14,1997 in Bangalore,three days after they had ameeting with Tatra Sipox (UK) and its associate companies officials in Slovakia.Officials said that apart from taking help from Interpol,they will also send LRs to these four countries and seek documents.

New Delhi:With an eye on both China and Pakistan,the government on Tuesday approved aslew of measures to fast-track acquisition of weapons as well as boost infrastructure development along the borders for faster mobility of troops and equipment. The new steps significantly include seeking the Planning Commissions sanction for 14 strategic railway lines,mostly along the western and eastern fronts,for quick troop mobilization and logistics sustenance in times of conflict,sources said. An empowered committee has also been constituted under defence secretary Shashikant Sharma to examine the detailed project reports of the Armys proposed capability development plan on the Northern Borders worth Rs 26,155 crore that is slated for completion by 2020-21. There is already an ongoing Rs 9,243 crore project for infrastructure development in the Eastern Theatre by 2016-17.All this is critical since China can now move around 30 divisions (each with over 15,000 soldiers) to the borders within 30 days to outnumber Indian forces by at least 3:1 after undertaking massive infrastructure development all along the 4,057km Line of Actual Control.Beijing,in fact,has recently taken to holding regular air and land combat exercises in the high-altitude Qinghai-Tibet Plateau to flex its military might. The new fast-track measures came after defence minister A K Antony held an almost two-hour long meeting with General V K Singh and his top brass on Tuesday,a day ahead of the slated testing of Indias most ambitious strategic missile,the over 5,000km range Agni-V. This was the third review meeting to plug critical operational gaps in Indias military capabilities,highlighted by Gen Singh in his confidential letter to the PM on March 12,in the face of two inimical neighbours and the reality of large land borders.The meeting expressed satisfaction at the progress of procurement cases for the 4th regiment of the BrahMos supersonic cruise missiles at a cost of Rs 4,100 crore and two regiments of the Pinaka multi-barrel rocket launchers for Rs 2,136 crore. The new BrahMos regiment,with the missiles Block-III version that has steep dive capability to take out targets hidden behind a mountain range,will be deployed in Arunachal Pradesh,with the first three catering for the western front with Pakistan. The meeting also discussed the Armys proposed procurement of 145 M-777 ultra-light howitzers,which India is to buy from the US in a direct government-to- government deal worth $647 million.These airmobile artillery guns will be needed for the new mountain strike corps (70,000 soldiers) being planned after the raising of two new mountain infantry divisions,with 1,260 officers and 35,011 soldiers,in Assam and Nagaland.

Mumbai: The land on which Adarsh Cooperative Housing Society stands belongs to the state government,not the defence ministry,a two-member judicial commission said in its interim report on Tuesday. The commission comprising Justice (retd) J A Patil and former state chief secretary P Subrahmanyam ruled that the ministry of defence did not give any credible evidence to establish its ownership.It also ruled that neither the land nor membership to society was reserved for housing defence personnel or Kargil war heroes. It said the land was in the possession of local military authorities between 1996 and 2004 and the defence ministry couldnt prove possession prior to 1996.Contrary to the ministrys claim that the land existed since August 25,1821 and was in its possession for over 100 years,the panel said there was no evidence to show it was occupied before August 15,1967.The local army unit of Maharashtra,Gujarat and Goa is expected to file a land title suit soon,saying the Adarsh land has been in their possession for decades.The judicial commissions report is not the final say and can't conclusively prove title of the Adarsh land,either in favour of the state or the army, said advocate Aniket Nikam,counsel for the defence ministry. Even as government officers were patting themselves on the back,senior advocate Dipan Merchant,counsel for the commission,said,There is no question of a clean chit to anyone. The Congress-NCP government reportedly intends to move court against the necessity for a CBI probe but a CBI officer said,The commission was set up to find out the land ownership,which is not our mandate.Our mandate is to investigate whether there was criminal conspiracy in the way land was allotted to the Adarsh society.Our investigations will continue as per our mandate.

Mumbai:The local army unit of Maharashtra,Gujarat and Goa is expected to file a land title suit soon seeking a formalization of land records,saying the Adarsh land has been in their possession for decades.Senior army officers said the move is in lines with recommendations made by the then additional solicitor general Darius Khambatta. The judicial commissions report is not the final say and cannot provetitle of the Adarsh land,either in favour of the state or the army, said advocate Aniket Nikam,counsel for the Union ministry of defence (MoD).Ownership of a land can only be established in a court of law by filing a title suit in the civil court, said Nikam.

New Delhi: Chairman and managing director of Bharat Earth Movers Ltd (BEML),V RSNatarajan,was put through almost eight hours of grueling questioning by the Central Bureau of Investigation on Tuesday over the alleged Tatra procurement scam.The agency also questioned Ravi Rishi,owner of the Vectra group which supplies Tatra trucks,and V Mohan,a former director of BEML. CBI sources said they would be putting Natarajan,Rishi and Mohan for a round of joint questions on Wednesday.Sources said they are already in touch with Interpol for gathering details from four countries including tax haven Liechtenstein. Natarajan reached the CBI headquarters around 11.30 am where a group of officers questioned him for almost eight hours,asking him an array of questions regarding the entire Tatra acquisition process.Sources said the CBI asked him how supply contract with Tatra Sipox (UK) was renewed in 2003 much before it was required in 2006.On this,Natarajan told CBI that he did it mainly for indigenization of Tatra vehicles that would help BEML export the vehicles to other countries.

New Delhi: The Central Bureau of Investigation raided the residences of two retired Army officers in connection with the Tatra-Vectra deal while investigators are also pursuing leads pointing to a nexus between Vectra head Ravi Rishi and the top brass of Indian public sector firm BEML. The CBI on Wednesday carried out raids at the residences of Brigadier (retd) P C Das in Vasant Kunj and Colonel (retd) Anil Dutta in Noida.Das was also questioned at the CBI headquarters while the residence of Vectra executive Anil Mansaramani at Noida was also searched. CBI sources said they suspected Das and Dutta to have worked as conduits for Vectra head Rishi,a London-based businessman.The agency feels that the retired officers were liasioning for Vectra,which is a crucial link in supply of Tatra trucks to the Army.The deal is now under a graft cloud. The CBI hopes to make more progress when Army chief Gen V K Singh meets investigators after April 19 and his statement is recorded.He had set the cat among the pigeons by alleging that he was offered a.14 crore bribe for the underperforming vehicles. The agency questioned BEML chairman V R S Natarajan for almost six hours on Wednesday,and sources said the probe was at a delicate stage as definite leads had emerged regarding BEML and Rishi in the Tatra trucks procurement process. The CBI reportedly asked Natarajan if he had tried to verify,when BEML signed a contract with Tatra Sipox (UK),if any of the parts for making Tatra trucks were available with another company in India,sources said.He was also asked if BEML tried to find out the nature of Tatra Sipox (UK) contracts with other countries on supplies.

Coimbatore: A team of Central Bureau of Investigation (CBI) sleuths conducted a search on a city-based consultancy firm,Astral Consulting Limited,in connection with the probe against VRS Natarajan,chairman and managing director of Bharath Earth Movers Limited (BEML). The agency has filed a case naming Natarajan as the first accused and a director of the consultancy firm as the second accused for irregularities in hiring the services of the firm to provide enterprise resource planning (ERP) platform for BEML.They were booked under the relevant sections of the Prevention of Corruption Act 1988. However,the management of the firm claimed that they were not involved in any misappropriation and the allegations were baseless.We have offered our full cooperation to the investigation agency and have handed over the documents that they have demanded from us about our association with the BEML.We have not done anything illegal, said M Muthukumar,one of the directors of the firm. We received Rs 84 lakh from BEML for our services.We have documents to prove that everything was initiated and completed through proper channel, Muthukumar added. The ERP solution offered by the firm was used to streamline the entire procurement and other internal departments of BEML.The consultancy has CS Srivatsan as the chairman and three directors under him in charge of its operation and administration. Initial reports indicated that the search was being conducted in connection with the controversial Tatra truck deal in which the CBI has already questioned Natarajan.However,the CBI official said that the search was not related to the Tatra scam.

The intrigue and disinformation campaign against the Army Chief, General V.K. Singh, is discrediting the institution itself.

SO it now turns out, as many had suspected, that The Indian Express story alleging that there was unusual and un-notified movement on January 16 of two Army attack formations towards the national capital, which “spooked New Delhi”, was a complete fabrication. The barely hidden suggestion in the story was that the troop movement ominously took place the night before the Chief of the Army Staff General V.K. Singh moved the Supreme Court on the date of birth issue; it was a not-too-subtle way of the Army flexing its muscle against civilian authority.
The troop movement violated no protocol of standard operating procedure. Such movements need to be notified to the Defence Ministry only if they involve corps-level strength. The story appears to be wrong on other details too, and has been dismissed by Prime Minister Manmohan Singh, Defence Minister A.K. Antony, and General V.K. Singh.
However, the real question is who fed or planted the story, and with what motive. One may never know for certain the answer to the first question, but the plausible motive seems to have been to discredit Gen. V.K. Singh. One of his detractors, former Northern Army Commander Lt Gen. H.S. Panag, said that the troop movement was an attempt by a “compromised [military] hierarchy” to “pre-empt” a likely decision by the Defence Ministry to sack the COAS. Lt Gen. Panag was relieved of his command after an anti-corruption inquiry in 2008, and has since retired. But he is a member of the Armed Forces Tribunal. Thus, it was totally out of order for him to make these remarks. A similar story was planted earlier about Gen. V.K. Singh having ordered the clandestine interception of telephone conversations involving top Defence Ministry officials. This pointed to grave indiscipline. But the charge was never substantiated.
Even more important, the “controversy” about his year of birth (1951 or 1950) was raked up without any reference to the record pertinent to his promotion, first as Lt General and later as a full General. The sole basis for regarding the date as 1950, which would entail the end of his tenure this year, was another document concerning his application to the National Defence Academy. A confidential letter from the COAS to Manmohan Singh, pointing out serious deficiencies in the Army's war preparedness, was also mysteriously leaked.
Clearly, a great deal of intrigue and disinformation has been at play in an institution, which is supposed to follow exemplary standards of truthfulness, discipline and integrity. A possible clue to its source is provided in a writ petition moved before the Supreme Court by former Chief of the Naval Staff Admiral L. Ramdas, former Chief Election Commissioner N. Gopalaswami and three ex-generals, among others.
This reportedly alleges that a process or line of succession was launched by former COAS Gen. J.J. Singh by initiating something new called “the look-down policy”, which was calculated to favour certain officers and have them promoted above the rank of Brigadier. As a result, many likely contenders to Army commanders' positions were “eliminated” to ensure that Gen. V.K. Singh would remain COAS only until May 2012 and that Lt Gen. Bikram Singh, currently the Eastern Army Commander, would succeed him.
The petition also alleges that there was a “communal conspiracy” behind the rejection of Gen. V.K. Singh's claim for a revision in his date of birth, in particular, lobbying by Sikh organisations, and support from certain high government officials. Even if this allegation is discounted, the petition, which prima facie appears broadly truthful, raises disturbing questions about the process through which high-level Army promotions and seniority lists are determined.
On March 3, Lt Gen. Bikram Singh was designated as the next COAS – three months in advance, instead of the usual two months. But Lt Gen. Bikram Singh has two court cases pending against him: the first involving a fake “encounter” killing in Jammu and Kashmir in 2001, and the second concerning Indian troops' misconduct, including rape, during a United Nations peacekeeping mission in Congo under his charge in 2008. Surely, both propriety and convention demand that he should not have been designated the next COAS until he is cleared of these cases.
The Defence Ministry has also just cleared the names of Lt Gen. Dalbir Suhag, head of Dimapur-based 3 Corps, and Lt Gen. Sanjiv Chachra, Military Secretary, for promotion as army commanders. Lt Gen. Suhag was recently at the centre of a controversy triggered by the forwarding to the Central Bureau of Investigation (CBI) of a complaint about his role in the purchase of parachutes as the head of the Special Frontier Force.
The CBI refused to investigate the complaint, made by Trinamool Congress MP Ambica Banerjee, on the ground that Lt Gen. Suhag had been cleared by another government agency. As for Lt Gen. Chachra, his appointment as Military Secretary, in charge of transfers and postings, was reportedly opposed in the past by the Defence Ministry.
Evidently, there is very little coordination, accord or harmony between the armed forces and the civilian leadership, which is supposed to exercise supremacy over the armed forces in a democracy. Indeed, their relations are extremely strained, and marked by suspicion, distrust and a crisis of confidence. This does not generally bode well for the nation's defence.
Particularly worrisome is the recent trend of personnel of the armed forces pronouncing themselves on policy matters, or speaking at cross purposes with the government on issues such as a resolution of the Siachen glacier dispute with Pakistan, which has festered since 1984, and repealing or suspending the Armed Forces (Special Powers) Act (AFSPA) in Jammu and Kashmir. Siachen, the world's highest-altitude military conflict, has taken a huge toll on the Army, including the loss of an estimated 2,000 lives mainly thanks to frostbite, while driving thousands of soldiers into acute psychological disorders, and inflicting a daily expense of Rs.3 crore to Rs. 5 crore. India and Pakistan came close to resolving the dispute by agreeing to withdraw their troops from the glacier at least three times, in 1989, 2006 and 2011.
This was vetoed by the Army – although occupying the icy heights confers no obvious strategic advantage. In 2006, Gen. J.J. Singh publicly ruled out his Army's withdrawal until its positions on the glacier are marked and recorded. As former United States Ambassador David Mulford put it in a cable disclosed by WikiLeaks, “Army Chief J.J. Singh appears on the front page of the Indian Express seemingly fortnightly to tell readers the Army cannot support a withdrawal from Siachen. Given India's high degree of civilian control over the armed forces, it is improbable that Gen. Singh could repeatedly make such statements without MoD civilians giving at least tacit approval.”
In a democracy, it is illegitimate for the armed forces to defy civilian authority in this manner. Similarly, in the recent debate over the AFSPA, whose withdrawal is demanded by the Jammu and Kashmir government – not least because of a dramatic reduction in cross-border infiltration amidst declining militancy – several Army commanders lobbied against the move and even threatened to stop counter-insurgency operations if the “indispensable” Act is lifted. It is the same story in Manipur.
The AFSPA is a draconian law unworthy of a civilised society. It grants impunity to an officer who kills civilians on the mere suspicion that they may be about to commit a violent act or even violate prohibitory orders which are imposed at the drop of a hat. To top it all, the government is taking refuge behind the AFSPA in refusing to sanction the prosecution of military personnel found by the police to have committed murder, culpable homicide or rape.
In Jammu and Kashmir alone, the Home Ministry refused such sanction in 42 cases in recent months, provoking the Supreme Court to remark: “You go to a place in exercise of AFSPA, you commit rape, you commit murder, then where is the question of sanction?” Among the cases is the Pathribal killing of five innocent civilians in March 2000, on the palpably false ground that they were Lashkar-e-Taiba militants responsible for the massacre of 36 Sikhs at Chittisinghpura.
Army units have been recently implicated in a number of fake “encounters” such as the cold-blooded execution of villagers at Ganderbal in 2007, and at Macchel in 2010. Corruption scandals in the Army have involved numerous arms deals, from Bofors and HDW submarines in the 1980s to the more recent Tatra trucks case, and the Sukna land scam and the Adarsh Housing Society scandal. The biggest cases are related to India's growing participation in the super-corrupt global arms bazaar since the Kargil conflict (1999), which has made it the world's biggest arms importer in 2007-11. More corruption can be expected as India spends an estimated $80 billion on armaments acquisition over the next five years.
While there is no direct link between corruption and the armed forces' defiance of civilian authority or outright lawlessness and “encounter” killings, a culture of impunity is common to all. Despite his faults and mistakes, Gen. V.K. Singh deserves support for opposing this and fighting corruption.
New Delhi: Tatra Sipox (UK) Limited,supplier of Tatra trucks to the public sector BEML,is an agent of the manufacturer.This was admitted by Tatra Sipox on June 23,1995,to the UK authorities to which it described its main activity as being the manufacturers agents. The fresh evidence would indicate that the contract between BEML and Tatra Sipox was in clear violation of defence rules,which ban dealing with agents or middlemen. TOI has secured a copy of Tatra Sipoxs returns filed before the UK authorities where the company,responding to the query,give a brief description of principal activity,stated,manufacturers agents.This document is among many accessed by this newspaper which show that BEML violated the defence procurement stipulation that allows purchase contracts only with original equipment manufacturers (OEMs).
Trust based in European tax haven holds Tatra Sipox reins
New Delhi: Documents accessed from European authorities show that the company Tatra Sipox is fully owned by an investment firm that is controlled by a trust based in the European tax haven of Lichtenstein.Ravi Rishi,the NRI businessman who runs Tatra Sipox and a clutch of other companies in UK,Hong Kong,India and elsewhere,had been operating at least one more establishment in Liechtenstein since 1986.Coincidentally,the first contract for supply of Tatra trucks was signed by BEML in 1986. These findings raise questions about BEMLs deal with Tatra Sipox UK since 1997,prior to which BEMLs contract was with Czech company Omni Pol for 11 years.Although its widely known that agents and middlemen are banned in defence deals,the arrangement with Tatra Sipox passed muster with not just BEML,but also the defence ministry and the Army brass for several years before the current Army chief V K Singh blew the whistle. TOI sent a detailed questionnaire to Ravi Rishis PR agency in Delhi but no response was forthcoming.On Friday,the agency got back to say there would be no formal response to the questions.According to Tatra Sipoxs filings on January 20,2012 before the British authorities,it has issued a total of 15,000 ordinary shares.The entire lot was held by Vectra Ltd,another company of Rishis controlled by a trust in Lichtenstein.According to documents of Vectra filed with the British authorities,it has issued a total of 1,00,000 ordinary shares.

New Delhi:The CBI probe into the Tatra scam is examining a link between Madhya Pradesh IAS couple Arvind Joshi and Tinu Joshi,who are facing graft charges,and Londonbased businessman Ravi Rishi. The CBI is looking at Rishis Vectra Group acquiring maximum shares in Greater Noidas Indian Exposition Mart Limited (IEML) at the time when Tinu Joshi was posted as development commissioner,handicrafts,in the ministry of textiles. Sources said the agency is scrutinizing the bank accounts of the IAS couple,who were suspended by the MP government after the income tax department raided their house in February,2010.The CBI is examining transaction details of 70 bank accounts of the IAS couple and an official said,All entries in their accounts and related transaction details are being looked at.We may question the IAS couple in this regard. The agency is investigating Rishi,a majority stakeholder in Tatra Sipox (UK),for alleged irregularities in the purchase of more than 6,000 Tatra trucks after Army chief Gen V K Singh claimed that he was offered Rs 14 crore bribe on behalf of the businessman.The CBI is also taking assistance of the enforcement directorate and the I-T department. The CBI may also soon question Rishi again after having already sought assistance of the Interpol to get details about certain companies that are based in Slovakia,Czech Republic and the UK.

New Delhi: The Central Vigilance Commission (CVC) is likely to order a fresh probe into the dealings of Tatra Sipox (UK),suppliers of the controversial Tatra trucks,with the defence public sector unit BEML following the disclosure that the firm was a mere manufacturers agent. Under defence procurement procedures (DPP) and other government norms governing contracts,a PSU like BEML cannot deal with agents,and should have concluded the contract with only an original equipment manufacturer.TOI had on Saturday reported that Tatra Sipox had described themselves to British authorities as manufacturers agents. Government sources said the revelation raises questions if BEML violated norms about concluding government contracts,saying that the CVC may call for an inquiry into the matter.BEML may have a lot of explaining to do, said a source. A senior official in the defence ministry said BEMLs decision to sign a contract with Tatra Sipox (UK) in 1997 was purely the companys decision,and had no clearance from the the ministry.It was the PSUs decision,they have to explain, he said.The official,however,pointed out that prime facie BEML has committed serious violation of contractual norms.The official said BEML doesnt seem to have carried out a proper due diligence.Conversely,it is a willful violation, the official added. TOI had earlier reported that Tatra Sipox (UK) had,in its filings before the UK authorities in 1995,claimed that it was manufacturers agents.In 1995,Venus Projects (UK) Ltd,a Rishi-owned firm,had held 7,500 shares and an equal number was held by Jozef Majsky,Slovakian businessman.
New Delhi: Ahead of Mondays hearing in the Supreme Court on a PIL seeking stay of the Centres decision to appoint Lt Gen Bikram Singh as the next Chief of Army Staff (COAS),petitioners former Navy chief Admiral L Ramdas,ex-Chief Election Commissioner N Gopalaswamy and others have requested for an in-camera hearing. The petitioners counsel sent a letter to the registry requesting the court to consider conduct an in-camera hearing on the vital issues raised in the petition. The petitioners had shunned publicity to the PIL that was filed on April 4.Given the nature of allegations and personalities involved,the petitioner feel it would be in public interest to conduct an in-camera hearing before the court takes a prima facie view on the PIL. On Friday,the Union government had filed a caveat to pre-empt the petitioners from taking any ex-parte order on the PIL,which had alleged a communal conspiracy behind the rejection of Gen V K Singhs claim for revision of his date of birth and accused three former senior Army officials and others,including ex-Army chief J J Singh,presently the governor of Arunachal Pradesh,of masterminding the operation to clear the way for Lt Gen Bikram Singh to succeed Gen V K Singh. The petitioners said they were concerned by the brazen way Lt Gen Bikram Singh has been patronized and promoted to become the next COAS by superseding/sidelining several senior Army officials,who were perhaps more capable and eligible to become the COAS. They alleged that present Army chief Gen V K Singhs date of birth was crudely tampered with and manipulated to cut short his tenure as COAS,that was a mere issue of correction of date of birth but bl own out of proportion during Gen J J Singhs tenure as the Army chief.Lt Gen Bikram Singh,who is the Army chief-designate,would not have taken the top post if the incumbent's plea for revision of his age had been accepted. The PIL challenging Lt Gen Bikram Singh's appointment has said the Arunachal governor enjoyed blessings from the highest level,and that was why the conspiracy against Gen V K Singh succeeded even when he enjoyed the sympathies of defence minister A K Antony.
New Delhi: Army chief General V K Singh has told CBI officials that the day Lt Gen (Retd) Tejinder Singh came to visit him in his South Block office (September 22,2010) and offerred a bribe of Rs 14 crore,the file relating to purchase of Tatra trucks was lying on his table. Sources said the agency is probing the likelihood of some black sheep in Army headquarters or the Army chiefs office tipping off Lt Gen Tejinder Singh that the Tatra file was awaiting Gen Singhs clearance and whether that prompted the retired lieutenant general to pay the chief a visit. The CBI,which is likely to question Lt Gen Singh this week,is also pouring over his call records to ascertain if someone called him on that day to inform him about the Tatra file.Sources said the call records would also prove if Lt Gen Singh was in touch with Vectra chief Ravi Rishi either before or after his meeting with Army chief. Gen Singh has also told CBI officials that when he saw the number of trucks to be procured mentioned on the Tatra file,he called up all his commands to know about their requirement and the requirement of Army commands was way less than what was mentioned on the file.CBI sources believe a section in the Army Headquarters which was lobbying for Tatra trucks could have facilitated the files movement up to the chiefs office. After seeing such a large number of Tatra trucks mentioned in the file,the Army chief had cancelled the deal,sources said.CBI officials refused to give details of the requirement mentioned on the file.The number of trucks required mentioned on file were much higher than the actual requirement by all the commands of the Army, said a top source. These facts were given by Gen Singh to a CBI team on Friday when it recorded his statement.The agency has already found the record of Lt Gen Tejinder Singhs visit on that day from the visitors register.

Outdated and insufficient military hardware has become the Achilles’ heel of the Indian armed forces.
Flagging concerns over longstanding gaps in the country’s defence preparedness, a Parliamentary panel has asked the government to speed up the induction of fighter jets, trainer aircraft, artillery guns, tank ammunition and helicopters for the army’s aviation wing.
In a report tabled in Parliament Monday, the Standing Committee on Defence expressed shock over how deficiencies in critical capabilities were allowed to linger on, denting the military’s operational readiness.
The panel’s report comes a month after army chief General VK Singh flagged concerns about the weakening capabilities of his force to PM Manmohan Singh in a leaked letter. The chief had enumerated poor night fighting capabilities, shortage of tank ammunition, obsolete air defence systems and illequipped Special Forces as the main areas of worry.
The committee expressed concern over “the huge gap” between the required and existing combat squadrons of the IAF. “The gap would be to the extent of 11 squadrons (190 fighters) during the Twelfth Plan (2012-2017)…The country will reach the requisite level of 42 squadrons by the end of the Fourteenth Plan (2027),” the panel noted in its report, asking the government to fast track acquisitions.
The panel asked the government to make sure the IAF inducted the Swiss Pilatus PC7 Mark-ii planes by December 2013 “at any cost” to make up for the crippling shortage of trainer aircraft.
The report revealed that the problems of scarcity of tank ammunition were compounded due to the blacklisting of Israeli Military Industries.
Deploring the shortage of artillery guns — the army hasn’t inducted new guns after the Bofors scandal erupted in the late 1980s — the committee said the government should “at least now” take the “desired initiatives” to fill the gaps.

New Delhi: From sharply dwindling number of fighter squadrons and grossly inadequate trainer aircraft for rookie pilots in the IAF to critical shortages of helicopters and tank ammunition in the Army,a parliamentary panel has attacked the government for its lackadaisical attitude towards strengthening the countrys defence preparedness. The parliamentary standing committee on defence,however,agreed with the government in rejecting the media report that held the unusual movement of two army units towards New Delhi on January 16/17 had spooked Raisina Hill into thinking a coup could be in the offing.As stated by the defence secretary,the media report was based on wrong inferences,surmises and conjecturesits strongly dismissed, said the panel. Tabling its latest report in Parliament on Monday,the committee did not spare the government for huge delays in modernization of the armed forces that should be operationally ready to tackle any challenge,including the worst-case scenario of atwo-front war with China and Pakistan. The report largely endorses army chief General V K Singhs warning on the huge gaps in operational capabilities of the 1.13-million strong armyThe parliamentary committee said,India is surrounded by difficult neighbours and as such there is an urgent need to allocate adequate outlay to the armed forces,particularly for capital expenditure.Moreover,there are huge gaps between the required and existing force levels in armament,equipment,aircraft etc. While there is a shortage of 18 Cheetah,76 advanced light helicopters (ALHs) and 60 weapons systems integrated ALHs in the Army Aviation Corps,the armoured corps are grappling with critical shortages in tank ammunition.
Defence secy pleads helplessness at delays
The defence ministry expressed helplessness before the parliamentary standing committee on Indias long-winded arms procurement procedures,admitting there were delays at every stage on account of both military personnel as well as bureaucrats.I would say that though its an integrated procurement system,the delays are there and I cannot pinpoint exactly who is guilty or who is not guilty, defence secretary Shashikant Sharma told the committee.Delays creep in at the very first stage of issuing RFI (request for information) and formulation of GSQRs (general staff qualitative requirements) by the armed forces.TNN
Let Army decide how to try personnel in fake encounter cases: SC
NEW DELHI: Amid raging debate over alleged misuse of the Armed Forces Special Powers Act in insurgency-hit J&K and northeastern states, the Supreme Court on Tuesday ruled that army men accused of encounter killings cannot be prosecuted without the Centre’s sanction as they enjoyed immunity under AFSPA.
“In order that the public servant may not be unnecessarily harassed on a complaint of an unscrupulous person, it is obligatory on the part of the executive authority to protect him,” a bench of justice BS Chauhan and justice Swatanter Kumar said.
But, it said performance of public duty under colour of duty can’t be camouflaged to commit a crime.
The bench gave the ruling while deciding the fate of army men accused of killing seven persons in a fake encounter in Pathribal in Kashmir 12 years ago and another encounter in which five persons were killed in Assam’s Tinsukhia district in 1994.
The SC set an eight-week deadline for the army to decide if it would hold court martial inquiry against its officers allegedly involved in the two encounters or let the CBI prosecute them in a criminal court.
In case the army decided in favour of a CBI prosecution the agency would have to seek government sanction, it clarified.
In such a scenario, the application seeking sanction should be made within four weeks of receiving order from the army. On receiving CBI’S application, the Centre has to take a final decision within three months.
“If the law requires sanction, and the court proceeds against a public servant without sanction, the public servant has a right to raise the issue of jurisdiction as the entire action may be rendered void ab-initio for want of sanction,” it added. SRINAGAR: The Pathribal fake encounter case is inching towards justice, albeit slowly. This was the cautious reaction of the families of the men killed 12 years ago — allegedly by the army — to the SC direction on encounter killing cases.
“The truth is finally coming to the fore, but justice is not served till the culprits are handed exemplary punishment,” said Shakoor Ahmad, 38, son of victim Juma Khan. “The case needs to be tried in a criminal court.”
“Over the last one decade, we have suffered a lot. It was a wellplanned, cold-blooded murder of innocent civilians,” said Abdul Rasheed Khan, 34, son of namesake victim Juma Khan.
The CBI had also argued before the court that the killings “were cold-blooded murders”.
But on Tuesday, the SC said the army has to decide whether the officers will face criminal trial or be court-martialled.
“We hope the culprits will not be shielded any more. The killings were carried out for rewards by those supposed to be protectors,” said Ahmad.
The other five families have refused to talk to the media, expressing indifference to the court’s direction.
ARMYMEN MAY HAVE TO WAIT 5 YRS FOR PVT SECTOR JOBS
NEW DELHI: Senior retired military officers may no longer be able to land plum jobs in the private defence sector after a year of hanging their boots, if the government accepts a key recommendation made by a Parliamentary panel that wants the 'cooling off' period to be extended to five years.
A month after army chief General VK Singh alleged he was offered a R14-crore bribe by a retired lieutenant general to buy "substandard" trucks for the army in 2010, the Standing Committee on Defence said it was of the “strong view” that officers who retire as brigadier and above should be forbidden from joining the defence sector for five years.
"Urgent initiatives in this regard should be taken by the defence ministry," the committee said.
At present, officers are barred from taking up jobs in the defence sector for one year after their retirement. The government had earlier reduced the mandatory 'cooling off' period from two years to one year.
The panel noted that some retired defence officers act as middlemen to facilitate defence deals.
It hinted that extending the 'cooling off' period would make it difficult for defence companies to hire retired officials with connections to influence deals. The panel said the move would help in addressing the problems created by blacklisting of defence companies.
The defence ministry had in March blacklisted six vendors — including four foreign defence contractors — for their alleged involvement in the Ordnance Factory Board (OFB) scam in 2009. The army was banking on some of the blacklisted firms for artillery guns and tank ammunition. The panel said, “Blacklisting of companies results in blacklisting of rare technologies and solution in this regard needs to be found.”
NEW DELHI: The CBI plans to register an FIR in connection with the bribery allegation leveled by army chief General VK Singh against retired Lieutenant General Tejinder Singh. General VK Singh has claimed before CBI investigators that Lt Gen Tejinder Singh offered him bribe of R14 crore to clear a tranche of sub-standard Tatra heavy duty trucks for the army.
General Singh has also claimed that the retired officer offered him bribe on behalf of Vectra group owner Ravinder Rishi who is facing a separate CBI probe in connection with procurement of Tatra trucks by the army from 1997 onwards.
Lt Gen Tejinder Singh has all along maintained that he indeed met General VK Singh in September 2010 but the meeting was for a personal reason.
After the investigators demanded, General Singh has now provided record of the meeting and details irregularities in procurement of Tatra trucks by the army.

This is a perfectly legal structure of tax andsuccession planning in thedeveloped financial world,and is not seen as suspicious or secretive, he added. When asked if he had given the transaction detailsof bothhistrustsin thetax haven Hemang Foundation and Deswa Holding Establishment to the CBI,he said,Whatever information was required by the agency has been provided to them. New Delhi: The Central Bureau of Investigation is planning to meet defence minister A K Antony to seek clarifications from him on the Tatra scandal. According to CBI sources,they will seek an appointment with Antony to get his response on various aspects of the allegation by Army chief Gen V K Singh that he was offered a bribe of Rs 14 crore by Lt Gen (Retd) Tejinder Singh for clearing a batch of Tatra trucks. Among the issues that the agency would like to clarify with the defence minister is his meeting with Gen V K Singh in September 2010,during which the Army chief told him about the Rs 14 crore that was offered by Tejinder Singh allegedly on behalf of Ravi Rishi,the owner of Tatra Sipox (UK) which supplies Tatra trucks to BEML,which in turn provides it to the military.TNN
New Delhi: The Centre has asked its senior officers not to mingle with foreigners working with different embassies or high commissioners as some of them could be spies looking to cultivate sources within the government or push their agenda. After getting specific instances where government officers at different levels had been in touch with such foreigners for personal favours,including being nominated for courses abroad,Union home secretary R K Singh has recently written to all secretaries asking them to sensitize officers down to undersecretary level about the existing rules that strictly prohibit such liaisons. Singh said in his note: Specific instances have come to the notice of this ministry where officers have been in touch with/interacting with foreign service nationals (FSNs) and embassy officers/staffers of other countries in contravention of the laid down rules and circulars. Such circulars are regularly put out by the government,which has been bitten by many officials falling into intelligence booby traps.For instance,an official with the National Security Council secretariat S S Paul was put under surveillance after being compromised by a US embassy official Rosanna Minchew.

Ayear before the defence ministry asked the Central Bureau of Investigation to probe BEMLs role in the supply of Tatra trucks to the armed forces,it had directed the state-run company to acquire a strategic stake in the truck maker.According to BEML,about a year ago in 2010-11,a secretary in the defence ministry had advised the company to consider picking up stake in Tatra to have control over its technology and to maximise local production.The company had subsequently appointed Dun & Bradstreet to study Tatras operations in the Czech Republic and Slovakia. the management of BEML had appointed Dun & Bradstreet to study the Tatra company of both Czech and Slovakia and come out with a report,including possible valuation,to enable us decide on picking up a stake as directed by the government, said a company spokesman.An email to the defence ministry spokesman on the issue did not elicit any comment.If BEMLs account is correct,it would appear that the defence ministry was pursuing a stake purchase in Tatra even after Army Chief General VK Singh had complained to Defence Minister AK Antony in 2010,that he had been offered a bribe for clearing the supply of sub-standard trucks.Antony has publicly confirmed the Army chief had come to him with this charge in September 2010.But it is not clear whether General Singh had specifically mentioned Tatra or whether Antony had shared the contents of this conversation with the mandarins in his ministry.General Singh went public with his accusation in March.

Defence minister AK Antony has asked investigating agencies to probe charges levelled against aDelhi-based businessman Abhishek Verma,by his former partner,accusing him of acting as a middleman in several defence deals and parking over $205 million in accounts in a bank in the US.I have asked the CBI and the Enforcement Directorate (ED) to investigate the allegations.The defence secretary has also been asked to take necessary action, Antony said.These allegations have been made by C Edmond Allen,the head of a New Yorkbased company called Ganton Limited,in a series of letters to Antony.His charges cover purported dealings between Ganton,which Allen,a non-practising attorney,says was incorporated in the US state of Delaware on Vermas instructions,and major equipment suppliers to the Indian armed forces,such as Rheinmetall,AugustaWestland,Hellenic Defence Systems and Hawker Beechcraft.A top CBI official said the investigations were at a preliminary stage.We are in touch with Allen and have asked him to submit the documents in original, said the official.He also said the agency is coordinating with the ED as there were allegations of large-scale money laundering.Verma,the son of former Congress leader Shrikant Verma,is an accused in the naval war room leak case where several sensitive defence documents were stolen and allegedly leaked to Thales,the maker of Scorpene submarines.He has denied all charges levelled against him by Allen and said documents implicating him have been forged.Verma said he had received a notice from ED asking an explanation for the money in the accounts but was unable to comment since the matter is sub-judice.As several petitions filed by me against C Edmond Allen are pending in various Indian and foreign courts and these cases are somehow connected to the alleged foreign exchange violations in which trial is going on in India under the FERA Act for ten years,it will not be possible for me to comment as matters are sub judice, he wrote.According to Allen,the escrow accounts belong to Verma but he had the right to handle them as a result of agreements signed between the two in April 2000 and February 2004.Allen has alleged that the money in these accounts has been obtained through illegal means and that Verma has acted as a middleman in several defence deals.Verma,in turn,has issued legal notices to Allen to return the money and a case has been filed in a district court in New York according to documents reviewed by ET.

Verma,the son of former Congress treasurer Shrikant Verma and MP Veena Verma,has business links with Jagdish Tytler,a Congress Working Committee member and the party's Odisha incharge.Jagdish Tytlers fashion designer son Siddharth is a founder shareholder in a company along with a former director of Ganton,Arjun Arora.Siddharth Tytler had also signed a joint venture agreement with Ganton India.Confirming this,Jagdish Tytler also told ET that he knew Verma as his parents were colleagues of his.He denied any knowledge of defence deals that Verma is alleged to be involved in.Tytler also confirmed being an arbitrator for a dispute involving Ganton and another company over nearly hundred acres of land in Noida belonging to the Yamuna Express Industrial Development Authority.People close to Verma have alleged that the allegations levelled against him was at Tytlers behest,a charge that has been strongly denied by both Tytler and Allen.Allen,however,told ET in an email that Tytler and Verma were very close but had fallen out recently over the Noida land deal.Allen also emailed pictures of Tytler with Verma and said that Verma often boasts about how people like Tytler protect him.
CORRUPTION CHARGES
The letters to Antony paint a picture of labyrinthine corruption in defence deals with Verma allegedly at the centre.Some of the documents linked to the case were publicly released by India Against Corruption (IAC) in late April,a group linked to activist Anna Hazare after Allen sent the documents to lawyer Prashant Bhushan.In a report dated April 28,the New York Times quoted Allen as saying that he had approached (the lawyer) after India authorities showed no interest in his allegations.In a letter to Antony dated March 28,2012,Allen has alleged that the German firm Rheinmetall paid Ganton $5,30,000 to reverse its blacklisting by Indias defence ministry.The money was supposedly paid through the firms UBS account in Switzerland according to the bank statements of Ganton Limited and an invoice generated by the company.Emails sent by ET to Rheinmetall officials did not elicit a response.Allen has further said that Greeces Hellenic Defence System signed an agreement with Ganton to pay 10% commission on guns sold through PSU Bharat Electronics (BEL) to the Indian army.Ganton had also signed a confidentiality agreement with BEL for offset business from the programme of air defence gun systems bids in India.The agreement was signed by Anca Neacsu,Vermas associate and managing director of Ganton India and A Ramalingam,a BEL executive.Ramalingam confirmed signing the agreement but said BEL never pursued it and subsequently directly dealt with the foreign companies.Neacsu declined to comment on the story.Allen has also alleged that Ganton signed an agreement with Italian firm AgustaWestland by which it would receive a commission of 8% on sale of helicopters and 15% on the sale of spare parts to the Delhi police.The deal is now under scanner because of allegations of kickbacks being paid by the Italian firm.The agreement was signed on August 7 2009 between Allen as the president of Ganton and by Bruno Spagnolini the MD of Agusta.Emails sent to Spagnolini did not elicit a response.Allen confirmed signing the agreement and made available a copy to this newspaper.Hawker Beechcraft,a US firm also named by Allen,declined to comment on the companys dealings with Verma and why they were trying to enlist Vermas help in bagging contracts in India.The company also did not comment on whether it had paid any money to Verma for enlisting his help.Allen has alleged that money was routed through Ganton Limited for Verma Foundation,a so-called non-profit organisation controlled by Abhishek Verma and his mother.Verma has strongly denied allegations of wrong doing.In an emailed response to ET he claimed that a former deputy director of the ED had been running a campaign against him and that documents implicating him are forged.Running a damaging story based on forged documents planted by certain interested parties who are working hand-in-glove with the former deputy director will only result in civil litigation and criminal cases which I will have no other option but to file against any newspaper and irresponsible journalists who use these fabricated documents as an abettor and for libel, Verma wrote.Verma said he had suffered a heart attack and was recovering at the Escorts Hospital in New Delhi.He did not respond to specific allegations made by Allen on the ground that he was advised to avoid stress by his doctors.He emailed pictures of himself in the hospital to this newspaper.Allen,on his part,told this newspaper that he had also provided evidence of the charges to the FBI.E-mails to Jeremy Bell,an FBI agent mentioned in the court documents,remained unanswered.Allen claimed that Verma has furnished two agreements between the two as evidence in court. you may ask Mr Abhishek Verma after facing FERA charges in 1999 in which he claims to be innocent and not being allowed to travel overseas until 2003 by ED,where did these funds come from You must also ask ED and the IT authorities in India too about what they are doing as this is akin to confession of his crimes of money laundering and income tax evasion, said Allen.He declined to comment on the source of these funds.The source of funds is best known to Abhishek Verma but I would not like to hazard a guess on record since the case is sub-judice here, he wrote.
New Delhi: The Supreme Court on Thursday dismissed as withdrawn a writ petition by Lt Gen (Retd) Tejinder Singh seeking a CBI inquiry into Army chief Gen V K Singhs alleged role in the reported bugging of the defence ministers office despite the government denying any such incident. The reluctance of a bench of Justices P Sathasivam and J Chelameswar forced the retired Army officer to withdraw his plea. The petition was filed days after the Army chief accused Tejinder Singh of offering him a bribe of Rs 14 crore for purchase of Tatra trucks.Following the complaint by the Army chief,the CBI initiated a probe into the matter. Tejinder Singh had also accused the Army chief of professional misconduct by making political statements while holding the key post.He said the Army chief had stated that the Maoist problem in the country was the creation of the government when the Centre had sought the Armys help in Naxal affected areas. He has also filed a criminal defamation case against Gen V K Singh and four other senior Army officers in a trial court.
BEML under CAG fire for overstating Tatra profit
Defence PSU BEML on Thursday drew flak from the CAG for overstatement of revenue and profits from sale of Tatra trucks,which are in controversy after Army Chief Gen V K Singh's claimed that he was offered a bribe to clear the procurement of these vehicles. Overstatement of revenue due to incorrect recognition of sales in the accounts for the year ended 31 March 2010 was commented upon earlier by the Comptroller and Auditor General.The company continued the incorrect practice in the year 2010-11 also and recognised sales of Rs 246.52 crore in respect of 306 Tatra vehicles based on offer of vehicles for inspection.... New Delhi: Exorbitant prices to severe shortcomings in indigenization may not be limited to just Tatra vehicles supplied to the Army by Bharat Earth Movers Limited (BEML),according to Army sources and internal assessments. The supply of Armoured Recovery Vehicle (ARV) WZT-3 to the Indian Army by BEML suffers from similar issues including exorbitant prices for spare parts and lack of efforts to indigenize the vehicle.ARV WZT-3,supplied by Bumar of Poland,is based on a T-72 tank chassis and was introduced in service more than a decade ago. A detailed assessment shows that BEML has been charging the Army exorbitant rates for spare parts for the vehicle.The BEML offer is sometimes 20 to 30 times more than the estimated rates based on pervious receipts.For example,non-return valve,for which the estimated rate is Rs 1,608.81,was supplied by BEML at Rs 39,550 in 2008-09.The small bolts for track links,of which the estimated rate was Rs 424.70,was sold by BEML at Rs 15,480 in the same year.A mere nut in the set,estimated to cost Rs 192.08,was sold at Rs 5,505. BEML has also failed to indigenize the vehicle significantly,leading to almost complete dependence on the Polish supplier.BEML has exclusive rights to manufacture and sell the ARV and its spare parts in India under a transfer of technology agreement with Bumar. Army sources said the exorbitant rates for spare parts was going to cause serious problems in the coming days because the overhaul of these ARVs is nearing its due.As a result,the need for spare parts will shoot up.Source said BEML will not be able to meet the increased requirements because BEML has not set up any manufacturing facility so far,and most of the items demanded by us are imported by the DPSU (defence public sector unit), a source said. The induction of ARV WZT-3 was approved in July 2002.BEML signed the contract with the Indian Army on the lines of Tatra,and imported them from Bumar.Between 2000 and 2007,352 of these ARVs were inducted into the Army.
CBI seeks answers from Army chief
N early three weeks after recording his statement,the CBI has sought certain clarifications from Army chief Gen V K Singh on his allegation that Lt Gen (Retd) Tejinder Singh had offered him a bribe of Rs 14 crore to clear the purchase of a fresh batch of Tatra trucks.A CBI team visited the Army chiefs office on Thursday evening as the agency needed some clarifications,sources said.They added that the CBI also wanted clarity on the issue of delay on part of the Army chief in approaching the agency as the incident had taken place at least one-and-a-half years back.TNN

New Delhi:The Central Bureau of Investigation (CBI) has registered a case against defence ministry officials,including defence estates officer Ajay Chowdhary,in the Srinagar land scam in which no-objection certificates (NoCs) were issued to civilians granting them land. The agency on Friday conducted raids at several places in Delhi,Jammu,Srinagar,Patna and Ambala and recovered documents related to the land,which originally belonged to the MoD.The CBI alleged that around 12 acres of prime land near Srinagar airport was given to civilians on the issuance of NoCs. The officials named also include then SDO Vijay Kumar and others under the Prevention of Corruption Act and for criminal conspiracy.It is alleged that a huge area of MoD land near a sensitive zone in Srinagar was suspected to have been taken by civilians in connivance with officials of Jammu & Kashmirs revenue department and Directorate General of Defence Estates (DGDE),Srinagar.There was no provision to issue NoC by the office of DGDE for the purpose of sale/purchase of defence owned or occupied land, said CBI. The agency had registered a preliminary enquiry into the matter last year during which it claimed to have found evidence that NoCs were granted to civilians for this prime and strategic piece of land arbitrarily.The agency had also conducted enquiry into the records of the DGDEs and the local revenue,following arequest from MoD to probe the sanction of NoC for sale of this land in Kashmir Valley. Defence minister A K Antony had last year informed Parliament that on receipt of complaint,a PE found that more than 70 NoCs were issued by the department in Srinagar over last four years.
New Delhi: The government on Sunday denied that the ongoing Intelligence Bureau probe into the leaking of Army chief General V K Singhs confidential letter to the Prime Minister had nailed a joint-secretary rank officer in the cabinet secretariat as the culprit behind making the top-secret communication public. This came after a news agency report said that the cabinet secretariat officer,a woman from the Indian Economic Service who was handling the charge of intelligence agencies,had been repatriated to her parent cadre after being found guilty of leaking the classified letter addressed to PM Manmohan Singh in March. Cabinet secretary Ajit Seth on Sunday came out to dub as wrong the agency report.The government also issued a statement that there was no truth in the completely baseless report. But this does not detract from the fact that the leak of the letter,which had highlighted critical hollowness in the Armys operational capabilities,was seen as part of the ongoing tussle between Gen Singh and the politico-bureaucratic combine,which began with a bitter row over the Army chiefs age last year.With fingers initially being pointed to the Army chief and his lobby for being behind the conspiracy to leak the letter,Gen Singh had forcefully held that the incident should be treated as high treason and the source of leakage should be dealt with ruthlessly. He had alleged that vested interests were trying to drive a wedge between him and the government. The surfacing of the letter in the public domain had rocked both Houses of Parliament,with certain parties even demanding action against Gen Singh.Calling it an anti-national act,defence minister A K Antony had said that publishing the contents of secret communications within the government cannot serve our national security. In the letter written on March 12,Gen Singh had painted a grim picture of the operational capabilities of his 1.13-million strong force,holding that it was grappling with tanks running out of ammunition,obsolete air defence systems and lack of adequate weaponry for infantry and special forces battalions.

Chennai: The final trial of the upgraded Arjun Mark II Main Battle Tank (MBT) is expected to be held at Pokhran in Rajasthan on June 10.A team of more than 300 officials,including scientists of the Combat Vehicles Research and Development Establishment (CVR&DE) in Avadi,is giving finishing touches,including testing of remote control weapon system,to the Mark II which will leave for the desert destination in Rajasthan this week. The CVR&DE,one of the 52 research units of DRDO,is in charge of design and development of Arjun Mark I and II.We are completely satisfied with Arjun Mark II that cost Rs 34 crore.It will not only be more lethal than the earlier version but also more than 50% of its inputs are indigenous, CVR&DE director and senior scientist P Sivakumar told TOI. The Mark II,fitted with a German-made 1,500hp engine,has all 89 improvements sought by the army,officials said.Nineteen of these are new and include a missile-firing system,track width mine plough that helps detect and destroy mines,10-round bin containerised bin (CABIS) and explosive reactive armour (ERA) panels.The Mark II weighs 65kg three kg heavier than the earlier version.It can travel at a top speed of 58.5kmph and has an advanced land navigation system (similar to GPS), said a CVR&DE scientist. I demand a Commission of Inquiry under a sitting Judge of the Supreme Court to go into two connected questions of national security: – first, the bogus and planted Indian Express story about the attempted coup by alleged illegal movement of armoured vehicles near Delhi, and second,the leak of the letter written to the Prime Minister by the Commander in Chief of the Indian Army, Gen V.K. Singh, pointing out the shortages in the Indian army which makes India’s preparedness less than complete. The letter leak was, according to a respected newswire service,the PTI,an official of the Cabinet Secretariat belonging to the Indian Economic Service had leaked the said letter.
The fact of the matter is that such news leaks and publications cannot be effected unless there is a high level patronage promising a cover up, if and when necessary. In the case of letter leak question, it is well known that the present RAW Chief and the Principal Secretary to the Prime Minister are part of the personal entourage of Ms. Sonia Gandhi and have frequently performed personal tasks and chores for her abroad. It is also well known that a clique of the Indian army with full backing of Sonia Gandhi had targeted one of India’s most honest Army Chief viz., Gen V.K. Singh, and hence it is time to get to the bottom of this campaign of calumny, to demoralize the Indian army to the extent that they surrender to the corrupt.
Hence an Inquiry conducted by an impeccable authority, which today would be a Judge of the Supreme Court, is absolutely necessary to restore credibility and integrity to our democratic system.
Discipline primary obligation of armed forces,says SC

New Delhi: A day after the May 10 incident at Nyoma in Jammu and Kashmir where Army soldiers allegedly assaulted officers,the Supreme Court ironically ruled that primary obligation of a member of armed forces is to maintain discipline in all aspects. This apex court judgment drew curtains over a litigation initiated 22 years ago by a major,who in 1991 had moved the Delhi high court challenging the July 20,1990 decision of the Army to cashier him from service and also award him imprisonment of six months for three counts of corruption. The three incidents of corruption alleged against the major happened in 1988 and the general court martial found him guilty on all three counts on June 4,1990 and punished him with cashiering and an imprisonment of five years.A month-and-a-half later,the confirming authority upheld the majors cashiering but reduced the sentence to six months. The Delhi HC,in its judgment of July 23,1991,declined to interfere with the Armys decision.But the case remained pending in the Supreme Court for 21 years before a bench of Justices P Sathasivam and Dipak Misra drew curtains over the two-decade-long litigation by dismissing the cashiered majors appeal. Writing the judgment for the bench,Justice Misra said with the corruption charges proved against the major,it is well nigh impossible to hold that the punishment was harsh or arbitrary. When an Army officer gets cashiered,he or she is stripped of rank,privilege and responsibility,often in a very public and humiliating way. The appellant was a major in the Army and all the charges leveled against him fundamentally pertain to commission of illegal acts in fiscal sphere.The acts done by him were intended to gain pecuniary advantage.The primary obligation of a member of armed forces is to maintain discipline in all aspects, the bench said. Discipline in fiscal matters has to be given top priority as that mirrors the image of any institution.That apart,the appellant was a major in the Army.Irreproachable conduct,restrained attitude,understanding of responsibility and adherence to discipline were expected of him.The proven charges luminously project that the said aspects have been given a total go by, the court said.
New Delhi: A parliamentary panel has slammed the defence ministry for its discriminatory and negative policies on granting permanent commission (PC) to women military officers as well as inducting them in greater numbers in the armed forces. We fail to understand the negativism when it comes to employing more women in our countrys armed forces, the committee on empowerment of women said in its latest report tabled in Parliament on Friday.Women constitute just 2.84% of the officers in Navy,3.01% in Army and 8.55% in IAF,excluding the medical streams,despite being allowed into the armed forces since the early-1990 s. Moreover,women can get PC only in the legal,education and naval constructor wings,while they can serve for a maximum of 14 years in arms like engineering,ordnance,intelligence,signals,air traffic control and the like.They are also not allowed to serve in combat arms like infantry,artillery or armoured corps,nor serve on board operational warships or fly fighter jets. The defence establishment has long contended that granting PC to women officers across the board is not feasible due to operational,practical and cultural problems''.The legal and education wings,incidentally,ions.The parliamentary committee,on its part,accused the defence ministry of turning a blind eye to its earlier recommendations on inducting more women and granting them PC. New Delhi: The Navy has run up a tab of Rs 23 crore for a days extravaganza for the President.This included a bill of Rs 12 lakh for drinking water and Rs 17 lakh for the presidential banquet,besides spending Rs 14 lakh on alteration of a cattle fence. The Presidents Fleet Review of the Navy,in which the supreme commander of the armed forces inspects the maritime prowess of the force,took place in 2011 and is held once in the Presidents tenure. Data accessed under RTI from the Western Naval Command headquarters said Rs 23.24 crore was spent on the event attended by Pratibha Patil.The information was provided on an application filed by activist S C Agrawal. The Navy spent Rs 26.96 lakh to acquire new furniture which included 30 dining tables and 60 dining chairs,besides furniture for VIPs and other staff.It spent Rs 17.57 lakh on the presidential banquet for 960 guests and Rs 2.11 lakh on catering on the presidential yacht for 760 invitees. Interestingly,the authorities had budgeted Rs 12 lakh for water (amounting to 83 one-litre bottles of mineral water for each guest) and Rs 28.14 lakh for fresh provisions. Wages and salaries came to Rs 1 crore while some of the long-term infrastructure changes that were made included alterations to cattle fence at Vijaya garden that cost Rs 14 lakh.Repairs to the staircase from the main foyer to the officers mess also ran up a bill of Rs 14 lakh and a fountain built outside Mulla auditorium cost Rs 6 lakh.

New Delhi: General V K Singh may be all set to retire on May 31 after losing a debilitating battle with the government but he still has a missile or two to unleash.The outgoing Army chief has now issued a showcause notice to a lieutenant general tipped to take over the reins of the force when the current chief designate Lt-Gen Bikram Singh retires in 2014. The showcause notice issued to Lt-Gen Dalbir Singh Suhag,commanding the Dimapur-based 3 Corps at present,accuses him of lapses in command in handling a botched-up intelligence operation in the Jorhat district of Assam last December. This move by Gen V K Singh,known to be strongly against the Bikram-Suhag line of succession in the Army,has delayed clearing of Lt-Gen Suhags name for promotion to the Army commander-rank (senior Lt-Gens who command one of the six regional commands or the training command ) by the Appointments Committee of the Cabinet. Both the defence ministry and Army HQ were tightlipped about the showcause notice,which yet again brings to the fore the raging factional feud within the Army.It had first manifested when Gen Singh pushed for a 10-month extension in office,claiming he was born in May 1951 and not May 1950,that would have ruled out current Eastern Army commander Lt-Gen Bikram Singh from becoming the Army chief. After failing to spoil Lt-Gen Bikram Singhs chances,Gen VK Singh in March forwarded a complaint,based on a letter written by Trinamool Congress MP Ambika Banerjee in May 2011,against Lt-Gen Suhag to the CBI.But Lt-Gen Suhag got a clean chit in the affair,with the defence ministry recommending his name for the Army commander rank. The fresh showcause notice charges Lt-Gen Suhag with abdicating responsibility in handling an intelligence and surveillance unit in a most unprofessional and lackadaisical manner.Gen V K Singh,in the notice,says it appears to him that a censure from the Army chief himself is required. Reply to this showcause notice is requested within seven days of its receipt,failing which it would be assumed that you have no grounds to urge against the proposed action and an ex-parte decision may be taken, says the notice.
Army major killed in copter crash
New Delhi:An Army pilot was killed and another injured when their Cheetah helicopter crashed near the Bhim post,at an altitude of around 6,000 metres,in the Siachen Glacier-Saltoro Ridge region on Wednesday morning.Major Chandrashekhar Singh and his co-pilot,Major Amit Mahendroo,had just taken off from the Bhim post on the northern glacier at around 11.15am when their Cheetah crashed barely 400 metres from the helipad.Major Singh died on the spot while Major Mahendroo was subsequently evacuated to Leh and then to Chandigarh with head injuries, said an official.TNN
Mumbai: The defence ministry sent a notice on Monday to the Maharashtra government for filing a suit to claim title of the controversial Adarsh plot in Mumbai. The notice is to call upon the government of Maharashtra and the Adarsh Society to reconsider their legal position in respect of the property and acknowledge the title of my client,the Union of India (through the MoD),to the property and intimate the same to me or to my client within two months from the receipt of this notice, the ministrys advocate Dhiren Shah said. If the government does not acknowledge the ministry as title holder and hands over possession,the ministry will file a suit against the state and Adarsh. Earlier,a two-member judicial panel had held in favour of the Adarsh society and the state over the ownerhip of the plot in south Mumbai. Meanwhile,the CBI on Monday told a special court that it might add stringent sections of the IPC which could attract life imprisonment for the accused.The ministry,served the notice as part of legal requirement before approaching the judiciary. The defence ministry alleged that the commissions findings are contrary to facts.According to the ministry,the 3,824 sq m land in Block VI of Colaba division adjacent to Colaba bus depot where the 31-storey Adarsh building stands is theirs.

New Delhi: Two days before Lt Gen Bikram Singh takes over as Army chief,former Navy chief L Ramdas and others on Tuesday moved the Supreme Court seeking review of its order dismissing their PIL,which had challenged the Centres decision to name him as Gen V K Singhs successor. On April 23,a bench of Justices R M Lodha and H L Gokhale had perused Lt Gen Bikram Singhs file cleared by the Appointments Committee of the Cabinet (ACC) and said his appointment as the next Army chief suffered no discrepancy. When attorney general G E Vahanvati and solicitor general R F Nariman repeatedly argued that it was a petition aimed at reopening the date of birth issue pertaining to Gen V K Singh,the bench had said,There is no question of indirectly reopening the Army chief's date of birth issue which has attained finality.Directly or indirectly,the matter relating to the DoB of the Army chief cannot be reopened. But the review petition filed by Ramdas,former chief election commissioner N Gopalaswami and others put up a strong ground by making a startling allegation that the government had doctored the ACC file before showing it to the court to convince it on the decision favouring Lt Gen Bikram Singh. Their counsel Kamini Jaiswal said though the government had told the court that the allegations against Lt Gen Singh relating to the misconduct of the Indian contingent in Congo under a UN mission and the alleged fake encounter in J&K in 2001 were considered by the ACC,it actually could not have been. For,the ACC file clearing Lt Gen Singhs appointment as the next Chief of Army Staff was dated March 3 while the Congo incident was officially recorded in the file on April 13 and the counter affidavit absolving Lt Gen Singh was filed before the J&K High Court on March 23,she said. That is why the ACC file shown to apex court contained a page 15A,which was not in existence when the ACC headed by the prime minister considered appointment of Lt Gen Bikram Singh as the next Army chief.The normal numbering of a file is 14,15 and 16.So,how does page 15A come into the file, the petitioners asked. But it can hardly come in the way of Lt Gen Singh taking over as Army chief on May 31 as the review petition will be considered by the same bench in the chamber,that too without the presence of advocates or law officers,when it is first taken up for judicial scrutiny. If the bench gets convinced by the arguments,it will then direct listing of the matter in open court for hearing.And all this could happen only after July 2 when the court reassembles after summer recess.

Bangalore/New Delhi:A day after General V K Singh stepped down as Army chief,Bangalore-based defence public sector unit BEML served a legal notice on him asking him to apologize for alleged defamatory statements against the company and its products.An unperturbed Gen Singh refused to back down,and dismissed any possibility of him apologizing for his remarks about Tatra and Armoured Recovery Vehicles supplied by BEML. BEML said Gen Singh had made false and motivated allegations against the company.Legal notice has been issued today.If he does not apologize,we may file a defamation suit against Gen V K Singh, BEML chairman and managing director V R S Natarajan told reporters in Bangalore. The former Army chief has made some allegations against BEML.As the CEO of the company,I deny them as absolutely false,motivated,damaging and defamatory, Natarajan said.He said the delay in issuing a legal notice was because of the consultations with the legal team. There was also no indication that BEMLs action was orchestrated from New Delhi by the government,which had several tough moments during the tenure of Gen Singh as the Army chief. Gen Singh had alleged in March that he was offered Rs 14 crore in bribe to clear the purchase of 600 Tatra trucks from BEML.He had said that the bribe was offered by Lt Gen (retd) Tejinder Singh on behalf of Ravi Rishi,whose Tatra Sipox UK supplies the trucks to BEML,which in turn sells it to the Army.Based on Gen Singhs statements,the CBI has filed a preliminary enquiry against Lt Gen Tejinder Singh,Ravi Rishi and others. Gen Singh also repeatedly spoke in public about the quality of Tatra trucks and ARVs supplied by BEML.However,the BEML leadership argued that it had not received a single letter from the Army talking about the standard of Tatra trucks. Maintaining his strident stand on the issue,Gen Singh on Friday said he would not apologize to BEML.Apology for what,I would like to ask Natarajan that.I have not alleged anything,I have just stated some facts, Gen Singh said.Natarajan has been there for more than 12 years with BEML.He should be knowing how things are run in BEML, he added. Gen Singh said the issue was with the CBI,and the truth in the matter would emerge.

New Delhi: Their monopoly over purchases by Indian Army over a quarter of a century may force the government into approving purchase of over 100 Tatra vehicles at an earlier negotiated price,despite controversy surrounding these imported trucks and a CBI investigation into allegations of corruption against Tatra,its exorbitant price and concerns about quality. Interestingly,purchase of these trucks as part of the Pinaka multi barrel rocket launchers was recommended by the Army headquarters under Gen VK Singh,whose allegations of bribery against Tatra,and his concerns about the quality and pricing of these all terrain trucks have resulted in the CBI probe Dependable sources said the Ministry of Defence,based on Army recommendation,has finalised a proposal for purchase of two regiments of Pinaka rocket launchers worth over Rs 1500 crores.The MOD is believed to have forwarded the proposal to the Cabinet Committee on Security for final approval.Three companies are involved in the manufacture of the Pinaka system-Larson and Toubro,Tata Power Strategic Electronics Division and BEML. Each Pinaka regiment would include 20 launchers and eight command posts mounted on Tatra vehicles,as well as other Tatra vehicles for loading,replenishment,maintenance etc.A total of 52 vehicles are required for a regiment,and so for two regiments the requirement comes to 104 vehicles. In fact,DRDO (Defence Research and Development Organisation )s design for Pinakas itself based on Tatra vehicles,leaving the Army and the defence ministry with no option but to stick to the vehicles dubbed sub-standard by the ex-Army chief. The order was approved and recommended by the Army headquarters when Gen VK Singh was the chief, an MOD source told TOI.When asked if they are relooking at the price of Tatra or a different proposal to avoid Tatra controversy,he said,The Army has approved it and the prices are already negotiated. An Army source said there was no alternative for now given the fact that the entire system has been developed on Tatra vehicles.After the first two regiments were ordered in 2006,we have delayed the induction programme so much.It wouldnt be prudent to delay it any further, he said. When L& T and Tata Power SED were first roped in to make Pinaka launchers in 2006,the two companies first went into the open market looking to buy Tatra trucks from open market.To their shock,they discovered that the vehicles could be had for a price almost half of what the BEML charges the defence ministry. The MOD then forced the two private companies to abandon their plans to acquire Tatra trucks from the open market,and instead offered them as Free Issue Material (FIM).

New Delhi: Dispute over a land bank of over 100 hectares bought by controversial businessman Abhishek Verma and his associates along the Yamuna Expressway may have been a trigger,leading US attorney C Edmonds Allen bringing Vermas deals to the notice of Indian investigators.According to sources,the land bank was bought by Verma,Allen and other associates a few years ago. Vermas wife Ancia Neascu,Allen and others were involved in the deal.Later,differences arose among the partners about what to do with the land,the price of which had shot up after the expressway development took off. While Verma wanted to develop a township there,Allen and others probably wanted to dispose of the land.The CBI was looking at several such deals as also companies of Verma and his wife Neascu,who have been booked for receiving $530,000 from Rheinmetall Air Defence (RAD) AG to get it removed from the blacklist of the defence ministry. A city court on Saturday remanded both Verma and his newly wed Romanian wife to seven days CBI custody,a day after both were arrested. In the latest CBI case against him,Verma has been accused of receiving payments from RAD for using his influence to stall the blacklisting proceedings initiated by the government against it after the Ordnance Factory Board (OFB) scam surfaced. RAD was among the six defence firms that were suspected of bribing former OFB chairman Sudipto Ghosh,and are now blacklisted. The CBI produced the couple before the special CBI court and sought their custody for 12 days saying that the investigation in the case is going on and they need to unearth the entire conspiracy. The court directed the CBI to get the accused medically examined in a government hospital on Saturday and after every 48 hours while they are in the agencys custody.

New Delhi: In tune with a growing strategic partnership with South Korea,India is now getting all set to ink a major defence contract with the north-east Asian country for acquisition of eight advanced minesweeping and hunting warships.Under the programme,which will be worth well over 6,000 crore,India will get two of the mine counter-measures vessels (MCMVs) directly from South Korean firm Kangnam Corporation,while the other six will be manufactured by Goa Shipyard after transfer of technology.The contract is now being finalized after the conclusion of the commercial negotiations, said a source. Indias need for advanced MCMVs that combine the role of traditional minesweepers and active mine-hunters to detect and destroy underwater mines is critical.The Mumbai harbour,for instance,is now left with only one such vessel after the Pondicherry-class INS Ratnagiri was decommissioned last month.Despite intelligence inputs holding that Indian harbours face threat,the Navys MCMV project has been hanging fire for several years now.
New Delhi: Even as the CBI probes the role of NRI businessman Ravi Rishi in alleged irregularities in the supply of Tatra trucks to the army,his connection to a self-propelled wheeled gun deal has also come to light. Government sources said that the Rishi-owned Tatra Sipox,UK,had acted as a business associate of a Slovakian firm,DMD Group,which was eyeing a Rs 2,000-crore deal of wheeled guns,called Zuzana,for the army.The firm had signed an MoU with defence PSU BEML in 2007,in which Tatra Sipox,UK,has been mentioned as a business associate of the Slovakian firm. TOI has accessed a copy of the MoU that was signed by V R S Natrajan,CMD of BEML,and Jozef Mihok,chairman of the DMD Group,for the 155mm Zuzana. Government sources said the gun deal is in limbo,but Rishis links to the Slovakian firm has not come as a big surprise for the CBI.Rishis company has tie-ups with other companies,but the CBI case is focusing on the Tatra deal, said a senior CBI official. In the MoU,the DMD Group has stated that the guns chassis would be produced in Slovakia and would be supplied by its business associate,Tatra Sipox,UK.Government sources said that when the MoU was signed,both the defence ministry and BEML didnt raise any objections to the inclusion of Tatra Sipox,UK. On the tricky issue of indigenization,the MoU states that the DMD Group agreed to consider 30-35 % indigenization of the product,including the chassis to be provided by Tanax /Tatra Sipox,UK.The company had also agreed to consider the transfer of technology to BEML with a minimum 30% indigenization,including the vehicle portion with the super structure to be supplied by the defence PSU with the support of partner,Tatra Sipox,UK. The DMD Group owns four defence companies,including Konstruckta,which has the Intellectual Property Right (IPR) for Zuzana.
New Delhi: The government on Monday suspended BEML chairman and managing director V R S Natarajan,in what looks like a prelude to the defence PSU chief being formally prosecuted by the CBI for alleged financial irregularities in the Tatra trucks,armoured recovery vehicles and other cases. The defence ministrys decision to suspend Natarajan came after a recommendation by the CBI last week that he should be kept away from the post to ensure fair investigation.The charge of BEML has been given to its seniormost functional director P Dwarkanath, said an official.The CBI had sought the dismissal of Natarajan,who has been the chief of Bharat Earth Movers Ltd (BEML) for over a decade now,because he was allegedly influencing witnesses by briefing and de-briefing every BEML official being called for questioning by the investigating agency over the last few weeks,said sources. Already armed with government sanction under Section 6A of the Delhi Special Police Establishment Act,which is required to initiate a preliminary enquiry or chargesheet any officer above the rank of a joint secretary,the agency may now even arrest the suspended chief of the mini-ratna defence PSU.
